W}REAS, J. A. Rime, W. S. Hill, S. S. Johnston, Dr.E. id.Fly, and Dr. Theo.F.3ohnson have made application for a franchise to construct, operate and maintain for a period of twenty -wive years a street railway track along and upon certain streets and protty in the City of National City, State of California, which said amended petition describes said franchise and is now on file in the Office of the City Clerk in and for the City of National City; and WHEREAS, it is the purpose of the g.a.44 Board of Trustees to grant said franchise as in said petition set forth and to offer for sale the same to the highest bidder, and to advertise for bids therefor, NOW TH7R7FORE, BE IT RESOLVED that the City Clerk of the said City of National City be, and he is hereby authorized and dir- ected to pub1ish and advertise the Ilotice of Sale of said franchise and the fact of said application in the ITationa:k City 1122p,a weekly newspaper of general circulation of said City and published therein, which is hereby designated as the newspaper for that purpose. It is further ordered that said notice shall contain the statement that sealed bids for the purchase of said franchise will be received by the City Clerk at his office in sal.d City up_ to June 17th,1905, at 7:'310',0'41:bek.P,Lof said day. It is further ordered that if said franchise is sold, the successful bidder therefor, or his assign or successor, must within six months after the grant of said franchise, decide upon and select that portion of one of said avenues which runs northerly from 8th street to said city limits, upon which the railway track shall be constructed, main- tained and operated; and in case of a failure to make such decision and selection in six months as aforesaid, the the said franchise shall be forfeited along said avenues between said nth street and said City limits; and after the said selection has been made as provided, the right to lay tracks upon the .other avenues north of said nth street shall be forfeited; as it is only intended hereby to by to allowa street railway built and operateover one of said avenues north of said 8th street. It is further ordered that construction of the strnet railroad under said franchise shall be completed and in operation within two years after the grant of said franchise, unless the time is extended under the law. And it is furth'r orderd that any successful binder of saidfranchise shall file with the City Clerk, a bond to saidcity with at least two gpod andsufficient sureties to be approved by the Board of TrusteE S of said city in the penal sum of one thousand dollars conditioned that said bidder shall well and truly observe, fulfi]Iand perfom each and every term and. condition of such franchise, and in that case of every breech of condition of such bond; the whole amount of the penalsurn therein named shall be taken and deemed to be liquidated damages and be recovera- ble from the principal and sureties upon said bond..
