RESOLUTION CONFIRMING ASSESSMENT
(18th Street)
WHEREAS, Byri D. Phelps, acting as the Superintendent
of Streets of the City of National City, California, has
heretofore filed in the office of the City Clerk of National
City an assessment and diagram for that certain street im-
provement work in said City done under and pursuant to the
"Improvement Act of 1911," Division 7 of the Streets and
Highways Code of the State of California, and Resolution of
Intention No. 6877 adopted by this City Council on the 26th
day of February 1957; and
WHEREAS, after the filing of said assessment and
diagram the City Clerk has, as required by law, given notice of
the filing of said assessment and of the time fixed in said
notice for hearing by this City Council, and affidavits of
publication, posting and mailing of such notice have been
made and are on file in the office of the City Clerk, and
WHEREAS, at the time and place fixed in such notice a
hearing was duly held by this City Council at which all written
appeals, protests or objections, if any, were duly presented
and read, and all persons desiring to be heard thereon were
heard, and this City Council gave all persons present an
opportunity to be heard in respect to any matter relating to
said work or improvement, to any act of determination of the
said Byrl D. Phelps acting as the Superintendent of Streets
and the Engineer of Work of National City in relation thereto,
to the contract for said work or the performance of said
contract, to the correctness of said assessment of said diagram,
or to any other act, determination or proceedings of said
Superintendent of Streets or said Engineer of Work, or to any
matter relating -to said work, the assessment district or the
proceedings
therefore; and
WHEREAS, request has been made to divide assessment No.203
in the sum of $4,217.35 into assessment No. 203 for the sum of
$2,780.00 and assessment No. 203 A for the sum of $1,437.35; and
WHEREAS, request has been made to divide assessment No.I09
in the sum of $1,230.02 into assessment No. 109 and I09A each
for the sum of $615.0I and
WHEREAS, the City Council pursuant to the provisions of §
5367 of the Streets & Highways Code of California has authorized
the modification of the assessment to provide ,for assessments 109,
109A, 203 and 203A for the above sums;and Byrl D. Phelps as
Superintendent of Streets has so corrected the diagram; and
WHEREAS, the protest of, William H. and Gladys 1. Phillips
having in writing presented to the City Council having been
waived; and
WHEREAS, all persons desiring to be heard have been heard
by this City Council, and this City Council being fully informed
in the premises;
NOW THEREFORE, the City Council of the City of National City,
California DOES HEREBY FIND, RESOLVE, DLIERMINE AND ORDER as
follows:
That said hearing has been duly held; that each and every
step in the proceeding prior to and including the hearing has
been duly and regularly taken; that this City Council is satisfied
with the correctness
of the assessment as corrected, the diagram,
the proceedings and all matters relating thereto, and all protests,
objections or appeals be and the same are hereby overruled and
denied, and this City Council does hereby confirm said proceedings
and said corrected assessment.
