HomeMy WebLinkAboutCC RESO 6995RESOLUTION NO. 6995 BE IT RESOLVED by the City Council of the City of National City as follows: That Resolution No. 6834 adopted by this City Council on January 15th, 1957 be, and the same hereby is, amended to read as follows: WHEREAS, the Engineer of Work has heretofore filed his report pursuant to the provision of the Special Assessment Investigation, Limitation and Majority Protest Act of 1931 for the proposed improvements of Eighteenth Street between Palm and Rachael; and WHEREAS, pursuant to the authorization of the City of National City hearings conducted by the City Manager and the report on said hearing has been filed is now on of the City Council on said report have been Engineer of Work and a with the City Council and of National City pursuant to the provisions of section 2858 of the Streets and Highways Code of California. WHEREAS, at the hearing on said report certain property owners appeared and protested the proposed improvement. NOW THEREFORE, be it resolved by the City Council of the City of National City as follows: The City Council of National City hereby finds and determines that the percentage of owners protesting the said proposed improvement is less than 21 and is insufficient to prevent the making of said proposed improvement. That the said protests, and each of them, be, and the same hereby are, overruled and denied. The said City Council of National City hereby finds and determines that the proposed project is feasible and that the lands so to be assessed will be able to carry the burden of such file with the Clerk of the City II 1 proposed assessment and that the limitations on the amounts of assessments provided for in Part 5 of Division 4 of the Streets and Highways Code of the State of California may and shall be disregarded both with respect to the limitation on the district as a whole and as to the limitation on individual specific assessments. The City Council of the City of National City further finds and determines that the public interest, convenience and necessity require the acquisition or improvement substantially as set forth in the above described report and that the project is feasible and that the same should proceed under the law stated in the report as the statute under which the proceeding is to be conducted.
