HomeMy WebLinkAboutCC RESO 2016-101RESOLUTION NO. 2016 — 101 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY RATIFYING THE CITY MANAGER'S DECLARATION OF EMERGENCY WORK TO ADDRESS ISSUES RELATED TO A RUPTURED 8-INCH SEWER LINE ON THE WESTSIDE INFILL TRANSIT ORIENTED DEVELOPMENT SITE NEAR PARADISE CREEK, RATIFYING THE WAIVING OF COMPETITIVE BIDDING PROCEDURES UNDER EMERGENCY CONDITIONS CONSISTENT WITH THE PROVISIONS INCLUDED IN SECTION 22050 `EMERGENCY CONTRACTING PROCEDURES" OF THE CALIFORNIA PUBLIC CONTRACT CODE AND SECTION 2.60.230 "EMERGENCY PURCHASES -EMERGENCY DEFINED" OF THE NATIONAL CITY MUNICIPAL CODE, AND RATIFYING PREVIOUS ACTIONS TAKEN TO PROVIDE EMERGENCY SERVICES AS A RESULT OF THE RUPTURE OF THE SEWER LINE AS AUTHORIZED BY THE CITY MANAGER, INCLUDING BUT NOT LIMITED TO, PROCURING THE NECESSARY CONTRACTUAL SERVICES, EQUIPMENT, MATERIALS AND SUPPLIES TO RESTORE SEWER SERVICE AND ENSURE ENVIRONMENTAL COMPLIANCE. WHEREAS, on October 2015, in conjunction with site preparation for the Westside Infill Transit Oriented Development ("WI-TOD") Project, National City Public Works staff performed a dye test and video of an existing 8-inch sewer line to confirm location, flow, and structural integrity of the pipe, and discovered that the pipe was ruptured in several locations; and WHEREAS, the sewer line services a handful of residences located in the vicinity of West 20th Street and Coolidge Avenue, passes across the future WI-TOD park site on the west side of Paradise Creek, under the Paradise Creek streambed, and across the WI-TOD Phase II site on the east side of Paradise Creek; and WHEREAS, because this was an active sewer line at the time of testing, and to ensure effluents did not reach Paradise Creek, the City Manager, based on findings and recommendations provided by the City Engineer, declared that the work required to implement repairs constituted an "emergency," consistent with California Public Contract Code Section 22050 ("Emergency Contracting Procedures") and National City Municipal Code Section 2.60.230 ("Emergency Purchases -Emergency Defined"), which allow for the waiver of competitive bidding procedures under emergency conditions; and WHEREAS, on October 27, 2015, the City Manager executed a Letter Agreement with Paradise Creek II Housing Partners to provide emergency services, because their project engineer and contractor were readily available to expedite the project design and construction; and WHEREAS, in December, 2015, the contractor for Paradise Creek II Housing Partners, VCC, LLC, started construction, which is approximately 90% complete. NOW, THEREFORE, BE IT RESOLVED that the City Council hereby ratifies the City Manager's declaration of emergency work to address issues related to a ruptured 8-inch sewer line on the Westside Infill Transit Oriented Development (WI-TOD) site near Paradise Creek. Resolution No. 2016 — 101 Page Two BE IT FURTHER RESOLVED that the City Council hereby ratifies the waiving of competitive bidding procedures under emergency conditions consistent with California Public Contract Code Section 22050 ("Emergency Contracting Procedures") and National City Municipal Code Section 2.60.230 ("Emergency Purchases -Emergency Defined"). BE IT FURTHER RESOLVED that the City Council hereby ratifies the previous actions taken to provide emergency repairs and services as a result of the rupture of the sewer line as authorized by the City Manager, including but not limited to, procuring the necessary contractual services, equipment, materials and supplies to restore sewer service and ensure environmental compliance.
