WHEREAS, the City Council has heretofore
determined that it is proper to expend the sums set forth in the
attached agreement with the National City Chamber of Commerce,
for the purposes therein stated.
NOW, THEREFORE, be it resolved by the City
Council of the City of National City, California, as follows:
That certain agreement with the National City
Chamber of Commerce, an association, dated November ,
1954, providing for the expenditure of $1000.00 for the Street
Christmas Decorations Program, a copy of which is hereto attached,
be and the same hereby is approved and accepted and Walter F. Hodge,
Mayor, is hereby authorized and directed to execute the same for
and on behalf of the said City.

CONTRACT BETWEEN CITY OF NATIONAL CITY
AND
NATIONAL CITY CHAMBER OF COMMERCE
THIS AGREEMENT, made and entered into as of the
/day of November, 1954, by and between the City of National
City, California, a Municipal corporation, in the County of San Diego,
State of California, hereinafter designated as "CITY" and National
City Chamber of Commerce, an association, hereinafter designated
as "ADVERTISER",
WITNESSETH
WHEREAS, said Advertiser is the National City Chamber
of Commerce within the City of National City, and has special experience
and faci-ities for promotion and advertising work to be done and performed
for the City of National City, and
WHEREAS, it is the desire of the City to employ said
National City Chamber of Commerce as its agent for the purpose of
advertising, exploiting and making known the resources of the City for
the purpose of inducing immigration to and increasing the trade and
commerce of, said City, all pursuant to the Government Code of the State
of California; and
WHEREAS, it has been found by said City that a Street
Christmas Decorations Program will promote the general welfare of
said City and will publicize and advertise said City and will make known the
enterprises of said City and will increase the trade and commerce of said
City, and that as a result in years past, the parties to this agreement have
contracted for the conducting of such a program, and that said City now
owns and possesses decorations for the conducting of' such a program,
and the City Council does further find and does hereby determine that
the expenditure of the sum of $1000.00 for the conducting of said program
is proper for the purposes hereinabove set forth;
NOW, THEREFORE, it is mutually agreed as follows:
1. That Advertiser shall use its facilities and its
special knowledge and experience in carrying out said program pursuant
to the terms of this agreement and that the City hereby agrees to pay
Advertiser the sum of One Thousand Dollars ($1000.00) subject to the
terms, conditions and restrictions imposed by this agreement;
2. That the total obligation hereby incurred. by City
shall not exceed the total sum of One Thousand Dollars ($1000.00);
3. That the sum shall be used for no purpose other
than (1) to transport said decorations owned by City from their place of
storage to the locations selected for display on the city streets of National
City, (2) to erect and set up said decorations, and (3) after the Christmas
season to dismantle said decorations and return the same to their place
of storage;
4. That the term of this agreement shall expire on
February 1, 1955;
5. That it is hereby mutually agreed that no part of any
money paid by the City to Advertiser shall ever be used to pay any part
of the salaries of its officers;
6. That on or before February 1, 1955, Advertiser
shall submit to the City a report giving details of the steps taken by
Advertiser to carry out the purposes hereinabove set forth in this agree-
ment, an evaluation of the results of said program and further setting
forth bills itemized in detail showing the expenditures made and work
done with the sums provided by City to Advertiser pursuant to this
agreement;

7. It is distinctly understood and agreed that
Advertiser shall not be entitled to receive any compensation for its
own services as such in conducting said program, and that the entire
sum paid Advertiser by City pursuant to this agreement shall actually
be paid out by Advertiser for the sole purpose of conducting the Street
Christmas Decorations Program as hereinabove defined;
8. In any event, Advertiser covenants and agrees to
deliver, reasonable wear and tear excepted, back to the possession of
City the decorations hereby made available to Advertiser in as good
condition, reasonable wear and tear excepted, as the same are in at
the time of the execution of this agreement;
9. It is agreed that the sum of One Thousand Dollars
($1000. 00) shall be paid by City to Advertiser pursuant to this agreement

IN WITNESS WHEREOF, said City has caused this
agreement to be executed by its Mayor and attested by its City Clerk
and Advertiser has caused this agreement to be executed by its President
and its Secretary thereto duly authorized, and to have its corporation
seal affixed, the day and year in this instrument first written.
