AVENUE IN THE CITY OF NATIONAL CITY
BE IT RESOLVED by the City Council of the City
of National City that it is the intention of said City
Council to order the following work to be done and impro-
vements to be made in the City of National City, County
o.f San Diego, State of California, to wit:
That Harbison Avenue, Kenton Avenue, Belmont
Avenue, Drexel Avenue and Clairmont Avenue from Division
Street to Cervantes Street and Norfolk Street from
Clairmont Avenue to Euclid Avenue be improved as follows:
that portions of the streets be graded; that subgrades be
prepared and that portions of the streets be paved; that
concrete driveways be constructed; that standard gutters
be constructed; that cross gutters be constructed, that
existing curbs be removed and standard type "G° curbs be
constructed; that concrete sidewalks be removed and re-
placed; that manhole rims be reset to grade; that curb
be depressed at all driveways; and that existing obstruc-
tions be removed as shown upon the plans, and that any
other work auxilliary to any of the above and which may
be required to carry out the same be performed.
All of the above mentioned work is more parti-
cularly and specifically set forth and described in the
plans, profiles and specifications for said work hereto-
fore adopted by the City Council of the City of National
City by its Resolution No. 6779 which plans, profiles and
specifications are hereby referred to for all particulars
in connection therewith. The public streets and rights -
of -way hereinabove referred to are shown and delineated
in detail and specifically located on the plans herein -
above referred to, and reference is hereby specifically
made to said plans, and notice is hereby given to all parties
that specific locations thereof are contained in said
plans;. and that
BE IT FURTHER RESOLVED that all of the said work
hereinbefore generally described shall be constructed in
said streets, avenues, roads, lanes, courts, places and/or
public ways hereinabove described, of the dimensions,
materials, and in the particular locations set forth and
shown on the plans and specifications and detailed drawings
hereinabove and hereafter referred to; together with the
construction of all appurtenances thereto, including
necessary fittings, trenchings, grading and regrading,
excavation and fill, removal of obstructions, connections
to existing services, back filling, reconstruction of
existing ground surface as required to conditions existing
prior to commencement of construction, all in the manner,
of the materials and to the dimensions and to the grades,
and in the particular locations as the same are more fully
shown on the plans and specifications and detailed drawings
hereinabove and hereafter referred to;
That the structures and work and improvements
herein described shall be constructed to the ,grades,
sub;rades and elevations severally shown upon the plans,
profiles and detailed drawings thereof in the r espective
locations thereof, to which plans and profiles reference
is hereby expressly made for a description of the grades
to which all of the work and i:provements under this
Resolution of Intention shall be done, which said grades
are hereby adopted and established as the official grades

therefor for all purposes in connection with proceedings
pursuant to this Resolution of Intent=on; notice is hereby
further given that said grades are or may be, in part,
new and different from those heretofore established or
existing, or may be, and in some cases are, different from
existing ground levels;
All of said work and improvements shall be done
to the lines and grades as shown on the plans and profiles
and in accordance with the plans and specifications here-
tofore, and on the lath day of November, 1956, adopted by
the City Council of the City of National City by Resolu-
tion No. 6779 for the doing of said work and improvement,
and which are now on file in the office of the City Clerk
of the City of National City. Said plans and specifications,
said profiles and detailed drawings and diagrams accompanying
the same are hereby expressly referred to for full and
detailed description and location of said proposed work
and improvements, the public streets and rights -of -way
involved, and of the grades to which said improvements
are to be constructed.
F.Xcepting from all of the herein described work
all of said work that has already been done to the lines
and grades shown on said plans and profiles, and in accord-
ance with said plans and specifications;
All of said work shall include, without dupli-
cation, any and all streets intersections, terminations
and opposite terminations occurring within the limitations
of said work;
The attention of all persons is directed to the
fact that all of said classes of work above described my
not be constructed upon all of the streets and/or public
ways above described in their entirety, but only upon the
particular locations as shown on the plans and specifications,
to which the attention of all persons is directed for a
description of the work to be done upon each of the
several public streets or rights -of -way named, a des-
cription of the streets and rights -of -way, and for all
other information contained in the said plans and speci-
fications pertinent to the doing and completion of the
work and improvements herein proposed; and
That the City of National City has allocated
the sum of $1,654.16 from its drainage fund and that said
sum will be contributed towards the total cost of said
proposed improvement, and that the sum of 41,634.16 shall
be paid out of the Treasury of the City of National City
from the drainage fund for this purpose; and that the
City of National City has allocated the sum of 4572.00
from its sewer fund and that said sum will be contributed
towards the total cost of said proposed improvement, and
that the sum of 4572.00 shall be paid out of the Treasury
of the City of National City from the sewer fund for this
purpose; and that the City of National City has allocated
the sum of 412,009.58 from its general fund and that said
sum will be contributed towards the total cost of said
proposed improvement, and the the sum of $12,009.58 shall
be paid out of the Treasury of the City of National City
from the general fund for this purpose; and that the
remaining cost of said work and improvements willbe
assessed on the property owners benefited pursuant to
the provisions of the Improvement Act of 1911 and this
Resolution of Intention.
