HomeMy WebLinkAboutCC RESO 5858RESOLUTION NO. 5858 RESOLUTION DETERMINING INITIAL VIEW OF TFGISLATIVE BODY THAT THE PROVISIONS OF DIVISION 4 OF THE STREETS AND HIGHWAYS CODE WILL NOT BE VIOLATED. WHEREAS, the City Council of CITY OF NATIONAL CITY, California, has heretofore adopted its Resolution No. 5857 entitled "Preliminary Determination of Legislative Body Under "Special Assessment Investigation, Limitation -and Majority Protest Actiof 1931", in accordance with Sections 2820, 2821, 2822 and 2823 of said Act; NOW, THEREFORE, IT IS HEREBY RESOLVED and determined by the City Council of CITY OF NATIONAL CITY, California, as follows: That after taking the steps provided by Said Sections 2820, 2821, 2822 and 2823 of said Act hereinabove referred to, that it is the initial view of this legislative body that the contemplated improvement described in said Resolution No. 5857 above_referred to is one in which the probable assessments will not exceed the limitations set up in Division 4 of the Streets and Highways Code and othergise known as the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931; and That the City Clerk of City of National City is hereby directed and ordered to give notice of the contemplated action of this City Council by mailing prepaid post cards giving notice of the finding and proposed action of the said City Council. Said card shall assessment assessment his or her address as shown upon such roll, and to any person, whether owner in fee or having a lien upon, or legal or be mailed to each person to whom land in the proposed district is assessed on the last equalized county roll available on the date the notices commence, and equitable interest in, any land within the proposed district who has filed with the Clerk his or her name and address and a designation of the land in which he or she is interested. Said notice shall be in the form provided by Part 7 of Division 4 of the Streets and Highways Code of the State of California, otherwise known as the "Special Assessment Investi- gation, Limitation and Majority Protest Act of 1931".
