(Harding Avenue from I3th Street to 20th Street and
20th Street from Harding Avenue to Wilson Avenue)
The City Council of the City of National City, California,
does hereby resolve, determine and order as follows:
I. The public interest and convenience require and it is
the intention of the City Council of said City of National City
to order the following work to be done or improvement to be made
in the City of National City, to wit: that Harding Avenue from
I3th Street to 20th Street and 20th Street from Harding Avenue
to Wilson Avenue be improved as follows: by the grading of
portions of streets, the preparation of subgrade and the paving
of portions of streets, the construction of type "Gm concrete
curbs, the construction of concrete sidewalks, the construction
of concrete driveway aprons, the construction of concrete cross -
gutters, the construction of standard alley aprons, the construc-
tion of standard concrete gutters, the construction of standard
A.C. curb, the removal of concrete sidewalks, the removal of con-
crete curbs and the removal of trees and that any other work
auxilliary to any of the above and which may be required to carry
out the same, be performed.
§2. The attention of all persons is directed to the fact
that all of said classes of work above described may not be con-
structed upon all of the streets or public ways above mentioned
in their entirety, but only upon the particular locations shown
on the plans, specifications and drawings.
§3. The estimated cost of said work, including incidental ex-
penses, is the sum of $49,997.22. The City of National City has
allocated the sum of $21,014.00 as a contribution to said cost.
§4. All the aforesaid work or improvement shall be con-
structed at the grades, along the lines, between the points, of
the dimensions, at the places and in the manner shown on the plans,
specifications, profiles and drawings for the said work approved
and adopted by this Council on May 19, 1959 by Resolution No.
7502. Said plans, specifications, profiles and drawings are on
file in the office of the City Clerk of the City of National City
in the City Hall of said City, and reference is hereby made to
said plans, specifications, profiles and drawings for a full and
detailed description of said proposed work and for a description
of the grades at which said work is to be done.
Said grades are
hereby adopted and established as the official grades for all
purposes in connection with proceedings pursuant to this Resolu-
tion of Intention. Notice is hereby given that said grades may
be new and different from those heretofore established or existing,
or may be, and in some cases are, different from existing ground
levels.
5. In the opinion of this City Council, the said contem-
plated work is of more than local or ordinary public benefit and
this City Council hereby makes the expense of said work chargeable
upon a district, which district this City Council hereby declares
to be the district benefited by the said work and to be assessed
to pay the cost and expenses thereof. For a description of said
district,reference is hereby made to a plat or map of said district
heretofore approved by this City Council on file in the office of
the City Clerk and designated as "MAP OF PROPOSED ASSESSMENT DISTRICT
FOR THE IMPROVEMENT OF HARDING AVENUE FROM 13th ST. TO 20th ST., AND
20th STREET FROM WILSON AVE. TO HARDING AVENUE, ALL IN THE CITY OF
NATIONAL CITY." This map or plat indicates by a boundary line the
extent of the territory included in the said proposed district and
shall govern for all details as to the extent of said assessment
district.
§6. All public streets or public parks, and all easements or
rights of way belonging to the public, and also all property owned
by the United States of America or the State of California now in
use in the performance of a public function are hereby specifically
excluded 'rom this assessment district.
§7. Serial bonds bearing interest at the rate of six per cent
(6%) per annum shall be issued to represent each assessment of
fifty dolyars (S50.00) or over remaining unpaid for thirty (30) days
after the date of recordation of the warrant. Said serial bonds
shall extend over a period ending nine (9) years from the second day
of January next succeeding the next October 15th following their
date. Said bonds are to be issued pursuant to and as provided in
the Improvement Act of 1911, Division 7 of the Streets and Highways
Code of the State of California.
§8. The said proposed work is to be done under and proceedings
therefore are to be under and pursuant to the said Improvement Act
of 1911.
§9. Notice is hereby given that the 25th day of August, 1959,
at the hour of 2:00 o'clock P.M., are the day and hour when, and
the Council Chambers of this City Council in the City Hall in the
City of National City is the place where, any and all persons
having any protest or objection to said proposed work or to the
extent of said assessment district, or to the proposed grades, may
appear before the City Council of the City of National City and show
cause why said proposed work should not be carried out in accordance
with this Resolution of Intention. Protests or objections must be
in writing and must be delivered to the City Clerk of said City of
National City not later than the hour herein set for hearing protests
or objections.
§10. The report of the City Engineer pursuant to the provisions
of the Special Assessment Investigation, Limitation and Majority
Protest Act of 1931, and the report of the City Manager and the City
Engineer of the hearing on said report are on file with the City
Clerk of National City and may be examined in her office.
1. The National City Star News is hereby selected as the
newspaper in which this resolution shall be published and in which
all other publications regarding the proceedings pursuant to this
Resolution of Intention shall be made. The City Clerk is hereby
directed to certify to the adoption of this resolution and to
cause said resolution to be published in the manner provided by
law.
§12. The City Clerk is hereby directed to mail notices of
the adoption of this resolution as provided in said Improvement
Act of 1911, postage prepaid, to all persons owning real property
which is proposed to be assessed to pay any part of the cost of
said work whose names and addresses appear on the last equalized
assessment roll or as known to the City Clerk.
§13. The Street Superintendent of the City of National City
is hereby directed to cause to be conspicuously posted along the
line of the contemplated work and on all open streets within the
said assessment district notices of the passage of this Resolution
of Intention in the time, form and manner provided by law.
