BE IT RESOLVED by the City Council of the City of National
City, California;
WHEREAS, the United States of America has indicated its desire
to obtain title to certain lands described and shown on Exhibit "A" hereto
as Parcel 5-A, in the City of National City, County of San Diego, title
to which is now vested in the City, and
WHEREAS, the City recognizes the necessity of acquiring these
the expansion of the U.S.Naval Repair Base, and
SEAS, the City has title to other lands which are now sub -
WHEREAS, The United States, through the Navy Department, has
indicated its desire to deposit dredged material on such of these as are
shown on Exhibit "A" hereto in the manner shown thereon, and
WHEREAS, the City desires that these lands be filled in order
to make them usable and to enhance their value, and
WHEREAS, the City and the United States desire to avoid the
institution of a proceeding in eminent domain by the United States pendi
negotiations concerning the terms on which the United States will aequir
the lands necessary for the project, and
WHZHEAS, the United States desires to be authorized to proceed
with its work pending thesenegotiations,
NOW, TFORE, it is resolved that this Council, in considera^
tion of the withholding by the United States of its proceeding in con-
demnation hereby;
(1) grants permission to the United States, its officers,
employees and agents to enter upon the. lands of the
City of National City designated on Exhibit "A"
hereto as Parcel 5 for the purpose of earrying out
the work nece esary to complete its project for the
berthing of the reserve fleet at the Naval Repair
Base, San Diego.
grants permission to the Atohison,Topeka and Santa
Fe Railroad Company to temporarily relocate and maintain
its tracks and facilities on the area shown on Exhibit
"A" hereto pending the execution of a lees Abe

(3) agrees that in the event the United States of America
files a proceeding in condemnation within one year from
this date, which time may be extended an additional year
by consent of the parties, to acquire all or any portion
of Parcel 5 as described in Exhibit "A" hereto the just
compensation to be awarded shall be determined on the
basis of the condition in which. the lands existed as of
December 10,1945. It being understood that the City
does not waive any defenses or right to contest to any
condemnation proceeding.

successors and assigns of the rights of the City to
the lands described.
