BE IT RESOLVED by the City Council of the City of
National City, California, that the public interest
and convenience require the work hereinafter described
to be done, and
WHEREAS, the said City Council did on the 18th day
of November, 1947, pass its Resolution of Intention No.
4574 to order said work to be done and' improvement to
be made in said City, which Resolution of Intention was
duly published as required by law, as appears from the
affidavit of Helen J. Vurgason, now on file in the of-
fice of the Clerk of said City; and
'WHEREAS, notices of the passage of said Resolution
of Intention No. 4574 headed "Notice of Improvement"
were duly and legally posted along the line of said con-
templated work and improvement and in front of all the
.property liable to be assessed therefor, and on and
along each and every open street and highway in the assess-
ment district described in said Resolution of Intention,
in time, form, manner and number as required by law, after
the passage of said Resolution of Intention, as appears
from the affidavit of Sam R. Mosley, who personally posted
the same, and who, upon the completion of the posting of
said notices, forthwith filed said affidavit in the office
of the City Clerk making oath that he completed posting
of said notices on the 17th day of January, 1948, and
WHEREAS, all protests or objections having been
presented in the time, form and manner as required by
law, were overruled by said City Council by Resolution
No. 4617, on the 2nd day of March, 1948, and said City
Council now having acquired jurisdiction to order the
proposed improvement; therefore, the said City Council
hereby orders the following work to be done and improve-
ment to be made in said City, to -wit; The construction
of Portland cement concrete sidewalks and curbs along
both sides of National Avenue, in the City of National
City California, from the south curb line of 18th
Street to the North line of 30th Street, together with
_.necessary grading, all according to plan, profile and
specifications on file in the office of the City Engin-
eer, excepting work already done, all in the City of
National City, California, and all as more fully de-
scribed in said Resolution of Intention.
The costs and expenses of said work and improvements
"are to be assessed upon the district which is more particu-
larly described in said Resolution of Intention.
The said Council determined that serial bonds extend-
ing over a period ending nine years from the second day
of January next succeeding the fifteenth day of the next
October following their date, bearing interest at the rate
of six per cent -(6%) per annum, interest payable semi-
annually, shall be issued to represent assessments of
twenty-five dollars or more for the expenses of said work
and improvement, as provided by the Improvement Act of
1911 and amendments thereto.
For further particulars, reference is hereby made to
said Resolution of Intention.
The City Clerk of said City is hereby directed to
post conspicuously for ten (10) days, on or near the
Council Chamber door of said Council, in the manner and
form required by law, a notice inviting sealed proposals
or bids for doing the aforesaid work in accordance with
the plans and specifications on file, and the prevailing
wage scale adopted by Resolution No. , all of
which is more particularly set forth in the Resolution of
Intention, and said Clerk is hereby directed to publish
twice in the National City News, a weekly newspaper pub-
lished and circulated in said City, and hereby designated
for that purpose by said Council, a notice inviting such
proposals for doing the said work, and referring to the
specifications and prevailing wage schedule posted or on
file.
All proposals or bids offered shall be accompanied
by a certified check payable to the City, for an amount
which shall not be less than 10 per cent of the aggregate
of the proposal, or by a bond for that amount and so pay-
able, signed by the bidder and two sureties, who shall
justify, before any officer competent to administer an
oath, in double that amount, and over and above all statu-
tory exemptions.
The proposals or bids, shall be delivered to the Clerk
and the legislative body shall, in open session publicly
open, examine and declare the same. No proposal or bid
shall be considered unless accompanied by the check or
bond satisfactory to the legislative body.
The legislative body may reject any and all proposals

or bids should it deem this for the public good, and
also the bid of any party who has been delinquent or
unfaithful in any former contract with the city, and
shall reject all proposals or bids other than the low—
est regular proposal or bid of any responsible bidder,
and may award the contract for said work or improvement
to the lowest responsible bidder at the prices named in
his bid. If the bids are rejected, the legislative body
shall thereupon return to each bidder the check or bond
which accompanied his bid.
The time and place of receiving and opening said
bids shall be not less than 10 days from the time of
first publication or posting of the notice.
