ILR(,.`m 7ET Ow FIFTH STREET IF THE CITY OF NATIONAL CITY, CALIFORNIA BE IT RESOLVED by the City Council of the City of rational City as follows; That it is the intention of said City Council to order the following work to be done and improvements to be made in the City of National City, County of San Diego, State of California to wit: That Fifth Street between the centerline of Palm Avenue and the westerly boundary of Palmcrest Subdivision No. 2 per map No. 2562 on file in the office of the Recorder of the County of San Diego, State of California, be graded and paved; that gutters and cross -gutters be constructed therein; that existing manhole rims therein be reset to grade; that any existing obstructions therein be removed, and that any other work auxilliary to any of the above and which may be required to carry out the same, be performed. All of the above mentioned work is more particularly and specifically set forth and described in the plans, profiles and specifications for said work heretofore adopted by the City Council of the City of National City by its Resolution No. 6592, adopted March 20th, 1956, which plans, profiles and specifications are hereby referred to for all particulars in connection therewith. The publi..c streets and rights -of -way hereinabove referred to are shown and delineated in detail and specifically located on the plans hereinabove referred to, and reference is hereby specifically made to said plans, and notice is hereby given to all parties that specific locations thereof are contained insaid plans; and that all of the said work hereinabove generally described shall be constructed in said streets, avenues, roads, lanes, courts, place and/or public ways hereinabove described, of the dimensions, - 1 - materials, and in the particular locations set forth and shown on the plans and specifications and detailed drawings hereinabove and hereafter referred to, together with the construction of all appurtenances thereto, including necessary fitting, trenchings, grading and regrading, excavation and fill, removal of obstructions, connections to existing services, back filling, reconstruction of existing ground surface as required to conditions existing prior to commencement of construction, all in the manner, of the materials and to the dimensions and to the grades, and in the particular locations as the same are more fully shown on the plans and specifications and detailed drawings hereinabove and hereafter referred to; That the structures and work and improvements herein described shall be constructed to the grades, subgrades and detailed drawings thereof in the respective locations thereof, to which plans and profiles reference is hereby expressly made for a description of the grades to which all of the work and improve- ments under this Resolution of Intention shall be done, with said grades are hereby adopted and established as the official grades therefor for all purposes in connection with proceedings pursuant to t his Resolution of Intention; notice is hereby further given that said grades are or may be, in part, new and different from those heretofore established or existing, or may be, and in some cases are, different from existing ground levels; All of said work and improvement shall be done to the lines and grades as shown on the plans and profiles ani1 in accord- ance with the plans and specifications heretofore, and on the 20th day of Larch, 1956, adopted by the City Council of the City of National City by Resolutidn No. 6592 for the doing of_ said work and improvement, and which are now en file in the office of the City Clerk of the City of National City. Said plans and specifications, said profiles and detailed drawings and diagrams accompanying the sameare hereby expressly referred to for full - 2 - and detailed description and location of said proposed work and improvements, the public streets and rights -of -ay involved, and the grades of the public streets andrights-of-way:nvolved, and of the grades to which said improvements are to be constructed. Excepting from all of the herein described work all of said w ork that has already been done to the line and grades shown on said plans and profiles, and in accordance w ith said plans and specifications; All of said work shall include, without duplication., any and all streets intersections, terminations and opposite termina- tons ooeuring within the limitations of said work; �i'he a��: �ention of all persons is directed to the Fact that all of said classes of work above described may not be constructed upon all of the streets and/or public ways above described in their entirety, but only upon_ the particular locations as shown on the plans and specifications, to which the attention of all persons is directed for a description of the fork to be done upon each of the several public streets of rights -of -Way named, a description of t hestreets and rights-of;Nay, and for all other information contained in the said plans and specifications per- tinent to the doing and completion of the work and improvements herein proposed; and WHEREAS, said contemplated work and improvements, in the opinion of this City Council, is of .more than local or ordinary benefit, said City Council hereby makesthe expenses and costs of. said work and improvements chargeable upon a district, which said district said City Council hereby declares the district benefited by the work and improvements herein described; said district shall include that territory in the City of Natidnal City, County of Saneiego, State of California, s: hich is shown on that certain plat or map on file in the office of the City Clerk of the City of National City, and which was approved and adopted by the City Council, by Resonation No. 6580 on the - 3 - 6th day of I�arc'h, 1956, and which said map or plat indicates, by a boundary line, the extent of the territory included in the pro- posed district and covers all details as to the extent of the area to be assessed; said map or plat is, by this reference, incorporated herein