HomeMy WebLinkAboutCC RESO 4607a RESOLUTION NO. 4607 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF. NATIONAL CITY EMPLOYING SPECIAL COUNSEL IN CONNECTION WITH WATER PROBLEMS. The City Council of the City of National City, California does hereby resolve as follows: Section 1. That Stephen B. Robinson and Louis H. Burke be hereby employed as Special Counsel for the City of National City, the terms of such employment to be as follows: The services to be rendered shall be legal services in connection with the City's water supply, it being under- stood that the employment is in conjunction with like employment on the same terms and for the like purpose by the City of Chula Vista and the City of Coronado, or either of them; The compensation is to be 3200.00 per month from each of said cities, payable monthly; Such compensation shall be payable only for months during which services are actually rendered; It is understood that such retainer shall cover such matters as consultation, advice, drafting of legislation, appearances before legislative committees and the like, but that in the event that said attorneys should be re- quested to represent the cities or any of them in rate or condemnation proceedings, or in any other court or like proceedings, or in major negotiations, or the preparation of joint powers agreements, or the creation or organization of any board, district or the like, or in connection with the issuance or approval of bonds, the compensation to be paid shall be a matter of agree- ment at the time; That if it should develop that the amount of legal services required should be substantially greater or less than is now in the contemplation of the parties, either side may ask for a revision of the terms of the employment;. that the employment hereby created may be terminated by any City, as to such City, or by the said attorneys, upon 30-days' notice. -1- That in addition to such retainer, the City shall reimburse sAn attorneys for expenses necessarily incurred by them, for transportation (including railroad or other fares, or mileage at 510 per mile for the use of private automobiles), hotel bills for rooms, telephone and tele- graph costs, and other necessary incidental costs, not including the ordinary cost of their own meals, such costs where incurred jointly for more than one City to be equitably pro -rated. Sec. 2. The City Clerk shall certify to the passage of this resolution and thenceforth and thereafter the same shall be in full force and effect.
