SECTION III It is hereby agreed that no change shall be made in said street lighting system as specified in Section I hereof, except such changes as are covered by satisfactory written modification hereto and mutually agreed upon. Additional non -ornamental street lights may be included hereunder by such modification at the applicable rate specified and the Company agrees to make such installation provided the distance from an existing street lighting circuit of similar character, to the new light, is not greater than 100 feet per 1000 lumens of lamp rating. No change will be made in the location of non -ornamental lights unless the expense thereof is paid by the Customer. SECTION IV The Company agrees to use reasonable diligence and care in providing a regular and uninter- rupted service but does not guarantee continuityor sufficiency of supply, and if said street lights or any part of them fail to burn properly, or if for any reason the Company is unable to supply energy for said service. the Cus- tomer agrees that the only liability of the Company shall be to rebate the proportionate charge for the time of such lamp (or lamps) failure to burn, excluding, however, the time to and including the initial 24-hour period following notification to the Company of the particular outage. This provision, however, shall not deprive the Customer of its power of rescission for substantial breach of contract by the Company. Form 132-12559 SECTION VIA copy of each rate schedule referred to herein is attached toand hereby made a, part hereof, and the Customer agrees to abide by the applicable conditions of such schedules and to abide by and comply with the Rules and Regulations relating to such service as filed with the Public' Utilities Commission of the State of Califor- nia, a copy of which is open to public inspection at the Company's office. It is mutually understood that the Company shall not be liable to the Customer or to any other person for any failure of the Company to furnish and deliver a continuous 'or sufficient supply of electric energy or to perform the terms of this contract caused by inevitable accident, fire, strikes, riots, war, or Federal or municipal interference or any other cause except that arising from its. failure 'to exercise reasonable diligence. This Contract shall at all times be subject to such changes or modifications by the Public Utilities Commission of the State of California as said Commission may, from time to time, direct in the exercise of its jurisdiction. SHEET NO. 917-E SCHEDULE L-11 STREET AND HIGHWAY LIGHTING —MERCURY VAPOR LAMPS APPLICABILITY This schedule is applicable to street or highway lighting installations using mercury vapor lamp units mounted on mast arms on wood poles in standard position, and supplied from overhead lines, where the Company owns and maintains the entire installation. For installations requiring cial facilities, see Special Conditions (e) and (f). spe- SPECIAL CONDITIONS (a) Service will not be furnished under this schedule where, in the opinion of the Com- pany, an undue hazard or expense will result because of location, mounting height in excess of 30 feet, or other reasons. (b) All night burning will normally be from dusk to daylight, which, in accordance with the Company's switching schedule, results in approximately 4,033 burning hours per year. The Company reserves the right, in the case of isolated all night installations not controlled by an established series circuit, to install a standard or astronomical time switch, or switch controlled by a photo -electric cell, either of which, under normal conditions, will result in approximately 4,033 burning hours per year during the hours of darkness. (c) The size of an installation is determined by the total number of lamps connected to an individual circuit or circuits having a single control for switching all such lamps. (d) A contract for a period of not less than three years will be required, or acceptable arrangement for payment of liquidated damages in case of a contract of shorter duration. (e) Where the customer desires a light at a location which will require a mast arm installation on a pole in a position which is not standard or would not otherwise be neces- sary as a part of the distribution system, an additional charge of $1.00 per lamp per month will be made. (f) Where the customer desires a center suspension light, instead of the mast. arm in- stallation, an additional charge of $2.00 per lamp per month will be made. (g) The installation of street lights hereunder, particularly special installations as cov- ered by (e) and (f) above, is contingent upon the Company's obtaining satisfactory rights of way and highway permits necessary for the required poles, anchors, cable and overhead circuits. GENERAL RULES AND REGULATIONS, AND SPECIAL CONDITIONS This schedule is subject to the General Rules and Regulations on file with the Public Utilities Commission of the State of California and to the Special Conditions shown on this schedule.
