HomeMy WebLinkAboutCC RESO 7516RESOLUTION NO. 77 C. RESOLUTION ACCEPTING ASSIGNMENT WHEREAS, on the 23rd day of December, 1958 this City Council by its Resolution No. 7369 did award a contract to J. L. McElvaney for a certain work of public improvement upon a portion of National City Tidelands; and WHEREAS, pursuant to such award a contract was made and entered into by and between City of National City and J.L. McElvaney dated the 3rd day of February, 1959; and WHEREAS, on May 14, 1959 said J.L. McElvaney did execute an assignment in writing wherein and whereby any amounts re- maining unpaid by City of National City pursuant to said contract were assigned to the El Centro Branch, Bank of America National Trust and Savings Association; and WHEREAS, the City Council has been requested to; honor said assignment of any additional sums which may become due pursuant to said contract; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF NATIONAL CITY AS FOLLOWS: That the City Council of City of National City does hereby consent to and accept said assignment, a duplicate original of which is attached hereto and by reference is made a part hereof. That the Mayor is hereby authorized and directed to accept said assignment for and on behalf of City of National City. That the City Clerk be and hereby is authorized to execute a warrant payable to Bank of America National Trust and Savings Association for any sums which may be found to be due to said J.L. P McElvaney pursuant to said contract, and the City Treasurer be and hereby is authorized to honor and pay said warrant. PASSED AND ADOPTED this 2nd day of June, 1959. F` ATTEST: CITY CLERK MAYOR J. Yaeckel Dear 3ir: We have a contract w.th the city of National City, City off' Chula Vista end the Santa Fe Land Company for the construction of a dike in the Tidelands locPted between the City of National City and Chula Vista. The aggregate amount of the contract is $. 2,000.00, to be paid thirty dAys after completion. The dike is 60% completed at this date and will require an additional ninety days for completion. We do here and now es of above date assign any amounts due us when and if paid by the Santa Fe Land Company end the Cities of National City and Chula 1tista to the Bank of America, El Centro ranch, to be applied as payment on our note with Bank of America at El Centro.
