RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA, 1) REJECTING ALL B1DS RECEIVED ON MAY 12, 2022, FOR THE LAS
PALMAS SWIMMING POOL RENOVATION PROJECT, CIP NO. 22-09; 2)
ACCEPTING THE BIDS RECEIVED ON JULY 20, 2022; 3) AUTHORIZING THE
APPROPRIATION OF ADDITIONAL FUNDS IN AMOUNT OF $660,907 FROM THE
REMAINING BALANCE OF AMERICAN RESCUE PLAN ACT (ARPA) FUND; 4)
AWARDING A CONTRACT TO CALIFORNIA COMMERCIAL POOL, INC., IN THE
NOT -TO -EXCEED AMOUNT OF $3,206,850 FOR THE LAS PALMAS SWIMMING
POOL RENOVATION PROJECT, CIP NO. 22-01; 5) AUTHORIZING A 10%
CONTINGENCY IN THE AMOUNT OF $320,685 FOR ANY UNFORESEEN CHANGES;
AND 6) AUTHORIZING THE MAYOR TO EXECUTE THE CONTRACT
WHEREAS, the Las Palmas Pool Swimming Pool Renovation Project will re-plast, re -
deck and expand the width of the pool by 10 feet; and
WHEREAS, EAs, the expansion of the pool is based on the City Council's desire to increase
the pool's capacity for both programming opportunities and swimming time for City residents;
and
WHEREAS, as plans and specifications were developed for the Las Palmas Pool
Emergency Project, staff and the City's consultant suggested that the expansion of the width
of the pool by 10 feet would have positive benefits for the community including 1 expanded
pool size will increase lap and recreational swimming by 100% for both programmed and free
swimming 2) the pool size would be brought up to the standard for competition at the high
school and collegiate level; and
WHEREAS, widening the pool an additional 10 feet along its length will allow for
greater flexibility for programming and free swim. As programmed and free swim could then
take place at the same time, it would increase pool use significantly; and
WHEREAS, on April 21, 2022, the bid solicitation was posted on PlanetBids, a free
public electronic bidding system for contractors; and
WHEREAS, on April 28, 2022 and May 2, 2022, the bid solicitation was advertised in
local newspapers; and
WHEREAS, on May 12, 2022, four bids were received by the 5:00 p.m. deadline;
and
WHEREAS, upon a review of all documents submitted, staff had to reject the first and
second apparent lowest bidders since they did not meet the minimum project qualifications
necessary to perform the work; and
WHEREAS, City staff also had to reject the third and fourth apparent lowest bidders
since the total cost of construction was higher than the budget allocated by the City for this
project; and
WHEREAS, as a result of this outcome, on June 23, 2022, staff re -advertised the
project on PlanetBids with a revised scope of work in order to receive the bids within the
budget allocations; and

WHEREAS, E ►S on June 28, 2022 and July 5, 2022, the bid solicitation was advertised in
local newspapers; and
WHEREAS, S, n July 20, 2022, two (2) bids were received by the 2:00 p.m. deadline.
California Commercial Pools, Inc., was the apparent lowest bidder with a total bid amount of
$3,206,850; and
WHEREAS, S, upon a review of all documents submitted, California Commercial Pools,
1n', bid was deemed responsive and the lowest responsible bidder qualified to perform the
work as described in the project specifications; and
WHEREAS, the initial budget allocated for the Las Palmas Swimming Pool
Renovation project was $3,2500O0 including the construction, contingency and soft costs;
and
WHEREAS, the lowest bid received was higher than estimated for every bid item; and
WHEREAS, S, due to current national and regional challenges caused by material cost
increase, shortage of labor force, fuel price increase and inflation; and
WHEREAS, S, City staff is requesting additional $598,220 for a total cost of $3848,220
in order to cover the additional project cost; and
WHEREAS, EAS, City staff recommends 1 rejecting all bids received on May 12, 2022, for
the Las Palmas Swimming Pool Renovation Project, CIP No. 22-01; 2) accepting the bids
received on July 20, 2022; awarding a contract to California Commercial Pool, Inc., in the
not -to -exceed amount of $3,206,850 for the Las Palmas Swimming Pool Renovation Project,
CIP No. 22-01; authorizing a 10% contingency in the amount of $320,685 for any
unforeseen changes; and authorizing the Mayor to execute the contract; and
WHEREAS, S, City staff also recommends authorizing the appropriation of additional
funds in amount of $660,907 from the remaining balance of American Rescue Plan Act
(ARFA) fund to Las Palmas Swimming Pool Renovation Project, CIP No. 22-01,
NOW, , THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS:
Section 1: That the City Council hereby authorizes the Mayor to execute the
contract with California Commercial Pool, Inc. for $3,206,850 for the Las Palmas Swimming
Pool Renovation Project, CIP No. 22-01.
Section 2: Authorizes a 10% contingency in the amount of $320,685 for any
unforeseen changes.
Section 3: Authorizes the appropriation of additional funds in amount of $660907
from the remaining balance of American Rescue Plan Act RP fund.

Section 4: Authorizes rejecting all bids received on May 12, 2022 and accepting
the bids received on July 20, 2022.
Section ►: That the City Clerk shall certify to the passage and adoption of this
Resolution olution and enter it into the book of original Resolutions.
