AND ASSOCIATED OVERHEAD STRUCTURES SHALL BE REMOVED, BY WHICH ALL PROPERTIES MUST BE READY TO RECEIVE UNDERGROUND SERVICE, AND BY WHICH THE UNDERGROUND WIRES AND FACILITIES FOR SUPPLYING ELECTRIC COMMUNICATION, COMMUNITY ANTENNA TELEVISION, OR SIMILAR OR ASSOCIATED SERVICE SHALL BE INSTALLED IN UNDERGROUND UTILITY DISTRICT NO. 16A ON PLAZA BOULEVARD FROM INTERSTATE 805 TO THE WEST OF PALM AVENUE, AND DIRECTING THE CITY CLERK TO PROVIDE PROPER NOTICE TO ALL AFFECTED UTILITY COMPANIES AND PROPERTY OWNERS WITHIN THE DISTRICT WHEREAS, on April 7, 2009, the City Council adopted Resolution No. 2009-74 establishing Underground Utility District No. 16A on Plaza Boulevard from Interstate 805 to the west of Palm Avenue for the purposes of replacing overhead wires, structures, and poles with an underground system for electric and communications services to benefit public safety, health, and welfare; and WHEREAS, pursuant to Resolution No. 2009-74, the City is required to establish a fixed date upon which all properties within District 16A must be ready to receive underground service, and by which all poles, overhead wires, and associated overhead structures must be removed. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of National City hereby establishes Friday, January 31, 2014, as the date by which all poles, overhead wires and associated overhead structures shall be removed, and by which all properties within Underground Utility District No. 16A (see Exhibit "A") must be ready to receive underground service, and by which the underground wires and facilities for supplying electric communication, community antenna television, or similar or associated service shall be installed in Underground Utility District No. 16A on Plaza Boulevard from Interstate 805 to the west of Palm Avenue. BE IT FURTHER RESOLVED that the City Council hereby directs the City Clerk to send a certified copy of this Resolution to all utility companies listed in the attached Exhibit "B", and to anyone who may own poles or facilities fixed upon poles within District No. 16A. BE IT FURTHER RESOLVED that the City Clerk is directed to notify the property owners within District No. 16A, as listed on the attached Exhibit "C", that if they or any person occupying property within District No. 16A, desire to continue to receive electric, communication, or other similar or associated services, they or such occupant shall, by Friday, January 31, 2014, provide all necessary facility changes on the premises so as to receive such service from the lines of the supplying utility or utilities at a new location. --- Signature Page to Follow --- Resolution No. 2013 — 72 Page Two PASSED and ADOPTED this 21st day of May, 2013.
