HomeMy WebLinkAboutCC RESO 7337RESOLUTION NO. 7337 The City Council of the City of National City, California does hereby find, determine and order as follows: I. That ever since the 1st day of April, 1886 and for several years prior thereto, there has existed within the boundc;ries of the City of National City, California a public streetand highway commonly known as Highland Avenue. 2. That from time to time since said 1st day of April, 1886, the California Water and Telephone Company, a corporation, has placed poles, water meters, fire hydrants and other appurtenances upon, in and under said Highland Avenue. 3. That public convenience and necessity demands that the poles, water meters, fire hydrants and other appurtenances so placed upon, in and under Highland Avenue by said California Water and Telephone Company be relocated and moved to different positions upon, in and under said Highland Avenue in order not to irterfere with the improvement of Highland Avenue described on City of National City Engineering Department, Drawing Nos. 337-L., 340-L, 341-L, 342-L, 343-L, 348-L, and 350-L to which reference is hereby made. 4. That on or about the 8th day of July, 1958, the City Engineer of National City served notice on said California Water and _{elephone Company that its poles, water meters, fire hy- drants and miscellaneous appurtenances so placed upon, in and unde^ said Highland Avenue between 8th Street and 18th Street would have to be relocated. 5. That the City Council of National City has caused to be published an invitation to bidders to submit proposal for a con- tract for the improvement of Highland Avenue between 8th Street and 18th Street in accordance with the above numbered drawings of the National City City Engineering Department and expects to award a contract for said work of improvement within the next fifteen (15) days. 6. That the California Water and Telephone Company has failed and neglected to relocate its said poles, water meters, fire hydrants and other appurtenances, and has notified the City cf National City that it will not do so unless the City of National City first pays to said California Water and Telephone Company a portion of the estimated cost of making such relocation. 7. That public convenience and necessity requires the relocation of said poles, water meters, fire hydrants and other appurtenances prior to the commencement of the improvement of Highland Avenue between 8th and 18th Streets and so as not to interfere with said work of improvement, and that it is within the poIiCe power of this City Council to order such relocation of facilities. 8. That the Superintendent of Streets of the City of National City be and hereby is authorized and directed to re- move any of said poles, water meters, fire hydrants or appurten- ances of the California Water and Telephone Company located upon, in and under Highland Avenue between 8th and 18th Streets which may interfere with the said work of improvement, provided, however, that if said California Water and Telephone Company noti'ies the Superintendent of Streets in writing that it will do said work of relocation itself and so as not to interfere with the work of improvement, the Superintendent of Streets need not make such removalof facilities. 9. That the City Attorney of National City is hereby authorized to institute whatever legal process may appear necessary or proper in order to protect the interests of the City of National City in this matter.