and made a part hereof; Excepting from the area shown and delineated on said map or plat, hereinabove referredto, the area of all public streets, avenues, lanes)roads, drives, courts, places, public parks, and all easements and right-oiluay therein contained belonging to the public, and also all property owned by the United States of America, the State of California, or any of its Political subdivisions, a municipal corporation, or a quasi -municipal corporation contained therein, now in use in the performance of a public function. NOT1C1 IS BY GIVEN THAT serial bonds shall be issued to represent each assessment of twenty-five dollars or .::ore re- maininrz unpaid after the full expiration of thirty days from the date of the warrant, to represent the expenses of said work and and improvement. Said serial bonds shall extend over a period ending nine years from the second day of January next succeeding the next October 15th following their date, and at the expiration of said time the whole sum then unpaid shell be due and payable; on the second day of January of each year_tllowing the next October 15th after their date, an even annual proportion of its whole amount shall be due and payable, upon Presentation of the coupon therefore, until the whole is Paid. Said bonds shall bear interest at the rate of six per cent per annum, interest payable semi- annually by coupon, on all sums unpaid until the whole of said Principal and interest are paid. Said bonds shall be issued and the Principal and interest thereof shall be paid under and Pursuant to the "Improvement and amendments thereto. I- �r.;orove9 �ment Act of 1., The City Council of the City of National City has ascertained and declared by adoption of Resolut:_on No. 6679 , on the 26thday of June , 1956, the °reveling rate of per diem wages paid by private employers in the said City of National City, for the same quality of service for a day of eight (8) hours for each craft, labor, type of workman or mechanic needed to execute said work, and by this reference thereto said Resolution is niede a part hereof. NOTICE IS H1_:BY C IVEN, that on Tuesday the 7th day of Aughst , 1956, at 2:00 o'clock P.; of -said day, at the meeting place of the City Council of the City of National City, 1245 National Avenue, in the City of National City, County of San Diego, State of California, any and all persons having any objections to the proposed work or improvement, to the grade at which said work is to be done, or to the extent of the district to be assessed to pay the costs ande xpenses of said proposed work or improvement, may apear before said Council and show cause why• said proposed improvement should not be carried out in accordance with this Resolution. Such protest, if any, must be in writing, and must contain a description of the property in which each signer thereof is interested, sufficient to identify the same, and shall be delivered and filed with the City. Clerk of said City. No other protests or objections will be considered. That the City Clerk of the City of national City shall cause this Resolution of Intention to be published twice in the NATIONAL CITY STAR ' W:S, which said newspaper has heretofore been designated by said City Council as the newspaper in which shall be printed and published all notices, resolutions, orders and other ;natters required to be published in the proceedings taken pursuant to this Resolution and under the provisions of Said "Improvement Act of 1911" and amendments thereto; the first publication of said notice shall not be less than ten (10) days prior to the date herein f ixed for healing on t his Resolution of Intention; - 5 - That the City Clerk be, and is hereby directed to mail notice of adoption of this Resolution of Intention, postage pre- paid, to all persons owning real property proposed to be assessed, whose names and afidresses appear to be on the last equalized County Assessment Roll, at his address as shown upon such r o11, , Clerk and to any persons, whether owner or as known to the City in fee or having a lien upon, or legal or equitable interest in any land within said proposed district, who has filed his name and address and the designation of the land in which he is interested with the Clerk of the said City, all in the time, fora: and manner required by law. If property assessed by the state ender Section 14 of Article XIII of the Constitut_on is proposed to be assessed, such notice shall be mailed to every owner of such property at the address thereof shown on the last State Board of Equalization roll transmitted to the County Auditor. Said railing shall be at least fifteen days prior to the d ate herein f ired for the hearing of this Resolution of Intention, all in time time, form, and manner prescribed by law. That the Street Superintendent of said City shall, after the adoption of this Resolution of Intention, cause to be conspicuously; posted along the line of said contemplated work or improvement, at not more than three hundred feet in distance apart, but not less than three in all, notices of the passage of this Resolution of Intention, and when the work to be done is only upon an entire crossing or intersection or any part thereof, he shall cause such notices to be conspicuously posted in front of each quarter block or irregular block liable to be assessed, and wha the work is chargeable upon a district, he shall cause such notices to be conspicuously posted upon all open streetswit'hin such district at not more than three hundred feet in distance apart on each street so posted; all in the time, 6 firm and manner required by law; and thereupon said Street Superintendent shall cause to be filed in the office of the City Clerk of said City, an affidavit showing the posting of said notices of improvement. All of the herein proposed work and all acts hereby ordered shall be done in pursuance of an Act of the Legislature of the State of California, designated as the "Improvement Act of 1911" and amendments thereto, PASS AND ADO-TLD this z ' day of July, 1956.
