A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, ORDERING, CAT.T.TNG, PROVIDING FOR AND GIVING NOTICE OF A SPECIAL MUNICIPAL ELECTION TO BE HELD IN SAID CITY ON TUESDAY, NOVEMBER 8, 1960, FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED VOTERS OF SAID CITY A PROPOSITION FOR THE ISSUANCE OF WATER REVENUE BONDS BY SAID CITY AND CONSOLIDATING SAID ELECTION WITH THE STATEWIDE GENERAL ELECTION TO BE HELD ON SAME DATE. The City Council of the City of National City, California, DOES HEREBY RESOLVE, DETERMINE AND ORDER as follows: Section 1. That a special election be held and the same is hereby called to be held in the City of National City, California, on Tuesday, the 8th day of November, 1960, for the purpose of submitting to the qualified voters of said city the proposition of issuing water revenue bonds pursuant to the Revenue Bond Law of 1941 (Chapter 6, Part 1, Division 2, Title 5 of the Government Code of the State of California) in the amount and for the objects and purposes hereinafter set forth, including all expenses incidental thereto or connected therewith. Section 2. That the purpose for which said bonded indebtedness is to be incurred and revenue bonds issued therefor is as follows: revenue bonds as provided herein in not exceeding the principal amount stated in such proposition shall be issued and sold for the pzrpose set forth herein. Said bonds are to be revenue bonds payable exclusively from the revenues of the enterprise and are not to be secured by the taxing power of the City of National City. Section 5. That the enterprise referred to herein is defined to be the entire waterworks system of the City of National City to be acquired, constructed and financed with funds derived from the sale of the revenue bonds herein proposed to be issued, together with all improvements and extensions to said system later constructed or acquired. Section 6. That the polls for said election shall be opened at seven o'clock A.M. of the day of said election and shall remain open continuously from said time until seven o«clock P.M. of the same day, when said polls shall be closed, except as provided in Section 5734 of the Elections Code of the State of California. Section 7. That on the ballots to be used at said special election, in addition to any other matter required by law, there shall be printed substantially the following: 5. Section 8. A cross (-) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be counted in favor of the adoption of the proposition. A cross (4) placed in the voting square after the word "NO" in the manner hereinbefore provided shall be counted against the adoption of the proposition. Section 9. That the manner of holding the election shall be as provided in this resolution and the manner of voting on the issuance of bonds shall be as provided in this resolution. That in all particulars not herein recited the election shall be held and the votes canvassed pursuant to law for general municipal elections held in the City of National City. Section 10. That said special election hereby called to be held in the City of National City on the 8th day of November, 1960, shall be and is hereby ordered consolidated with the statewide general election to be held on said date, and within the City of National City the precincts, polling places and officers of elec- tion for the special election hereby called shall be the same as those provided for said general election. The Board of Supervisors of the County of San Diego is hereby requested to order the consolidation of the special election hereby called with said statewide general election, and said Board of Supervisors is author- ized hereby to canvass the returns of the special election The acquisition, construction and financing of a waterworks system, includ- _ng works and facilities for the produc- tion, storage, treatment, transmission and distribution of water and the acquisi- ;,ion of lands, wells, easements, rights of way and other property necessary therefor, and including all engineering, inspection and legal fees, costs of the issuance of said revenue bonds, bond reserve funds, working capital and other costs and expenses incidental to or connected with such acquisition, con- struction and financing? Section 3. That the estimated cost of such acquisition, construction and financing is $6,000,000. That the principal amount cf the bonds proposed to be issued is $6,000,000. That the maximum rate of inter- est to be paid on said bonds shall not exceed the maximum rate permitted by law, to wit, six per cent (6%) per annum, payable annually for the first year and semi- annually thereafter, the actual rate or rates of interest on said bonds to be determined at or prior to the time of the sale or sales thereof. Section 4. That if the proposition for the incurring of bonded indebtedness so submitted receives the requisite number of votes, to wit: the votes of a majority of all the voters voting on the proposition, 2. MARK CROSS (+) ON BALLOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL. (ABSENTEE BALLOTS MAY BE MARKED WITH PEN AND INK OR PENCIL.) INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+) in the voting square after the word "YES' or after the word "NO". All marks, except the cross (+) are forbidden. All dis- tinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obtain another. On absent voter ballots mark a cross (+) with pen or pencil. ' • . . . . • • : . • hereby called, and the elections shall be held in all respects as if there were only one election, and only one form of ballot, namely the ballots used at such general election, shall be used. Said Board of Super- visors shall certify the result of the canvass of the returns of such special election to the Council of the City of National City who shall thereupon declare the result thereof. Said proposition shall be designated on the ballot by a letter printed on the left margin of the square containing the description of the measure, as provided in Section 3831 of the Elections Code of the State of California. Section 11. That only qualified voters of the City of National City shall be permitted to vote at the election hereby called. Section 12. That the City Clerk shall certify to the passage and adoption of this resolution and shall cause said resolution to be published once a week for two (2) succeeding weeks in the NATIONAL CITY STAR NEWS , a newspaper of general circulation published less than six (6) days a week in the City of National Cilr, and shall also cause said resolution to be posted in three (3) public places in the City of National City for two (2) succeeding weeks prior to said election. No other notice of such election need be given. 6. Section 13. This resolution shall take effect upon its adoption.
