HomeMy WebLinkAboutCC RESO 2020-217RESOLUTION NO. 2020 — 217 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY APPROVING THE RANCHO ARROYO VILLAS SUBDIVISION MAP AND MAINTENANCE AGREEMENT, ACCEPTING ON BEHALF OF THE PUBLIC CERTAIN EASEMENTS, APPROVING THE VACATION OF FUTURE UNUSED EASEMENTS, AND AUTHORIZING THE MAYOR AND CITY CLERK TO SIGN THE MAP WHEREAS, Bartizan Investments, LLC, a Nevada Limited Liability Company, (Owner), is the owner of the property located at the south end of "C" Avenue, APN 562 170 0900, south of East 27th Street in an undeveloped canyon area; and WHEREAS, the Owner has proposed a subdivision of the property into five parcels to build five new single-family homes; and WHEREAS, the parcel is currently vacant and approximately 36,000 square feet in size with access from an existing easement located at `C' Avenue, south of East 27th Street; and WHEREAS, the property contains a ten -foot -wide sewer easement with an eight -inch sewer main; and WHEREAS, most of the sewer main and the ten -foot sewer easement will be rerouted into the proposed sewer alignment, as dedicated on the map and the existing unused section of the easement is abandoned pursuant to section 6643(g) of the Subdivision Map Act; and WHEREAS, the Owner will provide, on this map, an easement for access and utilities for the benefit of Parcels 1, 2, 3, 4, and 5; and WHEREAS, the Owner has provided a Private Road Maintenance Agreement providing for joint maintenance, by and among, said Parcels 1, 2, 3, 4, and 5 of the shared roadway within the easement area; and WHEREAS, access is for the benefit of the City of National City Fire Protection purposes and the City of National City Public Works service vehicles and crews; and WHEREAS, City of National City staff reviewed the map on September 11, 2019, and found that it substantially complies with the tentative map, that it is technically correct and complies with the requirements of the Subdivision Map Act and National City Municipal Code Chapter 17, Subdivisions; and WHEREAS, the City of National City's staff recommends City Council's approval of the Rancho Arroyo Villas Subdivision Map and Maintenance Agreement, accept certain easement on behalf of the public, , authorize the vacating of future unused easements, and for the Mayor and City Clerk to sign the map. Resolution No. 2020 — 217 Page Two NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of National City hereby approves the Rancho Arroyo Villas Subdivision Map and Maintenance Agreement, accepting certain easements on behalf of the public, approving the vacation of future unused easements, and authorizes the Mayor and City Clerk to sign the map.
