BE IT RESOLVED by the City Council of the City
of National City, California, that:
SECTION 1: The Mayor is hereby authorized and
directed to sign forthwith that certain contract, a
copy of which is annexed hereto, between the City of
National City and Walter H. Barber and H. R. Breeden,
hereinafter referred to as the Contractors.
SECTION 2: Upon the Mayor informing the City
Clerk that he has signed said contract, the City Clerk
shall within five (5) days thereafter request said Con-
tractors to sign said contract and to furnish the City
with the bonds required by the terms of the invitation
for bids;
Said request shall be sent by Registered Mail to
said Contractors at the address given by said Contractors
in their bid;
Said Contractors shall have fifteen (15) days after
the date said request is mailed within which to sign said
contract and furnish said bonds to the City, and said re-
quest shall so inform him.
SECTION 3; In the event the Mayor does not sign
said contract within 180 days from the date of the adopt-
ion of this resolution, said Contractors and the surety on

their bid bond shall thereby be released and discharged
of and from any and all claims of the City arising out
of or by virtue of said bid and bid bond, and said bid
and bid bond shall thereupon be cancelled and extinguished.
SECTION 4: The City Clerk is hereby authorized
and directed:
(a) To transfer forthwith to the General Fund
from the Capital Outlay Fund, created by
Ordinance No. 725, enacted October 31, 1946,
a sum equal to the amount of the contract
hereinabove mentioned, and to credit the same
in the General Fund to a subdivision thereof
to be known as "Sanitary Sewer Fund —Dorfman --
Carroll and Foster --Barber and Breeden Con-
tracts";
(b) To countersign such warrants as may be drawn
by the Mayor upon the City Treasurer for de-
mands audited and allowed by the City Council
against said "Sanitary Sewer Fund--Dorfman--
Carroll and Foster --Barber and Breeden Cony►
tracts" for payments under said contract.
