SCOTT and ANN MEYER SCOTT , husba,nd a.nd wife, and the CITY OF NATIONAL CITY, a. municipal corporation, a copy of which agreement is attached hereto, be, and the same is hereby approved. SECTION 2: That WALTER F. HODGE, Mayor of the City of National City be, and he is hereby, authorized and directed to execute the same for and upon behalf of the said City. PASSED AND ADOPTED this ,,71-o '-day of July, 1954 City Clerk CONTRACT FOR COMPLETION OF SUBDIVISION IMPROVEMENTS IT IS HEREBY AGREED by and between CITY OF NATIONAL CITY, a municipal corporation, and GEORGE W. SCOTT and ANN MEYER SCOTT, husband and wife, hereinafter called Second Party, as follows: WITNESSETH: WHEREAS, the Second Party is the owner of real pro- perty in the City of National City, County of San Diego, State of California, described as follows, to wit: Being a. subdivision of a portion of lot 69 of a portion of the Ex -Mission Lands of San Diego (commonly known as Horton's Purchase) in the City of National City, County of San Diego, State of California, according to Map thereof No. 283, filed in the office of the County Re- corder of San Diego County, March 9, 1878, bounded and described a.s follows: Commencing at a. point 165 feet North of the Southeast corner of Lot 67 of said Ex -Mission Lands of San Diego; thence West, parallel with the South line of said Lot 67 a distance of 569.25 feet; thence South at right angles, 382.80 feet to the Southeast corner of a parcel of land described in Deed to J. J. Hughes, dated September 12, 1883 and recorded in Book 44, pa.ge 478 of Deeds, records of said County, being also the Northeast corner of a parcel of land described in Deed to Henry John Kropp, recorded April 25, 1923, as Document No. 14399 in Book 931, page 406 of Deeds; thence along the East line of said Kropp's land, South 0° 23' 05" East 20 feet to a point in a line which is parallel with and Southerly 20 feet, measured at right tangle% from the Southerly line of said Hughes' land above referred to, said point being the true point of beginning; thence continuning along said East line, South 0° 23' 05" East 91.00; thence South 89° 55' 25" West parallel with the South line of said Hughes' land and the Westerly prolongation thereof, 594 feet to the Southea.sterly corner of a parcel of land described in Deed to the Central Baptist Church, recorded January 11, 1954 in Book 5107, page 415 of Official Records; thence North 0° 23' 05" West along the East line of said Church land, 91.00 feet to the Northeasterly corner thereof, being also a point in a line which is parallel with a.nd Southerly 20- feet at right angles from the Souterly line of said Hughes' land above referred to and its Westerly pro}rrnga.tion; thence North 89° 55' 25" East along said last mentioned parallel line 594 feet to the true point of beginning a.nd WHEREAS, the Second Party proposes to create a sub- division of said above described property, to be known as SCOTT SUBDIVISION UNIT NO. 1, and to effect the same has heretofore filed with the proper authorities of the said City of National City the necessary maps and improvement plans and other data in conformity with the laws of the State of California and the ordina.nces of the City of National City a.pplica.ble thereto; and WHEREAS, the said proper authorities of said City have found the proposed subdivision plan to be acceptable and in accord with the best interests of said City; and WHEREAS, the City of National City is entitled to re- quire from the Second Party, and does require from Second Party, as a condition precedent to the acceptance of a.ny and all streets and easements, a.ssura.nces for the completion of the public improvements in said subdivision as is provided therefor in said plans and specifica- tions as ha.ve heretofore been approved a.s aforesaid; and WHEREAS, the Second Party is desirous of supplying such assurances; NOW, THEREFORE, IT IS HEREBY AGREED by and between CITY OF NATIONAL CITY and said SECOND PARTY, as follows 1. Said Second Party agrees to undertake and complete, and to pay for all labor and materials in connection therewith, on or before the ..to day of 1956'; all the necessary work and installation of improvements in the hereinabove described sub- division in full conformity with the Ordinances of the City of National City, the laws of the State of California and the directions of proper officials of the City of National City, California, as ma.y be applicable thereto. Said improvements are more particularly described as follows; IMPROVEMENTS ESTIMATED COST Sewers Combination Curb and Gutter 692 feet @ $2.25 4.5' P.C.C. Sidewalk 670 feet @ $1.80 Paving (1 1/2" A.C. over 5 1/2" Cement Treated Base) 13,200 sq. feet @ $0.30 Complete $ 1,557.00 1, 206.00 3,960.00 Finish Grading Lump sum 200.00 Dela.yed staking 200.00 $7,123.00 and the Second<Party further agrees to indemnify, protect and hold harmless the said City of National City from any and all claims of liability for personal injury, property damage, labor or material claims which may be made against said City by reason of said work and installation of improvements as herein provided. 2. As a guarantee and as security for its full and faithful performance in complying with all the requirements for the completion of said subdivision as aforesaid, the said Second Party shall deliver to the said City of National City, upon the execution of this agreement, a good and sufficient bond executed by an a.uthorized surety company satisfactory to the said City of National City in the sum of $;$M, 000.00. 3. Upon the execution by Second Party of this Contract and the posting of the bond as herein provided, and upon the full and complete performance by Second Party of all requirements imposed upon Second Party by Ordinance No. 803 of the City of National City, the City of National City agrees to approve the Final Map of said subdivision and accept the sa.me for recordation.
