RESOLUTION APPROVING CONTRACT
Be it resolved by the City Council of the City of National City as
follows:
That certain contract between City of National City and San Diego
Gas & Electric Company dated the 6th day of October, 1961, a copy of
which is hereto attached and made a part hereof by reference, is hereby
approved and accepted, and the Mayor is authorized and directed to exe-
cute the same for and on behalf of the City of National City,

Contract for Gas Service
THIS CONTRACT, made and entered into this ifettb day of Oftber 194.., by
and between SAN DIEGO GAS & ELECTRIC COMPANY, a corporation, hereinafter called the "Company", and

hereinafter called the "Customer", WITNESSETH:
SECTION I. The Company shall furnish gas service to the Customer at the premises in the County of San Diego,
State of California, more particularly described as follows, to wit:
The Customer agrees to take and use during the term of this contract said gas service for the purpose, and in the operation, of the following
described apparatus:

SECTION II. 68The Company shall furnish and install facilities for the delivery of gas service. Said gas service is to be supplied from a gas
main extension of feet in length. The free footage allowance based on the load listed above and calculated in accordance with the
provisions of the Company's gas main extension rule, as filed with the Public Utilities Commission of the State of California and in effect as of
the date of this contract, is....4610160
SECTION III. The Customer will install and commence using in a bona fide manner, within 6 months after the completion of the gas main
extension and the installation of other facilities required to render gas service, the apparatus listed herein for which a free footage allowance was
made, and continue to so use said apparatus for a period of 36 months.
The term of this contract shall commence either on the date Customer first takes said gas service or on the date 6 months after completion
by the Company of the facilities required to render service, whichever date is the earlier, and shall continue to the close of said period of
months.
SECTION IV. The applicable rates of the Company, as filed with the Public Utilities Commission of the State of California and legally in
effect as of the date of this contract, have�beenqcalled to the Customer's attention, and the Customer hereby designates and agrees to pay for said
gas service in accordance with Schedule._Y...4 or any superseding schedule authorized by said Commission.
The minimum charges, as specified in said schedule, shall be:
(a) $ 14.14.9 per month.
(b) $ • per winter month, December through May.
Nothing hereinabove set forth shall prevent the collection of full charges under the applicable schedule.
SECTION V. In the event the Customer fails to take said gas service or fails to install and use in a bona Me manner during the term of
this contract one or more of the apparatus for which a free footage allowance was made, the Customer shall pay to the Company an amount
necessary to make up any resulting deficit in free line extension allowed by the Company at the cost per foot specified in the Company's gas main
extension rule in effect at the time the extension was made.
SECTION VI. This contract may be assigned by the Customer to a successor using service at the above location, provided said successor
accepts in writing such assignment, or may be superseded by a similar contract covering service to an equal or greater load. Said assignment or
supersedure shall be subject to the approval of the Company as evidenced by written endorsement hereon.

SECTION VII. This contract shall at all times be subject to such changes or modifications by the Public Utilities Commission of the State
of California as said Commission may, from time to time, direct in the exercise of its jurisdiction. The Customer agrees to be bound by and to
comply with the rules of the Company relating to such service, as filed with the Public Utilities Commission of the State of California, a copy
of which is open to public inspection at the Company's office.
All terms and stipulations heretofore made and agreed to by the parties in relation to said gas service are set forth in this contract, and no
representation of any agent or employee shall be binding upon the Company except as herein expressed.
