HomeMy WebLinkAboutCC RESO 6949RESOLUTION NO. 6949 BE IT RESOLVED by the City Council of the City of National City as follows: That THE ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY, a corporation, is hereby permitted to construct, maintain and operate a spur track across 19th Street in the City of National City, the centerline of such track being more particularly described as follows: Beginning on the northerly line of Nineteenth Street, 10.98 feet easterly from the easterly line of Tidelands Avenue; thence southerly 65.45 feet along the arc of a curve concave easterly and having a radius of 941.70 feet; thence continuing southerly 21.58 feet tangent to said curve to point of ending in the southerly line of Nineteenth Street 17.47 feet easterly from the easterly line of Tidelands Avenue. This permit is granted upon the following express conditions and limitations: A. The permittee shall align and grade and realign and regrade the spur track as necessary in order to conform to the grade or subgrade of any street that may be constructed at any time in the future; such work to be at the sole cost and expense of the permittee; B. The permittee shall pave, at its own cost and expense,. that portion of the street used by the spur track in the event that said street is improved by City of National City; C. All work, including grade and subgrade, shall be installed in accordance with City of National City specifications; D. Permittee shall, at its own costs and expense, relocate said track should anyaark of improvement by City of National City require any such relocation. E. BE IT RESOLVED FURTHER that this permit is revocable at the will of the City Council of the City of National City and is hereby granted on the express condition of said revocability.
