RESOLUTION NO. SAS % 7
WHEREAS, the CITY OF NATIONAL CITY is the grantee
of certain property as set forth in the attached Exhibit;
and
WHEREAS, at the date of said grant, said property
was subject to a deed of trust, whereby said deed of trust
provided that said property could not be transferred without
consent of the trustee, and that a failure to so obtain would
be a violation of the terms of trust; and
WHEREAS, said trustee is the BANK OF AMERICA NATIONAL
TRUST AND SAVINGS ASSOCIATION; and
WHEREAS, demand upon City to return said property
has been heretofore made; and
WHEREAS, said proceedings have been hereto referred
to the PLANNING COMMISSION of CITY OF NATIONAL CITY; and
'WHEREAS, the property described does refer to
streets which have been heretofore officially vaeated; and
WHEREAS, the said trustee has heretofore agreed to
remove all restrictions on the Southerly thirty (30) feet of
said property upon condition that City return to the present
owner, LAURENCE R. ROBINSON, of said property, the Westerly
thirty (30) feet of said property; and
WHEREAS, said trustee will foreclose the rights of
City in all of said property if the agreement is not accepted;
NOW, THEREFORE, BE IT RESOLVED by the City Council
of CITY OF NATIONAL CITY, California, that the City Council
hereby finds that it is the best interest of CirY OF NATIONAL
CITY to quitclaim to LAURENCE R. ROBINSON the following
described property, to -wit:
That portion of the Northwest Quarter of
40 Acre Lot 1, in Quarter Section 132 of
Rancho de la Nacion, Map No. 166, as filed
in the Office of the Recorder of San Diego
County, and commonly known as "M" Avenue,
bounded and described as follows:
All that portion of the Easterly half
of Nu Avenue bounded on the north by the
South Line of 8th Street and on the South
by the North Line of 9th Street,
upon condition that the trustee obtain all necessary releases
to permit the City of National City to have clear title to the
Southerly thirty (30) feet of the hereinabove described pro-
perty, as set forth on the Exhibit attached hereto.
The Mayor is hereby authorized and directed to
execute and deliver said deed and the City Clerk is hereby
authorized and directed to attest said deed.
