RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY
ISSUING AN EMERGENCY ORDER MANDATING FACE COVERINGS FOR
MEMBERS OF THE PUBLIC VISITING ESSENTIAL BUSINESSES WHILE
THEY ARE IN THE CITY OF NATIONAL CITY
WHEREAS, a novel coronavirus, COVID-19, causes infectious disease and was
first detected in December 2019; and
WHEREAS, COVID-19 symptoms include fever, cough, and shortness of breath,
and those who have been afflicted have experienced anything from mild illness to death;
and
WHEREAS, the Centers for Disease Control and Prevention considers COVID-
19 to be a very serious public health threat and the World Health Organization declared
the COVID-19 outbreak to be a pandemic; and
WHEREAS, on February 19, 2020, the San Diego County Board of Supervisors
ratified a declaration of local health emergency related to COVID-19; and
WHEREAS, on March 4, 2020, Governor Gavin Newsom proclaimed a State of
Emergency in California as a result of the threat of COVID-19; and
WHEREAS, on March 17, 2020, the City Council of the City of National City ("City
Council") adopted a Resolution ratifying the Declaration of the existence of a local
emergency that was proclaimed on March 12, 2020 in the City of National City ("City")
as a result of COVID-19; and
WHEREAS, the National City Council has urged residents to follow the Orders of
the San Diego County Health Officer, Dr. Wooten which directs the members of the public
to:
• Stay home except to take care of essential needs or go to an essential job.
• Practice social distancing. Keep at least six feet away from other people unless
they're household members. Avoid gatherings of any size.
• Wear a face covering when leaving home.
WHEREAS, there have been reports that people going to, from and in essential
businesses that allow members of the public to enter have failed to wear face covering
thereby placing themselves and others at risk of COVID-19; and
WHEREAS, National City over the last two weeks has seen a rise in the number
of COVID-19 cases. Stricter measures and guidelines are needed in the South Bay to
combat this virus and protect the public in an effort to slow the rate of its spread.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of
National City hereby finds that an emergency order is necessary to protect the residents,
visitors and the general public of National City in effort to keep them safe, healthy and to
prevent the spread of COVID -19.

BE IT FURTHER RESOLVED, that the City Council of National City pursuant to
the Public Health Officer's Order numbers 10 and 11 to have all employees at essential
businesses who may have contact with the public are ordered to wear a face covering as
described in the California Department of Public Health Face Covering Guidance.
BE IT FURTHER RESOLVED, that the City Council of the City of National City
hereby issues an Emergency Order mandating face coverings for members of the public
visiting essential businesses while they are in the City of National City. For purpose of
this order the term "essential businesses" shall include any line established for entrance
into such essential business.
BE IT FURTHER RESOLVED AND ORDERED, that all individuals governed by
this Emergency Order to wear face coverings are personally responsible for their own
compliance. In addition, essential business owners and managers shall be responsible
for assuring compliance with the above -described face covering requirements for
workers, volunteers, and members of the public within their respective essential business;
such responsibility shall include, as necessary, refusing admission or service to any
member of the public who fails to wear a face covering when entering the essential
business.
BE IT FURTHER RESOLVED, that the authority of this Emergency Order is
enacted under the City Council's Police Powers to protect and promote the health, safety
and welfare of the public pursuant to the California Constitution and pursuant to the Order
of the Health Officer and Emergency Regulations specifically order number 24 which
mandates governmental entities in the county to take necessary measures to ensure
compliance with the Health Officer's Orders.
