HomeMy WebLinkAboutCC RESO 7057RESOLUTION NO. 7057 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA REAFFIRMING ITS DECISION TO ENTER INTO AN AGREEMENT WITH THE.SOUTH BAY IRRIGATION DISTRICT FOR THE JOINT ACQUISITION, OWNERSHIP AND. OPERATION OF.THE .SWEETWATER WATER.SYSTEM OF.THE - CALIFORNIA WATER AND.TELEPHONE COMPANY. WHEREAS, the City Council of National City did have a joint meeting with the Board of Directors of the South Bay Irrigation District on November 28th, 1956, for the purpose of determining the best possible method of submitting to the voters of the City of National City and of the South Bay Irrigation District a proposal as to whether or not the voters desired to acquire the Sweetwater Water System of the California Water and Tele- phone Company, and WHEREAS, a further joint meeting of the City Council and the District Directors was held on January 16th, 1957 to con- sider the recommendations of special bond counsel in this regard, and WHEREAS, at said meeting JOHN Q. JEWEII of the engineering firm of Leeds, Hill and Jewett personally appeared and advised that the joint operation of said Sweetwater Water System was feasible from an engineering point of view, and WHEREAS, at said meeting the retaining of the law firm of O'Melveney and Myers and the engineering flim of Leeds, Hill and Jewett and the preparation of an agreement for the joint acquisition, ownership and operation of the Sweetwater Water System by City of National City and South Bay Irrigation District was authorized, and WHEREAS, pursuant to such authority an agreement entitled "Joint Powers Agreement of 1957 between the South Bay Irrigation District and the City of National City" has been presented to the City Council and the District..,Directors, and WHEREAS, the said Joint Powers Agreement of 1957 was read aloud word for word and considered section by section at joint meetings of the City Council of National City and the Board of Directors of the South Bay Irrigation District on August 6th and August 12th, 1957, and WHEREAS, a meeting to discuss further said Joint Powers Agreement has been scheduled for September 5, 1957. NOW THEREFORE, BE IT RESOLVED by the City Council of the City of National City as follows: I. The City Council of the City of National City does hereby approve, adopt and accept in principle the Joint Powers Agreement of 1957 drafted by the law firm of O'Melveny and Myers in cooperation with the Attorney for the South Bay Irrigation District, the engineering firm of Leeds, Hill and Jewett and the City Attorney of National City. 2. The City Council recognizes that certain changes in the agreement may be desirable provided that they can be made within the framework of the agreement as submitted. 3. In order to expedite the submission of a proposal to the voters of the City of National City and to the voters of the South Bay Irrigation District as to whether or not the Sweetwater Water System should be acquired for public operation; the City Clerk is directed to mail -to each member of the Board of Directors of the South Bay Irrigation District a copy of this resolution, together with a request that the South Bay Irrigation District agree on a list of proposed changes to the Joint Powers Agreement to be considered at the September 5, 1957 joint meeting. 4. The Finance Committee of the City Council is directed to prepare a list of proposed changes to said agreement and to deliver the same to the City Clerk. 5. The City Clerk is directed to prepare an agenda of changes proposed by the South Bay Irrigation District and the Finance Committee after consulting with the Assistant Secretary of the South Bay Irrigation District, and to send a copy of such agenda to each councilman and each director not later than August 30th, 1957.
