HomeMy WebLinkAboutCC RESO 7818RESOLUTION NO. 7818 RESOLUTION GRANTING ZONE VARIANCE PURSUANT TO ORDINANCE NO. 962 The City Council of the City of National City does hereby find, determine, order and resolve as follows: 1. That practical difficulties, unnecessary hardship, and a result inconsistent with the general purpose and intent of Ordinance No. 962 would occur through strict application of the provisions of said Ordinance to that certain real property herein- after des:ribed. 2. That a Petition requesting a variance has been filed pursuant to the provisions of Section 12 of said Ordinance and said Petition complies with all the requirements of said section. 3. That the National City Planning Commission did hold a hearing on said Petition and did recommend to the City Council that a variance be granted. 4. That the granting of a variance with reference to the property hereinafter described will not defeat, but rather will carry out the general intent and purpose of the National City Zoning Ordinance, will provide for the public safety and welfare and will administer substantial justice. 5. That a variance from the provisions of said Ordinance No. 962 be and hereby is granted with reference to all the certain real property situated in the City of National City, California, more particularly described as follows: Those portions of Blocks 151 and 152 and closed portions of 23rd Street and Harding Avenue lying adjacent thereto, all as shown on Map of National City No. 348 on file in the Recorder's Office of San Diego County, Cali- fornia, more particularly described as follows: (I) Commencing at the Northwest corner of said Block 151; (2) Thence Easterly along the Northerly line of said Block 151, a distance of 200 feet to the TRUE POINT OF BEGINNING; (3) Thence Southwesterly along a straight line which prolonged intersects the Northerly line of Lot 7 of said Block 151 a distance of 75 feet Easterly of the Westerly line of said Block 151, to a point of tangency with a 200-foot radius curve, concave to the East; (4) Thence Southerly along the arc of said curve to a point of tangency with a line parallel with and 75 feet Easterly of the Westerly line of said Block 151; (5) Thence Southerly along said parallel line and its prolongation to the Southerly line of said Lot 152; (6) Thence Easterly along said Southerly line and its prolongation to the Easterly line of said Harding Avenue; (7) Thence Northerly along said Easterly line to the Easterly prolongation of the Northerly line of said Block 151; (8) Thence Westerly along said prolongation and said Northerly line to the TRUE POINT OF BEGINNING. 6. That the variance hereby granted is as follows: Permission to conduct an auto wrecking yard. 7. That said variance is hereby granted upon the following conditions: (a) That said variance shall be valid only so long as the property is being operated by L. Street and/or C. Nenow, and if for any reason whatso- ever both said Street and Nenow cease to be personally active in the operation of said premises, this variance shall ipso facto terminate. (b) That said variance is to be reviewed by the Planning Commission after three years from date of approval by the City Council for further continuation. (c) That said auto wrecking yard be moved easterly to include the closed Harding Avenue as out- lined on Drawing No. V.I1.P.C. dated July 12, 1960, a copy of which is hereto attached. (d) That said auto wrecking yard be cleared from the dedicated Wilson Avenue and the recorded drainage channel easement shown on said drawing. That said vacation be completed within 90 days from the approval of said zone variance by the City Council and if for any reason whatsoever said vacation is not completed within the said 90 days, this variance shall ipso facto terminate. (e) That there be no burning. (f) That the entire area be enclosed by a solid wall or structure not less than 8 feet in height and that none of the material within such enclosure be placed so that such material or any portion thereof extrudes therefrom. (g) That off-street parking be provided inside the enclosure for a minimum of 15 cars. 8. In the event that the City Council should hereafter find and determine that the conditions above set forth have not been satisfied, it may declare this variance void and of no further effect.
