HomeMy WebLinkAboutCC RESO 6744RESOLUTION NO. 6744 RESOLUTION DECLARING THAT PROCINGS HAVE BEEN INITIATED BY THE COUNCIL OF THE CITY OF NATIONAL CITY TO ANNEX TO SAID CITY CERTAIN UNI HABITED TERRITORY DESCRIBED HEREIN AND DESIGNATED DANIELSON ANNEXATION: AND GIVING NOTICE OF THE PROPOSED ANNEXATION. BE IT RESOLVED BY THE COUNCIL OF THE CITY OF NATIONAL CITY: 1. That, pursuant to the provisions of the Annexation of Uninhabited Territory Act of 1939, proceedings have been initiated by the Council of the City of National City, on its own motion, to annex to the City of National City all that uninhabited territory situate in the County of San Diego, State of California, hereby designated as "Danielson Annexation'' and described as follows: All that portion of 40 Acre Lot 2of Quarter Section 134 of Rancho de la Nacion according to Map thereof by Morrill, No. 166, filed in the office of the County Recorder of San Diego County, California, described as follows: Beginning at the centerline of "L" Avenue in the Northerly line of 30th Street as shown on Map of 0livewood Terrace No. 1542 on file in the office of the County Recorder of San Diego County, California, said point being also a point in the Southerly boundary of the City of National City, California, said point being also in the West line of 40 Acre Lot 2 of said Quarter Section 134; Thence from said point of beginning Southeasterly along said West line 401.42 feet more or less to a point in the North line of Olivewood Acres Subdivision as shown by Map No. 1665filed in said Recorder's Office; Thence northeasterly along said North line to the North- easterlycorner of Lot 15 of said subdivision; Thence!' continuing in the same course across "Edgemere Avenue as shown on County Surveyor's Map No. R. S. 670 to a point of intersection with a line parallel to and 30 feet easterly from the centerline of said "Edgmere Avenue" Thence Northwesterly along said parallel line to the South- easterly corner of Lot 13 in Jeraulds Subdivision as shown on Map No. 1034 filed in said Recorder's Office, said corner being also a point in the Northerly line of 30th Street as shown on said Map No. 1034; Thence Westerly along said Northerly line of 30th Street as shown on said Maps No. 1034 and 1542 to the point of beginning. 2, That the Council of the City of National City desires to annex said uninhabited territory to the City of National City for the following reasons: The territory is continguous to the City of National City, and its proposed annex- ation will contribute to and facilitate the orderly growth and development of both the City and the territory proposed to be annexed; will facilitate and contribute to the proper and orderly layout, design and construction of streets, gutters, sidewalks, sanitary and storm water sewers and drainage facilities, both within the City and within the territory proposed to be annexed; and will provide and facilitate proper overall planning and zoning of lands, and subdivision of lands in said City and said uninhabited territory, in a manner most conducive to the welfare of said City and said uninhabited territory. 3. That the County Boundary Commission of San Diego County, California, did in session duly assembled on the 31st day of July, 1956, approve the proposed annexation boundaries of said'banielson Annexation" as above described, and as submitted to said Commission by the Council of the City of National City. 4. That the day of Noh►ember, 1956, at the hour of 2 P.M., in the Council Chambers in the City Hall in the City of National City, County of San Diego, California, is hereby fixed as the time and place when and where any person owning real property within the uninhabited territory above described and proposed to be annexed to the City of National City, and having any objections to the proposed anre xation, may appear before the Council of the City of National City and show cause why such uninhabited territory should not be so annexed to said City of National City. Such protest must be in writing, and may be filed at any time before the hour set for hearing objections to the proposed annexation, and shall state the name or names of the owner or owners of property affected, and the description and area of such property, in general terms. 5. The City Clerk of the City of National City is hereby authorized and directed to cause a copy of this resolution to be published at least twice, but not oftener than once a week, in the National City Star News, a newspaper of general circulation in said City of National City, the city to which it is proposed to annex the aforesaid territory, and also in the San Diego Union, a newspaper of general circulation published outside the City of National City, but in the County of San ➢iego, California, the county in which is located the territory proposed to be annexed to the City of National City, said publication to be complete at least twenty (20) days prior to the date set for hearing. 6. The City Clerk is further authorized and directed to cause written notice of such proposed annexation to be mailed to each person to whom land within the territory proposed to be annexed is assessed in the last equalized county assess- ment roll available on the date the above said proceedings were initiated, at the addresses shown on said assessment roll or known to the Clerk, and to any person who has filed his name and address and the designation of the lands in which he has either legal or equitable, with the clerk, such given not less than twenty (20) days before the hearing on the proposed annexation. 7. The City Clerk iS directed to cause written notice to be given to such other persons as may be legally entitled thereto, in the manner required by law.
