WHEREAS, the ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY,
a corporation, has presented its petition to construct, maintain,
and operate an extension to an assisting track in Harrison Avenue
in National City, California.
NOW THEREFORE, BE IT RESOLVED by the City Council of the
City of National City that permission is hereby granted to the
ATCHISON, TOPEKA AND SANTA FE RAILWAY COMPANY, a corporation, to
construct, maintain and operate an extension to an exiatif1g:
track in Harrison Avenue; center line of said extension being
more particularly described as follows, to —wit:
Beginning at a point in the center line of and at the
end of The Atchison, Tppeka and Santa Fe Railway Company's
spur track No. 8 in Harrison Avenue, said point being
202.3 feet southerly from the southerly line of 21st
Street an 17.5 feet �gresterly at rht annortherlylefrm the
easterly ine of Harrison Avenue; tnence
242.3 feet parallel to the easterly line of Harrison
Avenue and 17.5 feet westerly thereof; thence northerly
40.0 feet on a tangent curve concave westerly, having
a radius of 603.8 feet; thence northerly 35.0 feet on
tangent; thenc no thariy 40.0.feet on a tangent curve
concave easterly, having a radius of 603.8 fret to a
point distant 22.5 feet westerly at right angles from
the easterly line of Harrison Avenue; thence northerly
505.4 feet on tangent, parallel to the easterly line
o.f Harrison Avenue to the southerly line of 19th Street.
A copy of the aforesaid petition, together with the attached
map of the proposed track is attached hereto and by this reference
made a part of this resolution.
BE IT FURTHER RESOLVED that said track shall be constructed
in such a manner as will present the least obstruction to the
free use by the public of said streets.
AND PROVIDED FURTHER, that said track shall be constructed
so as to conform to the grade of all streets upon which the
official grade has been established and in all other cases shall
be constructed so as to conform as near as possible to the
natural grade of said streets; and if at any time in the future
the grade on said streets shall be established or changed, then
the roadbed and track constructed upon said streets shall be
made to conform therftto by the said Atchison, Topeka and Santa
Fe Railway Company, or its successors or assigns. without ex—
pense to said City.
That the said Atchison, Topeka and Santa Fe Railway Com—
pany, its successors and assigns shall keep the space between
the rails and for two feet on each side thereof, along or across
said streets constantly in good repair and flush with the grade
of said streets so as to afford an easy and convenient crossing
for all vehicles crossing or traveling upon said streets, and
shall also pave the space between the rails of said track and
for two feet on each side thereof with the same kind and quality
of pavement that said streets upon which said track is located
shall be paved if such streets upon which such track shall be
located shall hereafter be paved.
The said Atchison, Topeka and Santa Fe Railway Company and
its successors and assigns shall also construct and maintain at
its own.expense, all necessary drains or culverts made necessary
by the construction of said Railway Track upon said streets.
That the City Engineer shall set the necessary grade stakes
for the construction of said track on said streets and the said
Atchison, Topeka and Santa Fe Railway Company shall construct
the same in conformity therewith.
BE IT FURTHER RESOLVED that this permit herein granted
may at any time be revoked at the pleasure of the City Council
of said City.
PASSED AND ADOPTED by the City Council of the City of National City, California, this 6th
day of March 1951
