HomeMy WebLinkAboutCC RESO 7290RESOLUTION OF INTENTION NO. 7290 (20th Street, A and B Avenues) The City Council of the City of National City, California, does hereby resolve, determine and order as follows: §1, The public interest and convenience require and it is the 'ntention of the City Council of said City of National City to order the following work to be done or improvement to be made in the City of National City, to wit: That 20th Street from National Avenue to B Avenue; A Avenue from 21st Street to 475 feet north of 20th Street; and B Avenue from 18th Street to 22nd Street be improved as follows: by the excavation of road- way, the grading of portions of streets, the preparation of subgrade for the paving of portions of the streets, the con- struction of standard type "G" curbs, the construction of con- crete sdewalks, the construction of standard gutters and cross -gutters, the construction of concrete driveways, driveway approaches, alley aprons and curbs, and concrete berm, the removal of existing sidewalks, curbs, driveways, cross -gutters, trees and obstructions, resetting existing manhole frame and cover, the paving of portions of the streets, and the relocation of water lines and that any other work auxilliary to any of the above and which may be required to carry out the same, be performed. §2. The attention of all persons is directed to the fact that all of said classes of work above described may not be constructed upon all of the streets or public ways above mentioned in their entirety, but only upon the particular locations shown on the Mans, specifications and drawings. §3, The estimated cost of said work, including incidental expenses, is the sum of 67,730,51. The City of National City has allocated the sum of S14,053.98 as a contribution to said cost. §4, All the aforesaid work or improvement shall be con- structed at the grades, along the lines, between the points, of the dimensions, at the places and in the manner shown on the plans, specifications, profiles and drawings for the said work approved and adopted by this Council on June 17, 1958 by Resolut on No. 7243. Said plans, specifications, profiles and drawings are on file in the office of the City Clerk of the City of National City in the City Hall of said City, and reference is hereby made to said plans, specifications, profiles and drawings for a full and detailed description of said pro- posed work and for a description of the grades at which said work is to be done. Said grades are hereby adopted and establisd as the official grades for all purposes in connection with pro- ceedings pursuant to this Resolution of Intention. Notice is hereby liven that said grades may be new and different from those heretofore established or existing, or may be, and in some cases are, different from existing ground levels. §5, In the opinion of this City Council the said contem- plated work is of more than local or ordinary public benefit and this City Council hereby makes the expense of said work charge- able upon a district, which district this City Council hereby declares to be the district benefited by the said work and to be assessed to pay the cost and expenses thereof. For a description of said district reference is hereby made to a plat or map of said district heretofore approved by this City Council on file in the jffice of the City Clerk and designated as "Map of Proposed Assessment District for the improvement of 20th Street from National Ave, to "B" Ave.; "A" Avenue from 21st St. to 475 feet (*) north of 20th St,; and "B" Avenue from 18th St. to 22nd St; and portions of intersections thereof." This map or plat indicates by a boundary line the extent of the territory included in the said proposed district and shall govern for all details as to the extent of said assessment district. J §o. All public streets or public parks, and all easements or rights of way belonging to the public, and also all property owned by the United States of America or the State of California now in Jse in the performance of a public function are hereby specifically excluded from this assessment district. §7. Serial bonds bearing interest at the rate of six per cent (6'a) per annum shall be issued to represent each assess- ment of fifty dollars ( 0.00) or over remaining unpaid for thirty (30) days after the date of recordation of the warrant Said seeial bonds shall extend over a period ending nine (9) years f-om the second day of January next succeeding the next October 15th following their date. Said bonds are to be issued pursuant to and as provided in the Improvement Act of 1911, Division 7 of the Streets and Highways Codqbf the State of Cal iforiia. §8. The said proposed work is to be done under and pro- ceedings therefore are to be under and pursuant to the said Improvement Act of 1911. §9. Notice is hereby given that the 2nd day of September, 1958, a-: the hour of 2:00 o'clock P.M., are the day and hour when, aid the Council Chambers of this City Council in the City Hall in the City of National City is the place where, any and all persons having any protest or objection to said proposed work or to the extent of said assessment district, or to the proposed grades, may appear before the City Council of the City of National City and show cause why said proposed work should not be tarried out in accordance with this Resolution of Intention. Protests of objections must be in writing and must be delivered to the City Clerk of said City of National City not later than the hour herein set for hearing protests or objections. §10. The report of the City Engineer pursuant to the pro- visions of the Special Assessment investigation, Limitation and Majority Protest Act of 1931, and the report of the City Manager and the City Engineer of the hearing on said report are on file with the City Clerk of National City and may be examined in her office. §!I. The National City Star News is hereby selected as the newspaper in which this resolution shall be published and in which a 1 other publications regarding the proceedings pursuant to this Resolution of Intention shall be made. The City Clerk is hereby directed to certify to the adoption of this resolution and to cause said resolution to be published in the manner pro- vided by law. 12. The City Clerk is hereby directed to mail notices of the adoption of this resolution as provided in said Improvement Act of 1911, postage prepaid, to all persons owning real property which is proposed to be assessed to pay any part of the cost of said work whose names and addresses appear on the last equalized assessment roll or as known to the City Clerk. §1:3. The Street Superintendent of the City of National City is hereby directed to cause to be conspicuously posted along the line of the contemplated work and on all open streets within the said assessment district notices of the passage of this Resolution of intention in the time, form and manner pro- vided by law.
