RESOLUTION CONFIRMING ASSESSMENT
(Fourth Street)
WHEREAS, WAYNE P. LILL as the Superintendent of
Streets of the City of National City, California, has heretofore
filed in the office of the City Clerk of National City an
assessment and diagram for that certain street improvement
work in said City done under and pursuant to the "Improvement
Act of 1911," Division 7 of the Streets end Highways Code of the
State ofCalifornia, and Resolution of Intention No. 6946
adopted by this City Council on the 14th day of May, 1957; and
WHEREAS, after the filing of said assessment and diagram
the City Clerk has, as required by law, given notice of the
filing of said assessment and of the time fixed in said notice
for hearing by this City Council, and affidavits of publication,
posting and mailing of such notice have been approved by this
City Council and are on file; and
WHEREAS, at the time and place fixed in such notice
a hearing was duly held by this City Council at which ail
written appeals, protests of objections, if any, were duly
presented and read, and all persons desiring to be heard thereon
were heard, and this City Council gave all persons present an
opportunity to be heard in respect of any matter relating to
said work or improvement, to any act or determination of the
Superintendent of Streets or the Engineer of Work of National
City in relation thereto, to the contract for said work or the
performance of said contract, to the correc*ness of said
assessment or said diagram, or to any other act, determination
or proceedings of said Superintendent of Streets or said
Engineer of Work, or to any matter relating to said work, the
assessment district or the proceedings therefore, and
WHEREAS, all such persons desiring to be heard
have been heard by this City Council, and this City Council
is fully informed in the premises;
NOW THEREFORE, the City Council of the City of
National City, California DOES HEREBY FIND, RESOLVE, DETERMINE
AND ORDER as follows:
L. That said hearing has been duly held; that
each and every step in the proceeding prior to and including
the hearing has been duly and regularly taken, that this City
Council is satisfied with the correctness of the assessment, the
diagram, the proceedings and all matters relating thereto, and
all protests, objections, or appeals be and the same are hereby
overruled and denied, and this City Council does hereby con-
firm said proceedings and said assessment.