-EAS, said contemplated work and improvements,
in the opinion of this City Council, is of more than local
or ordinary benefit, said City Council hereby makes the
expenses and costs of said work and improvements chargeable
upon a district, which said district said City Council
hereby declares the district benefited by the work and
improvements herein described; said district shall in-
clude that territory in the City of National City, County
of San Diego, State of California, which is shown on that
certain plat or map No. 121-A on file in the office of the
City Clerk of the City of National City and which is
entitled and described as "Map of Proposed Assessment
District for the Improvement of Harbison Avenue, Kenton
Avenue, Belmont Avenue, Drexel Avenue and Clairmont
Avenue from Division Street to Cervantes Street and
Norfolk Street from Clairmont Avenue to Euclid Avenue,
and which said map of plat was approved and adopted by
the City Council by Resolution No. 6788 on the 20th day
of November, 1956, and which indicates, by a boundary
line, the extent of the territory included in the proposed
district and covers all details as to the extent of the
area to be assessed; said map or plat is, by this reference
incorporated herein and made a part hereof;
Excepting therefrom the area shown and delineated
on said map or plat, hereinabove referred to, the area of
all public streets, avenues, lanes, roads, drives, courts,
places, public parks, and all easements and rights -of -way
therein contained belonging to the public, and also all
property owned by the United States of America, the State
of California, or any of its political subdivisions, a
municipal corporation, or a quasi -municipal corporation
contained therein, now in use in the performance of a public
function.
Notice is hereby given that the report of the
City Engineer and the report of the City Manager and the
City Engineer on the hearing on said report, pursuant to
the provisions of the Special Assessment Investigations,
Limitation and Majority Protest Act of 1931, are on file
with the City Clerk of National City and may be examined
at her office.
The said Council hereby determines and declares
that serial bonds shall be issued to represent each assess-
ment of twenty-five dollars or more remaining unpaid after
the full expiration of thirty days from the date of the
warrant, to represent the expenses of said work and
improvement. Said serial bonds shall extend over a period
ending nine years from the second day of January next
succeeding the next October 15th following their date,
aid at the expiration of said time the whole sum then
unpaid shall be due and payable; but on the second day
of January of each year following the next October 15th
after their date, an even annual proportion of its whole
amount shall be due and payable, upon presentation of the
coupon therefore, until the whole is paid. Said bonds
shall bear interest at the rate of six per cent per annum,
interest payable semi-annually by coupon, on all sums
unpaid until the whole of said principal and interest
thereof shall be paid under and in pursuance to the
"Improvement Act of 1911" and amendments thereto.
The City Council of the City of National City
has ascertained and declared by adoption of Resolution
No. 6847 on the 5th day of February, 1°57 the prevailing
rate of per diem wages paid by private employers in the
said City of National City, for the same quality of service
for a day of eight (8) hoursfor each craft, labor, type
of workman or mechanic needed to execute said work, and
by this reference thereto said Resolution is made a part
hereof.
NOTICEnIS HER"� BY GIVEM, that on `/G/e.r'.,4y , the
A) day of ,APR ( , 1957, at 2:00 P.M. of said day,
at the meeting place of the City Council of the City of
National City, 1243 National Avenue, in the City- of National
City, County of San Diego, State of California, any and
all persons having any objections to the proposed work or
improvement, to the grade at which said work is to be
done, or to the extent of the district to be assessed to
pay the costs and expenses of said proposed work or
improvement, may appear before said Council and show cause
why said proposed improvement should not be carried out
in accordance with this Resolution.
Such protest, if any, must be in writing, and
must contain a description of the property in which each
signer thereof is interested, sufficient to identify the
same, and shall be delivered and filed with the City Clerk
of said City. No other protests or objections will be
considered.
That the City Clerk of the City of National City
shall cause this Resolution of Intention to be published
twice in the National City Star News, which said newspaper
has heretofore been designated by said City Council as
the newspaper in which shall be printed and published
all notices, resolutinns, orders and other matters required
to be published in the proceedings taken pursuant to this
Resolution and under the provisions of said Improvement
Act of 1911" and amendments thereto; the first publication
of said notice shall not be less than teri(10) days prior
to the date herein fixed for hearing on this Resolution
of Intention;
That the City Clerk be, and is hereby directed
to mail notice of adoption of this Resolution of Intention,
postage prepaid, to all persons owning real property pro-
posed to be assessed, whose names and addresses appear
on the last equalized County Assessment Roll, at his address
as shown upon such roll, or as known to the City Clerk,
and as to property, if any, assessed by the State under
Section 14 of Article XIII of the Constitution to every
owner of such property at the address thereof shown on
the last State Board of Equalization roll transmitted to
the San Diego County Auditor. Said mailing shall be at
least fifteen days prior to the day herein fixed for the
hearing on this Resolution of Intention, all in the time,
form and manner required by law.
The Clerk of said City shall, upon completion
of the mailing of said notices, file with the City Council
an affidavit setting forth the time and manner of the com-
pliance with the above requirements for mailing such notices.
That the Street Superintendent of said City
shall, after the adoption of this Resolution of Intention,
cause to be conspicuously posted along the line of said
contemplated work or improvement, at not more than three
hundred feet in distance apart, but not less than three
in all, notices of the passage of this Resolution of
Intention, and when the work to be done is only upon an
entire crossing or intersection or any part thereof,
he shall cause such notices to be conspicuously posted
in front of each quarter block or irregular block liable
to be assessed, and when the work is chargeable upon a
district, he shall cause such notices to be conspicuously
posted upon all open streets within such district at
not more than three hundred feet in distance apart on
each street so posted; all in the time, form and manner
required by law; and thereupon said Street Superintende nt
shall cause to be filed in the office of the City Clerk
of said City, an affidavit showing the posting of said
notices of improvement.
All of the herein proposed work shall be done
in pursuance of an Act of the Legislature of the State of
California designated as the "Improvement Act of 1911"
and amendments thereto.
