HomeMy WebLinkAboutCC RESO 7030RESOLUTION NO. 7030 The City Council of the City of National City, California does hereby resolve, order and determine as follows: I. That pursuant to Ordinance No. 913 a hearing was duly and regularly held by the City Council of said City at 2:00 P.M. on the 4th day of June, 1957 in the City Council Chamber in the City Hall, National City, California regarding the closing of the hereinafter described portions of its public streets and alleys. 2. That no one appeared to object to the closing of said portions of City of National City's public streets and alleys. 3. That after hearing and considering the evidence pro- duced at said hearing, the City Council does hereby find that said portions of City of National City's public streets and alleys hereinafter described are not now necessary for present or prospective public street or public alley purposes, and that it is in the best interest of the City of National City to now close said portions of its public streets and public alleys. 4. That pursuant to said finding and determination those portions of the public alleys and public streets of the City of National City, California more particularly described as follows: Parcel One: The alley in Block 271, from the south line of 14th Street to the north line of 15th Street. Parcel Two: All of 15th Street from the east line of Harrison Avenue (formerly Ninth Avenue) to the west line of Cleveland Avenue (formerly Eighth Avenue). Parcel Three: All of 161h Street from the east line of Harrison Avenue (formerly Ninth Avenue) to the west line of Cleveland Avenue (formerly Eighth Avenue). All as shown on °City Plat" according to Map thereof No. 348 on file in the Recorder's Office of San Diego County, California. be and the same hereby are vacated, subject, however, to the following express conditions and reservation of rights: a. A reservation of easement and rights of way for structures enumerated in Section 8330 of the of the Streets and Highways Code of the State of California. b. The covenant and obligation on the part of the owners of the adjoining property to install sidewalks and curbs to the satisfaction of the City Engineer of National City; said covenant and obligatbn to be secured by a surety bond approved by the City Council of the City of National City in the sum of $6,000.00 to guarantee the performance of this condition on the part of said adjoining property owners. c. That the adjoining property owners, their heirs and assigns hold City of National City free and harmless for any injury tv the streets of National City resulting from the use of the railroad spur track from said premises. d. That any box cars left on said spur track from said premises overnight have affixed thereto adequate lighting devices. 5. That the City Clerk of the City of National City is hereby authorized and directed to record in the office of the Recorder of San Diego County, California a certified copy of this Resolution duly attested under the seal of the City of National City.
