HomeMy WebLinkAboutCC RESO 7429RESOLUTION NO. 74+�9 RESOLUTION GRANTING SPECIAL ZONE VARIANCE Be it resolved by the City Council of the City of National City as follows: That a special zone variance permit be granted to South Bay Properties, Inc. for the purpose of developing the property hereinafter described for retail sale purposes and commercial use with variance in size of signs and setback requirements. Said property is described in Exhibit A hereto attached and by reference made a part hereof. That said permit is granted upon the conditions and recommendations of the City Planning Commission as hereinafter set forth: 1. All improvement plans shall be submitted to and approved by the Planning Commission prior to the commencement of any work on said property. 2. Any building constructed for the purpose of retail sales may con- tain a maximum of a 200,000 square feet of ground floor area. 3. Any sign placed on the property shall be in strict compliance with the requirements established by Ordinance No. 750 for C-3 Districts. 4. For each structure there shall be maintained a minimum parking area of 3,000 square feet for each 1,000 square feet of floor area constructed. 5. A 10 foot setback from Highland Avenue shall be maintained at all times for any structure erected on said property. 6. South Bay Properties, Inc. shall dedicate for street purposes an additional 5 foot right of way from the North line of 12th Street to the center line of 13th Street for the establishment of E Avenue as a 60 foot right of way. 7. South Bay Properties, Inc. at its sole cost and expense shall improve the right of way so dedicated in accordance with National City specifications. Such work shall be approved by the City Engineer prior to the time that any permission to occupy any structure erected on the property is given. 8. Plans and specifications shall be submitted to the City Engineer for construction of drainage facilities. After approval of such plans and specifi- cations by the City Engineer, South Bay Properties, Inc. at its sole cost and expense shall construct drainage facilities in accordance with such plans and specifications. Such drainage facilities as constructed shall be approved by the City Engineer prior to the issuance of a permit to occupy any building r erected on said property. Construction is to be commenced within 180 days from date hereof. Any violation of any of the above conditions shall void this peewit and the same shall be lapse and be of no effect.
