444EREAS, the State of California desires to con-
struct a public highway on property herein described, and on
other property adjacent thereto; and
WHEREAS, the City of National City has an interest
in the herein described property; and
WHEREAS, to effect the desire -of the State of Cali-
fornia to construct said public highway, the said State has
requested that City of National City execute and deliver a
quitclaim deed to said State for said property; and
WHEREAS, the City Council of said City does hereby
find that it is in the public interest and forthe common
benefit to grant said deed upon the payment to said City of
the sum of $ gZ 4E?
which is hereby determined
as just and reasonable therefor; now, therefore:
BE IT RESOLVED by the City Council of City of National
City, California, as follows:
That the Mayor and City Clerk of said City, and each
of them, are hereby authorized and directed to execute a quit
claim deed to the State of California for the following -described
property, to -wit:
The East 75 feet of Lot 22 in Block 209
of National City, acdording to Map thereof
No. 348, filed in the office of the County
Recorder of San Diego County, 0etober 2, 1882.
Containing>1,875 square feet,
and to deliver said deed to the State of California upon payment
to the said City of the sum of $ f Z ��

In consideration of which, and the other considerations hereinafter set forth, it is mutually agreed as follows:
1. The parties have herein set forth the whole of their agreement. The performance of this agreement constitutes
the entire consideration for said document and shall relieve the State of all further obligation or claims on this account, or on
account of the location, grade or construction of the proposed public improvement.
2. The State shall:

State.
This transaction will be handled through an escrow with the
Union Title Insurance & Trust Company of San Diego, California.
13. Pay all escrow and recording fees incurred in this trans-
action and, it title insurance is desired by the State, the premium
char: -d therefor, and documentary stamp tax, it required.
3. The undersigned grantor hereby agrees and consents to the
dismissal of Parcel No,, 2, People vs, Sees Diego & Arisen* liiastern
Railway Co., Superior Court Case No..152601, ;fan Diego County, and
also waives any and all claims to any money that may have been de-
posited in the superior court in said action..

POLICY OF STATE DIVISION OF HIGHWAYS REGARDING COUNTY
AND/OR CITY TAX LIENS ON PROPERTIES ACQUIRED FOR STATE
HIGHWAY PURPOSES
The State cannot legally pay property taxes to a County or
a City.
The payment clause in the Right of Way Contract -State High-
way,usually shown as Clause 2A, merely means that the State will
pay the agreed amount for the property when the title is vested
in the State free and clear of all liens and encumbrances except
those listed, and will not require payment of the County and/or
City taxes, which are listed before payment is made for the pro-
perty acquired.
The State periodically requests the cancellation of taxes
on all property it has acquired; however, it frequently happens
that several months elapse between the time the deed is recorded
and the actual cancellation takes place. This lapse of time may
result in taxes becoming delinquent. Payment for land deeded to
the State is made immediately after recordation of the deed.
In order to pay the tax on the remaining portion of your
property, excluding the parcel acquired by the State Highway,
you may apply to the County Tax Collector for segregation of the
current tax under varying conditions. Information and advice for
proper procedure may be obtained from the County Tax Collector,
110 Civic Center, San Diego. The following factors have a bear-
ing on the making of a segregation:
1. The date of the application must not conflict with the
statutory dates and provisions of the State Law.
2. The deed to the State must be recorded.
3. Allpersonal property taxes assessed against the pro-
perty must be paid.
4. That neither installment of the real estate tax has
been paid.
5. That the last installment of real estate tax has not
become delinquent.
6. The property owner must pay the fee for segregation.

office, together with the legal description of the property
involved in the transaction.
