HomeMy WebLinkAboutCC RESO 4713RESOLUTION OF INTENTI0N No. .,417 NATIONAL CITY LIGHTING DISTRICT NO. 3 RESOLVED THAT it is the intention of the City Council of the City ot National City, California, to order the following work to be done and improvement to be made in said C i ty , torit The furnishing of electric current for the lighting of the following streets in the City of National City, California, to"wit: NATIONAL AVM , in said City, between the southerly curb line of Fifth Street and the northerly curb line of Tenth Street; EIGHTH STREET, in said City, between a line parallel to and 10 feet westerly from the westerly line of National Avenue and the westerly curb line of A Avenue; Together with the maintenance of the posts, wires, conduits and lamps on the aforesaid streets, between the points here .nbefore mentioned.. Such furnishing of electric current and such maintenance of appliances shall be for the period of one year from and after to -wit: to and including Jc' /_ 3/ J 7 Said work of improvements shall be done in all respects accord.. ing to, and at the places shown by, and of the materials provided for, in the plans and specification therefor to be hereafter furn- ished by the City Engineer of said City and filed with this City Council, as hereinafter set forth, That the exterior boundaries of the district in said Oity of National City to be benefited by said improvement, and to be assessed to pay the costs and expenses thereof, and to be known as the asses- sment district, aro hereby specified as follows, to -wit: Beginning at a point on the center line of Fifth Street which is 100 feet westerly frog the westerly line of National. Avenue; thence easterly along the center line of Fifth Street to a point 125 feet easterly from the easterly line of National Avenue; thence southerly on a line parallel to and distant 125 feet easterly from the easterly line of National Avenue to a point 150 feet southerly from the southerly line of Seventh Street; thence easterly to the -1- northwesterly corner of Lot 7, Block 1, T. Parson's Addition, Map No. 57; thence Easterly along the northerly line of said Lot 7, and along Said line produced easterly to the intersection of said line with the center line of A Avenue; thence southerly along the center line of A Avenue to a point 25 feet southerly from the southerly line of Eighth Street; thence westerly to the southeasterly corner of Lot 20, Block 1, W.C. Kimball's Sub., in 10 Acre Lot 1, Quarter Section 15+, Map No. 105; thence westerly along the southerly line of said lot and along said line produced westerly to a point 125 feet easterly from the easterly line of National Avenue; thence southerly on a line parallel to and distant 125 feet easterly from the easterly line of National Avenue to the intersection of said line with the center line of Tenth Street; thence westerly along the center line of Tenth Street to a point 100 feet westerly from the westerly line of National Avenue; thence northerly to the southwesterly corner of Lot 13, Block 10, Map of National, City No. 34+8; thence Northerly along the westerly line of Lots 13 to 22, inclusive of said Block 10 to the northwesterly corner of said Lot 22, thence northerly to the southwesterly corner of said Lot 13, Block 9, of said Map of National City; thence northerly along the westerly line of said Lots 13 to 22 inclusive of said Block 9 to the northwesterly corner of said Lot 22; thence northerly to the southwesterly corner of Lot 13, Block 8, of said Mapof National City; thence Northerly along the westerly line of Lots 13 to 22 inclusive of said Block 8 to the northwesterly corner of said Lot 22; thence northerly to the southwesterly corner of Lot 13, Block 7, of said Map of National City; thence northerly along the westerly line of Lots 13 to 22 inclusive of said Block 7, to the northwesterly corner of Lot 22; thence northerly to the southwesterly corner of Lot 13, Block 6 of said Map of National City; thence northerly along the westerly line of Lots 13 to 22 inclusive of said Block 6 and along said line produced to the intersection of said line with the center line of Fifth Street, the point of beginning, excepting there- from all public streets, roads, alleys, avenues and highways. Map Numbers referred to herein are record numbers of maps on file in the office of the County Recorder of said San Diego County, California. 1t is hereby declared and determined that any 1ots,s pieces, or parcels of land belonging to the United States or to the State of California, or any lot, piece or parcel of land belonging to the County of San Diego or to the City of National City, School Board, or educational institution, and being in use in the performance of any public function, and which is included within the said assess- ment districts shall be omitted of said improvement, and that the costs and expenses of said improvement shall be assessed on the remaining lots and Lands within said assessment district without regard to the 'omitted lots, parcels or pieces of land. Said City Council does hereby order that 50% of the costs and expenses of said improvements of furnishing electric current and maintenance of appliances shall be paid out of the Treasury of said City, from the General Fund of said City, and that 50% of the costs and expenses of furnishing said electric current and maintenance of appliances shall be assessed upon the said district hereinbefore described. That the proposed improvement is hereby referred to the City Engineer of said City who is hereby directed to cause to be made and filed with the Clerk of said City Council, a report, in writing pre- senting the followings 1. Plans and specifications for the work required in order to make said improvements, 2. An estimate of the cost of said improvement and of the incidental expenses in connection therewith 3. A diagram showing the district above referred tot and also the boundaries and dimensions of the respective subdivisions of the land within said district, each of which subdivision shall be given a separate number in red ink upon said diagram, 4. A proposed assessment of the total amount of the costs and expenses of the proposed improvement upon the several subdivisions of land in said district in proportion to the estimated benefits to be received by such sub division, respectively, frov said improvement; 40, Provided, that whenever any portion or percentage of the costs and expenses of such improvement is ordered to be paid out of the Treasury of the municipality, as hereinabove provided, the amount of such pro- tion or percentage shall first be deducted from the total estimated cost and expenses of such improvement, and the assessment upon pro- perty proposed in said report, shall include only the remainder of said estimated costs and oxpenses. Said assessment shall refer to such subdivision upon said diagram by the respective red ink numbers thereof, and shall show the names of the owners, if known, otherwise designating them as unknown. No mistakes in the names of the owner of any parcel of land shall effect the validity of the assessment thereon„ This proceeding shall be designat-ed as National City Lighting District No. 1. That said improvement is to be made pursuant to and under the provisions of an Act of the Legislature of the State of California, entitled, "An act to provide for the acquisition, installation, con* struction, reconstruction, extension, repair and maintenance of works and improvements mentioned in the Improvement Act of 1911 and of public utilities and other public works by municipalities, cities and counties, and by any district or public corporation authorized by law to construct such public improvements, or 'by combination thereof; for the assessment of the cost and expenses thereof upon the property benefited; and for the issuance of bonds to represent such assessment; providing that such proceedings shall be subject to the Special Assessment Investigation, Limitation and Majority Protest Act of 1931.
