HomeMy WebLinkAboutCC RESO 7252RESOLUTION OF INTENTION NO. 7252 (Third Street and J Avenue) The City Council of the City of National City does hereby resolve, determine and order as follows: Section 1. The public interest and convenience require and it is the intention of the City Council of .said City of National City to order the follow- ing work to be. done or improvement to be made in the City of National City, to wit: That Third Street from the centerline of Laurel Avenue to the west line of J Avenue and of J Avenue from the north line of Third Street to the centerline of Fourth Street be improved as follows: by the grading of portions of streets, the preparation of subgrade for the paving of portions of the streets, the construction of standard type "G" curbs, the construction of concrete sidewalks, the construction of cross -gutters, the construction of concrete driveways, the construction of type. "A-2" curb inlets, the construction of reinforced concrete pipe culverts, the removal of existing sidewalks, resetting existing manhole rims to new grades, the removal of existing type "G" curbs, the paving of portions of the streets, the reconstruction of existing inlets to a junction and cleanout, and the relocation of water lines behind water meters, and that any other work auxiliary to any of the above and which may be required to carry out the same be performed. Section 2. The attention of all persons is directed to the fact that all of said classesof work above described may not be constructed uponall of the streets or public ways above mentioned in their entirety, but only upon the particular locations shown on the plans, specifications and drawings.. Section 3. The estimated cost of said work, including incidental expenses, is the sum of $21, 767. 39. The City of National City has allocated the sum of $5, 204.. 98 as a contribution to said cost. Section 4. All the aforesaid work or improvement shall beconstructed at the grades, along thelines, between the points, of the dimensions, at the places and in the manner shown on the plans, specifications, profiles and drawings for the said workapproved and adopted by this Council on June 24, 1958, by Resolution No. 7248. Said plans, specifications, profiles and draw- ings are on file in the office of the City Clerk of the City of National City in the City Hall of said city, and reference is hereby made to said plans, speci- fications, profiles and drawings for a full and detailed description of said proposed work and for a description of the grades at which said work is to be done. Said grades are hereby adopted and established as the official grades for all purposes in connection with proceedings pursuant to this reso- lution of intention. Notice is hereby given that said grades may be new and different from those heretofore established or existing, or may be, and in some cases are, different from existing ground levels. Section 5. In. the opinion of this City Council the said contemplated work is of more than local or ordinary public benefit and this. City Council hereby makes the expense of said work chargeable upon a district, which district this City Council hereby declares to be the district benefited by the said work and to be assessed to pay the cost and expenses thereof. For a description of said district reference is hereby made to a plat or map of said district heretofore approved by this City Council on. file in the office of the City Clerk and designated as "Map of Proposed Assessment District for the Improvement of Third Street from the centerline of Laurel Avenue to the west line of J Avenue and of J Avenue from the north line of Third Street to the centerline of Fourth Street." This map or plat indicates by a boundary line the extent of the territory included in the said proposed district and shall govern for all details as to the extent of said assessment district. Section 6. All public streets or public parks, and all easements or rights of way belonging to the public, and alsoall property owned by the United States of America or the State of California now inuse in the perform- ance of a public function are hereby specifically excluded from this assess- ment district. Section. 7. Serial bondsbearing interest at the rate of six per cent (6%) per annum. shall be issued to represent each assessment of fifty dollars ($50. 00) or over remaining unpaid for thirty (30) days after the date of record- ation of the warrant. Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next October 15 following their date. Said bonds are to be issued pursuant to and as provided in the Improvement Act of 1911, Division 7 of the Streets and Highways Code of the State of California. Section 8. The said proposed work is to be done under and proceedings therefor are to be under and pursuant to the said Improvement Act of 1911. Section 9. Notice is hereby given that the 22nd day of July, 1958, at.. the hour of 2 o'clock p. m. , are the day and hour when, and the Council Chambers of this. City Council in the City Hall in the Gity of National City is the place where, any and all persons having any protest or objection to said proposed work or to the extent of said assessment district, or to the proposed grades, may appear before the. City Council of the City of National City and show cause why said proposed work should not be carried out inaccordancewith this resolution of intention. Protests or objections must be in writing and must be delivered to the Gity Clerk of said City of National City not later than the hour herein set for hearing protests or objections. Section 10. The report of the City Engineer pursuant to the provisions of the Special Assessment Investigation, Limitation and Majority Protest Act of 1931, and the report of the City Manager and the Gity Engineer of the hearing on said report are on file with the City Clerk of National City and may be exarrrined in her office. Section 11. The National City Star News is hereby selected as the newspaper in which this resolution shall be published and in which all other publications regarding the proceedings pursuant to this Resolution of Intention shall be made. The Gity Clerk is hereby directed to certify to the adoption of this resolutionand to causesaid resolution to be published in the manner provided by law. Section 12. The. City Clerk is hereby directed to mail noticesof the adoption of this resolution as provided in said Improvement Act of 1911, postage prepaid, to all persons owning real property which is proposed to beassessed to pay any part of thecost of said work whose names and addresses appear on the last equalized assessment roll or as known to the City Clerk. Section. 13. The Street Superintendent of the Gity of National City is hereby directed to cause to beconspicuously posted along the line of the con- templated work and on all open streets within the said assessment district notices of the passage of this Resolution of Intention in the time, form and manner provided by law.
