HomeMy WebLinkAboutCC RESO 6096RESOLUTION NO. 6096 /..67,-JrY rtz..40Jvva"v RESOLUTION OF THE CITY OF NATIONAL CITY, CALIFORNIA, CALLING AND PROVIN ING FOR AND GIVING NOTICE OF A SPECIAL FT PCTION TO BE HELD IN SOUTH WEST mRsA, IN THE COUNTY OF SAN DIEGO, STATE OF CALIFORNIA, ON TUESDAY, THE 9th DAY OF February 1954, FOR THE PURPOSE OF SUB. • MITTING TO THE ELECTORS RESIDING THEREIN THE QUESTION WHETHER THE TERRI- TORY IN SAID SOUTHWEST MESA SHALL BE ANNEXED TO, INCORPORATED IN AND MADE A PART OF THE CITY OF NATIONAL CITY, AND THAT THE PROPERTY THEREIN SHALL, • AFTER SUCH ANNEXATION, BE SUBJECT TO TAXATION EQUALLY WITH THE PROPERTY WITHIN THE CITY OF NATIONAL CITY TO PAY THE BONDED INDEBTEDNESS OF SAID CITY OUTSTANDING AT THE DATE OF SUCH ANNEXATION. WHEREAS, on the 5th day of Decembers 1953 , the Council of the City of National City, California, adopted a resolution of intention to call a special election in that certain territory of the County of San Diego, State of California, known and designated S;SoulliVest Mesa, for the purpose of submit- ting to the electors residing therein the question whether the terriroty in said South West Mesa, hereinafter described, shall be annexed to, incorporated in and made a part of The City of National City, and that the property therein shall, after such annexation, be subject to taxation equally with the property within The City of National City to pay the bonded indebtedness of said City outstand- ing at the date of such annexation; and WHEREAS, by said resolution the 5th day of January, 1954, at eight o'clock, P.M., in the Council Chambers, City Hall, National City, California, 14111 set as the day, hour and place for hearing protestsagainst the proposed annexation; and WHEREAS, at the time set for hearing protests the City Council finds that no protest was made by any owner of property within the territory proposed to be annexed against the said election; NOW, THEREFORE, BE IT RESOLVED By the City Council of the City of National City, California, as follows: Section 1: That pursuant to the termsand provisions of the Annexation Act of 1913, as amended, a SPECIAL ELECTION be held, and the same is hereby called and ordered tobe held, in the territory in the County of San Diego, hereinafter described, designated as "South West Mesa", on Tuesday, the 9th day of. February , 1954, for the purpose of submitting to the qualified elec- tors residing in the territory the following proposition, to -wit: That it is proposed to annex to, incorporatein., and make a part of The City of National City, the territory herein designated as South West Mesa, the exterior boundaries of which are specifically described as follows: All that portion of the County of San Diego, State of California, embraced within the following described boundaries, to -wit: "All that portion of RAI,ie Vista, Map No. 1815, Records of San Diego County. State of California, more particularly described as follows: Beginning at the intersection of the Southerly Boundary line of Nation- al City, with the West right of way line of National Avenue as shown on Map thereof No. 1815 of Bahia Vista, on file in the office of the Recorder of San Diego County; thence along said West right of way line Sy�18° 35' E 230 ft., thence South 71° 25' West 290 feet, thence S 6° 301 West 260.0 ft., thence S 85° 01' West 357.67 feet, thence S 73° 14' West 229.0 ft., thence N 67° 08' West 306.88 ft., thence S 58° 09' Nest 156.31 ft., thence S 88°.181 West 120.23 ft., thence S 53° 35'.West 110.16 ft., thence N 87° 30' Vest 117.10 ft., thence N 89° 18' West 92.86 ft., thence N 18° 35' hest 132.88 ft., to the Southerly Boundary line of National City, thence along said Southerly. Boundary North 71° 25' Bast 1776.01 ft., more or less, to the point of beginning." And that the property therein shall, after such annexation, be subject to taxation, equally with the property within the City of National City, to pay the bonded indebtedness of said City outstanding at the date of the said annexa- tion. The improvement or improvements for which such indebtedness was so incurred or authorized, and the amount or amounts of such indebtedness already incurred, outstanding at the date of the first publication of this resolution and notice of election, are, in general terms, as follows: For street improvements: 8 20,000.00 For extension of City's sewer system 0.89,00mo That the total amount of said bonded indebtedness outstanding at the date of the first publication of this resolution and notice of election is $_,__„_-, $209,000.00 That the maximum rate of interest payable on said indebtedness is,' Section 2: For the purposes of this election the territory hereinbefore described shall be referred to and designated as "South West Mesa". vex Section 3: • Said election shall be held in the territory hereinbefore des- cribed and referred to as South Nest Mesa, on the 9th day of FebruarY 1954, and the said election shall be conducted as provided in this resolution, the Annexation Act of 1913, and amendnents-tbereoft and also in accordance with the laws of the State of California. Section It: That the polls for saidelection shall be opened at 7:00 o'clock A.M. of the day of said election and shall remain open continnously from that time until 7:00 o'clock P.M. of the same,day.whea said polls shall be closed; except as provided in Section 5734 of the Elections Code of,the State of Calif- ornia. Section 5: That on the ballots to be used at said election, in addition to any other natters required by law, there shall be printed substantially the fol. lowing: MARK CROSS (+) ON BAIIOT ONLY WITH RUBBER STAMP; NEVER WITH PEN OR PENCIL ABSENTEE BALLOTS, MAY RR MARKED WITH PEN AND INK OR PENCIL INSTRUCTIONS TO VOTERS To vote on any measure, stamp a cross (+), in the noting square after the word "YES" or after the word "NO". Al]. marks, except the cross (+) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the inspector of election and obtain another. On absent voter's ballots mark a cross (+) with pen or pencil. 'Shall South West Mesa be annexed to The City -of 'National City, and the property therein be, after 'such annexation, subject to taxation equally with 'property within said City, to pay the bonded in. NO A cross (+) placed in the voting square after the word "YES" in the manner hereinbefore provided shall be conntdd in favor of the annexation of the territory referred to herein to The City of National City. Section 7: The City Clerk of said City is hereby directed to procure and have printed the requisite number of ballots and other printed matter, and to procure whatever supplies maybe necessary for use in said Special Election as may be required by law.
