IT ESOLVED by the City Council of the.
City of National City, that the sum of 90 of
the contract price for the contract m)rk of the
' '•:ar %:emorial Bowl shall be raid to H. H. Johnson,
the contractor, upon the execution of a written
agreement first arr�roved by the City Attorney, by
the said contractor, and theMayor of the City of
National City. .

This agreement made and entered into this /7/4day

, by and between the C '1V OF I A TONAL
CITY, a municipal corporation, hereinafter called "the
city", and H. H. JOHNSON of 464 Spreckels Suilding, San
Diego, California, hereinafter called "the contractor":
NHEPEAS, the city and contractor have heretofore
entered in an agreement for the construction of a concrete
ampitheatre and accessories in the City Park of National
City, and
A.S, said construction is ninety percent (90%)
completed and is subject to final inspection and acceptance,
and
SF AS, the said contractor should be paid 90% of the
contract price providing said contractor vvvarrants that all
labor and material claims have been paid.

1. ;aid contractor hereby warrants and states that all
labor and material claims on said construction job have been
paid and that all bonds heretofore given shall remain in full
force and effect.
2. That this agreement in no way `?tecany

3. That 90 of said contract price shall be paid to said
contractor and 10% shall be retained by said City until 35
days after final inspection and acceptance and notice of com-
pletion has been filed.
