(28th Street Between National Avenue and "B" Avenue and
"B" Avenue Between 27th Street and 28th Street)
The City Council of the City of National City, California,
does hereby resolve, determine and order as follows:
§I. The public interest and convenience require and it
is the intention of the City Council of said City of National
City to order the following work to be done or improvement to
be made in the City of National City, to wit: that 28th Street
between National Avenue 505and "B" Avenue between
27th Street and 28th Street be improved as follows: by the
grading of portions of streets, the preparation of subgrade and
paving of portions of streets, the construction of Type G curb,
the construction of sidewalk, the construction of cross gutter,
the construction of driveways, the construction of Alley Apron
and curbs and the resetting of Manholes to grade, and that any
other wo.r< auxiliary to any of the above and which may be re-
quired to carry out the same, be performed.
§2. The attention of all persons is directed to the fact
that all of said classes of work above described may not be con-
structed upon all of the streets or public ways above mentioned
in their entirety, but only upon the particular locations shown
on the plans, specifications and drawings.
§3. The estimated cost of said work, including incidental
expenses, is the sum of a25,057.09. The City of National City
has budgeted the sum of $4,824.47 as a contribution to said cost.
The said City hereby agrees that said sum of $4,824.47, or a sum
equal to 19.25% of the actual cost of said work of improvement,
whichever sum is the lesser, shall be paid to the contractor as
a contribution to said cost.
§4. All the aforesaid work or improvement shall be con-
structed at the grades, along the lines, between the points, of
the dimensions, at the places and in the manner shown on the
plane specifications, profiles and drawings for the said work
approved and adopted by this Council on March 15, 1960 by
Resolution No. 7696. Said plans, specifications, profiles
and drawings are on file in the office of the City Clerk of
the City of National City in the City Hall of said City, and
reference is hereby made to said plans, specifications, profiles
and drawings for a full and detailed description of said pro-
posed work and for a description of the grades at which said
work is to be done. Said grades are hereby adopted and es-
tablished as the official grades for all purposes in connection
with proceedings pursuant to this Resolution of Intention.
Notice is hereby given that said grades may be new and different
from those heretofore established or existing, or may be, and
in some cases are, different from existing ground levels.
§5. In the opinion of this City Council, the said con-
templated work is of more than local or ordinary public benefit
and this City Council hereby makes the expense of said work
chargeable upon a district, which district this City Council
hereby declares to be the district benefited by the said work
and to be assessed to pay the cost and expenses thereof. For a
description of said district, reference is hereby made to a plat
or map of said district heretofore approved by this City Council
on file in the office of the City Clerk and designated as "MAP OF
PROPOSED ASSESSMENT DISTRICT FOR THE IMPROVEMENT OF 28th STREET
BETWEEN NATIONAL AVENUE AND B AVENUE; B AVENUE BETWEEN 27th STREET
AND 28th STRELI; AND PORTIONS OF INTERSECTIONS THEREOF." This map
or plat indicates by a boundary line the extent of the territory
included in the said proposed district and shall govern for all
details as to the extent of said assessment district.
§6. All public streets or public parks, and all easements
or rights of way belonging to the public, and also all property
owned by the United States of America or the State of California
now in use in the performance of a public function are hereby
specifically excluded from this assessment district.
§7. Serial bonds bearing interest at the rate of six per
cent (6%) per annum shall be issued to represent each assessment
of fifty dollars ($50.00) or over remaining unpaid for thirty
(30) days after the date of recordation of the warrant. Said
serial bonds shall extend over a period ending nm,ne (9) years
from the second day of January next succeeding the next September
1 following their date. Said bonds are to be issued pursuant to
and as provided in the Improvement Act of 1911, Division 7 of the
Streets and Highways Code of the State of California.
§8. The said proposed work is to be done under and pro-
ceedings therefore are to be under and pursuant to the said
Improvement Act of 1911.
§9. Notice is hereby given that the 21st day of June, 1960,
at the hour of 2:00 o'clock P.M., are the day and hour when, and
the Council Chambers of this City Council in the City Hall in the
City of National City is the place where, any and all persons
having any protest or objection to said proposed work or to the
extent of said assessment district, or to the proposed grades,
may appear before the City Council of the City of National City
and show cause why said proposed work should not be carried out
in accorcance with this Resolution of Intention. Protests or
objections must be in writing and must be delivered to the City
Clerk of said City of National City not later than the hour herein
set for hearing protests or objections.
§IC. The report of the City Engineer pursuant to the pro-
visions cf the Special Assessment Investigation, Limitation and
Majority Protest Act of 1931, and the report of the City Manager
and the City Engineer of the hearing on said report are on file
with the City Clerk of National City and may be examined in her
office.
§ll. The National City Star News is hereby selected as the
newspaper in which this resolution shall be published and in which
all other publications regarding the proceedings pursuant to this
Resolution of intention shall be made. The City Clerk is hereby
directed to certify to the adoption of this resolution and to
cause said resolution to be published in the manner provided by
law.
§12. The City Clerk is hereby directed to mail notices of
the adoption of this resolution as provided in said Improvement
Act of 1911, postage prepaid, to all persons owning real property
which is proposed to be assessed to pay any part of the cost of
said work whose names and addresses appear on the last equalized
assessment roll or as known to the City Clerk.
§I. The Street Superintendent of the City of National
City is hereby directed to cause to be conspicuously posted along
the line of the contemplated work and on all open streets within
the said assessment district notices of the passage of this
Resolution of Intention in the time, form and manner provided by
law.
