RESOLUTION FINDING AND DETERMINING THE PERCENTAGE
OF DEMANDS BY PROPERTY OWNERS FOR INVESTIGATION
UNDER THE PROVISIONS OF DIVISION 4 OF THE STREETS
AND HIGHWAYS CODE OF THE STATE OF CALIFORNIA

WHEREAS, after proceedings duly had and taken by Resolution
No. 6695 of the Resolutions of the City Council of the City of
National City, adopted on the 24th day of July, 1956, and
pursuant to the provisions of the "Special Assessment Investigation,
Limitation and Majority Protest Act of 1931", which is now embodied
in Division 4 of the Streets and Highways Code of the State of
California, this City Council has determined and declared that
it is the initial view of this City Council that the improvements
contemplated and described in Resolution No. 6694 of the
Resolutions of the City Council, City of National City, adopted
on the 24th day of July, 1956, is one in which the probable
assessment will not exceed the limitations set up by said Act; aril
WHEREAS, the City Clerk of the City of National City has
given notice of the contemplated action of the City Council of
the City of National City in the time, form and manner provided
by the said Act and has made and filed her affidavit showing
mailing of notices in accordance with the provisions of said Act;
and
WHEREAS, the 6th day of August, 1956, is the date fixed in
said notice from which the time of the property owners to register
their opinions and decisions shall run, and more than thirty (30)
days has expired fr.:m and after said last mentioned date;
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council
of the City of National City that the number of returned postcards,
in response to said notices have been computed and tabulated;
that as a result of said computation and tabulation, this
City Council hereby finds and determines that the owners of
more than fifteen (15) percent of the area of land proposed
to be assessed for the proposed improvement described in
said Resolution No. 6694 have demanded the making of the
investigation provided for under the provisions of the "Special
Assessment, Investigation, Limitation and Majority Protest Act
of 1931."
That a hearing on the report of the City Engineer regarding
said proposed improvement shall be held by the City Manager
and the City Engineer on the _-y day of October, 1956 at the
hour of 8:00 o'clock P.M. in the City Council Chambers, City
Hall, National City, California.
That before the day of September, 1956 the City
Clerk shall give notice of said hearing by mailing a copy of
the notice, postage prepaid, to all persons owning real property
which is lroposed to be assessed to pay an part of the cost
of the work, and whose names and addresses appear on the last
equalized County Assessment Roll, at his address as shown upon
such Roll or as known to the Clerk.
That at the hearing protest may be made orally or in
writing by any person who would be entitled to protest or object
to the ordering of the things proposed to be done at a hearing
on the Resolution of Intention. All written protest must be
filed with the City Clerk at or before the time fixed for the
hearing. Any protest relating to the regularity or sufficiency
of the proceedings shall be in writing and shall clearly set
forth the irregularity of defeat to which objection is made.
