(Hoover Avenue from 13th Street to 18th Street)
The City Council of the City of National City, California,
does hereby resolve, determine and order as follows:
§I. The public interest and convenience require and it
is the irtention of the City Council of said City of National
City to order the following work to be done or improvement to
be made in the City of National City, to wit: that Hoover
Avenue from 13th Street to 18th Street be improved as follows:
by the grading of portion of streets, the preparation of subgrade
and the paving of portions of streets, the constructions of Type
"G" concrete curbs, the construction of concrete sidewalks, con-
crete driveway aprons, concrete cross gutters, and standard
concrete gutters, the removal of concrete sidewalks, concrete
curbs and trees, and that any other work auxiliary to any of the
above and which may be required to carry out the same, be performed.
§2. The attention of all persons is directed to the fact
that all of said classes of work above described may not be con-
structed upon all of the streets or public ways above mentioned
in their entirety, but only upon the particular locations shown
on the plans, specifications and drawings.
§3. The estimated cost of said work, including incidental
expenses, is the sum of $41,322.61. The City of National City
has budgeted the sum of $14,026.14 as a contribution to said cost.
The said city hereby agrees that said sum of $14,026.14, or a sum
equal to 33.94% of the actual cost of said work or improvement,
whichever sum is the lesser, shall be paid to the contractor as a
contribution to said cost.
§4. All the aforesaid work or improvement shall be constructed
at the grades, along the lines, between the points, of the dimensions,
at the places and in the manner shown on the plans, specifications,
profiles and drawings for the said work approved and adopted by this
Council on March 22, 1960 by Resolution No. 7702. Said plans,
specifications, profiles and drawings are on file in the office
of the City Clerk of the City of National City in the City Hall
of said City, and reference is hereby made to said plans,
specifications, profiles and drawings for a full and detailed
description of said proposed work and for a description of the
grades at which said work is to be done. Said grades are hereby
adopted and established as the official grades for all purposes
in connection with proceedings pursuant to this Resolution of
lntentior. Notice is hereby given that said grades may be new
and different from those heretofore established or existing, or
may be, end in some cases are, different from existing ground
levels.
§5. In the opinion of this City Council, the said con-
templated work is of more than local or ordinary public benefit
and this City Council hereby makes the expense of said work
chargeable upon a district, which district this City Council
hereby declares to be the district benefited by the said work and
to be assessed to pay the cost and expenses thereof. For a
description of said district, reference is hereby made to a plat
or map of said district heretofore approved by this City Council
on file in the office of the City Clerk and designated as "MAP OF
PROPOSED ASSESSMENT DISTRICT FOR THE IMPROVEMENT OF HOOVER AVENUE
FROM 13th STREET TO 18th STREET AND PORTIONS OF INTERSECTION
THEREOF, ALL IN THE CITY OF NATIONAL CITY, CALIFORNIA." This map
or plat indicates by a boundary line the extent of the territory
included in the said proposed district and shall govern for all
details es to the extent of said assessment district.
§6. All public streets or public parks, and all easements
or rights of way belonging to the public, and also all property
owned by the United States of America or the State of California
now in use in the performance of a public function are hereby
specifically excluded from this assessment district.
§7. Serial bonds bearing interest at the rate of six per
cent (670) per annum shall be issued to represent each assessment
of fifty dollars ($50.00) or over remaining unpaid for thirty (30)
days after the date of recordation of the warrant. Said serial
bonds shall extend over a period ending nine (9) years from the
second day of January next succeeding the next September 1
following their date. Said bonds are to be issued pursuant to
and as provided in the Improvement Act of 1911, Division 7 of the
Streets and Highways Code of the State of California.
§8. The said proposed work is to be done under and pro-
ceedings therefore are to be under and pursuant to the said
Improvement Act of 1911.
§9. Notice is hereby given that the pr day of June, 1960,
at the hour of 2:00 o'clock p.m., are the day and hour when, and
the Council Chambers of this City Council in the City Hall in the
City of National City is the place where, any and all persons
having ary protest or objection to said proposed work or to the
extent of said assessment district, or to the proposed grades, may
appear before the City Council of the City of National City and
show cause why said proposed work should not be carried out in
accordance with this Resolution of Intention. Protests or objec-
tions must be in writing and must be slivered to the City Clerk
of said City of National City not later than the hour herein set
for hearing protests or objections.
§10. The report of the City Engineer pursuant to the pro-
visions of the Special Assessment Investigation, Limitation and
Majority Protest Act of 1931, and the report of the City Manager
and the City Engineer of the hearing on said report are on file
with the City Clerk of National City and may be examined in her
office.
§II. The National City Star News is hereby selected as the
newspaper in which this resolution shall be published and in which
all other publications regarding the proceedings pursuant to this
Resolution of Intention shall be made. The City Clerk is hereby
directed to certify to the adoption of this resolution and to
cause said resolution to be published in the manner provided by
law.
§I2. The City Clerk is hereby directed to mail notices of
the adoption of this resolution as provided in said Improvement
Act of 1211, postage prepaid, to all persons owning real property
which is proposed to be assessed to pay any part of the cost of
said work whose names and addresses appear on the last equalized
assessment roll or as known to the City Clerk.
§13. The Street Superintendent of the City of National
City is hereby directed to cause to be conspicuously posted along
the line of the contemplated work and on all open streets within
the said assessment district notices of the passage of this
Resolution of Intention in the time, form and manner provided
by law.
