(Highland Avenue from 4th Street to 8th Street)
The City Council of the City of National City, California,
does hereby resolve, determine and order as follows:
§I. Ile public interest and convenience require and it is
the intention of the City Council of said City of National City
to order the following work to be done or improvementsto be made
in the C'ty of National City, to wit: that Highland Avenue from
4th Street to 8th Street be improved as follows: by the grading
of portions of streets, the preparation of subgrade and the
paving of portions of streets, the construction of Standard Type
"G" Curbs, the construction of Cross -Gutters, the construction of
Standard Driveways, the construction of P.C.C. Sidewalks, the
removal of Existing Curbs, the removal of Existing Sidewalks, the
resetting of Manhole frames to Grade, the construction of P.C.C.
Sidewalk Segments, and the removal of Existing Pavement and that
any other work auxilliary to any of the above and which may be
required to carry out the same, be performed.
§2. The attention of all persons is directed to the fact
that all of said classes of work above described may not be con-
structed upon all of the streets or public ways above mentioned
in their entirety, but only upon the particular locations shown
on the plans, specifications and drawings.
§3. The estimated cost of said work, including incidental
expenses, is the sum of $39,716.85. The City of National City has
allocated the sum of $19,723.12 as a contribution to said cost.
§4. All the aforesaid work or improvements shall be con-
structed at the grades, along the lines, between the points, of
the dimensions, at the places and in the manner shown on the plans,
specifications, profiles and drawings for the said work approved
and adopted by this Council on March 3, 1959 by Resolution No. 7433.
Said plans, specifications, profiles and drawings are on file in the
office oY the City Clerk of the City of National City in the City
Hall of said City, and reference is hereby made to said plans,
specifications, profiles and drawings for a full and detailed
descripton of said proposed work and for a description of the
grades at which said work is to be done. Said grades are hereby
adopted and established as the official grades for all purposes
in connection with proceedings pursuant to this Resolution of
Intention. Notice is hereby given that said grades may be new
and different from those heretofore established or existing, or
may be, and in some cases are, different from existing ground
levels.
§5. In the opinion of this City Council, the said contem-
plated work is of more than local or ordinary public benefit and this
City Council hereby makes the expense of said work chargeable upon
a district, which district this City Council hereby declares to be
the district benefited by the said work and to be assessed to pay
the cost and expenses thereof. For a description of said district
reference is hereby made to a plat or map of said district hereto-
fore approved by this City Council on file in the office of the City
Clerk and designated as "MAP OF PROPOSED ASSESSMENT DISTRICT FOR THE
IMPROVEMENT OF HIGHLAND AVENUE BETWEEN FOURTH STREET AND EIGHTH
STREET AND PORTIONS OF INTERSECTIONS THEREOF." This map or plat
indicates by a boundary line the extent of the territory included
in the said proposed district and shall govern for all details as
to the extent of said assessment district.
§6. All public streets or public parks, and all easements or
rights of way belonging to the public, and also all property owned
by the United States of America or the State of California now in
use in the performance of a public function are hereby specifically
excluded from this assessment district.
§7. Serial bonds bearing interest at the rate of six per cent
(6%) per annum shall be issued to represent each assessment of fifty
dollars 0.00) or over remaining unpaid for thirty (30) days after
the date of recordation of the warrant. Said serial bonds shall
extend over a period ending nine (9) years from the second day of
January next succeeding the next October I5th following their date.
Said bonds are to be issued pursuant to and as provided in the
Improvement Act of 1911, Division 7 of the Streets and Highways
Code of the State of California.
§8. The said proposed work is to be done under and proceedings
therefore are to be under and pursuant to the said Improvement Act
of 1911.
§9. Notice is hereby given that the ISth day of May, 1959, at
the hour of 2:00 o'clock P.M., are the day and hour when, and the
Council Chambers of this City Council in the City Hall in the City
of National City is the place where, any and all persons having
any protest or objection to said proposed work or to the extent of
said assessment district, or to the proposed grades, may appear
before the City Council of the City of National City and show cause
why said proposed work should not be carried out in accordance with
this Resolution of Intention. Protests or objections must be in
writing and must be delivered to the City Clerk of said City of
National City not later than the hour herein set for hearing pro-
tests or objections.
§10. The report of the City Engineer pursuant to the pro-
visions of the Special Assessment Investigation, Limitation and
Majority Protest Act of 1931, and the report of the City Manager
and the City Engineer of the hearing on said report are on file with
the City Clerk of National City and may be examined in her office.
§Il. The National City Star News is hereby selected as the
newspaper in which this resolution shall be published and in which
all other publications regarding the proceedings pursuant to this
Resolution of Intention shall be made. The City Clerk is hereby
directed to certify to the adoption of this resolution and to
cause said resolution to be published in the manner provided by law.
§12. The City Clerk is hereby directed to mail notices of the
adoption cf this resolution as provided in said Improvement Act of
1911, postage prepaid, to all persons owning real property which is
proposed to be assessed to pay any part of the cost of said work
whose names and addresses appear on the last equalized assessment roll
or as known to the City Clerk.
13. The Street Superintendent of the City of National City is
hereby directed to cause to be conspicuously posted along the line
of the contemplated work and on all open streets within the said
assessment district notices of the passage of this Resolution of
Intention in the time, form and manner provided by law.
