HomeMy WebLinkAboutCC RESO 5909SOLUTION NO. 5909 WHEREAS, pursuant to Ordinance No. 845 of CITY OF NATIONAL CITY, California, a hearing was duly and regularly held by the City Council of said City at 8:00 o'clock P.M. on April 7, 1953, and regularly continued to April 21, 1953, at 8:00 o'clock P.I., in the City Council Chambers in the City Hall, National City, California; and REAS, after hearing and considering the evidence produced at said hearing, and no one appearing to object, the City Council does hereby find that that portion of the ntreet set forth in said Ordinance No. 845, and hereafter described, is not now necessary for present public street purposes; and WHEREAS, the City Council does hereby further find that it s in the best interests of CITY OF NATIONAL CITY to now close that portion of said street as aforesaid; NOW, THEREFORE, BE Tr RESOLVED by the City Council of CITY O: NATIONAL CITY as follows: SECTION 1: That that portion of street, all as shown on Map thereof No. 348 of National City on file in the office of the Recorder of San Diego County, California, arid more particularly described as: That portion of 14+TH STREET lying between Elocics 178 and 179 of National City, Cali- fornia, and being further bounded and described as being that portion of 111TH STREET lying be- tween the West line of Wilson Avenue and the East line of Taft Avenue, National City, California,- all in the C1t of national City, California, be, and the sari: is hereby, vacated, subject to reservation of easements and he rights of iay for structures enumerated in Section 8330 of the Streets and Highways Code of the State of California. - SECTION 2: That in the event DUC©MMUN METAL & SUPPLY COMPANY, a corporation, or its assigns or successors, fail to operate a substantial commercial enterprise upon not less than one-third (one-third) of the following property, to -wit: Blocks 177, 178, 179, National City, and the portion of street hereby closed, within e i;:teen (18) months from the date of this resolution, then, and in that event, the deed which is executed simultaneously herewith by the said DUCOMMUN METAL & SUPPLY COMPANY to CITY OF NATIONAL CITY, and which deed is in escrow with the City, shall be immediately recorded. In the event the aforesaid condition is fulfilled, the said deed shall be of no force or effect and the said vacation and closing shall be absolute. ' SECTION 3: That the City Clerk of City of National City is hereby authorized and directed to record in the office of Recorder of San Diego County, a certified copy of this resolution, duly attested under the, seal of City of National City.
