AUTHORIZING THE CITY COUNCIL TO WAIVE THE FORMAL BID PROCESS PURSUANT TO NATIONAL CITY MUNICIPAL CODE SECTION 2.60.220, SUBSECTION (B), SOLE SOURCE PROCUREMENT, FOR THE NATIONAL CITY POLICE DEPARTMENT'S PURCHASE AND 2.) AUTHORIZING THE MAYOR TO EXECUTE THE PURCHASE OF THE FARO LASER SCANNER SYSTEM FROM FARO TECHNOLOGIES INC. IN A NOT -TO -EXCEED AMOUNT OF $81,927.64 WHEREAS, S, the National City Police Department ("NCPD") currently utilizes a Total Station survey scannerto document major crime scenes and fatal vehicle collisions forfactual reconstruction; and WHEREAS, E ►S, the Total station System is supported by the Crash Zone program, however, the Crash Zone program is no longer licensed, supported or sold; and WHEREAS, NCPD currently operates with 1 one computer with Crash Zone installed; and WHEREAS, EAS, the FARO O Laser scanner System is currently used by all agencies in our area with the exception of San Diego Police Department; and WHEREAS, the FARO Laser Scanner is specifically designed for both indoor and outdoor measurements, produces 3D version of any scene it measures and can be made into an animated motion recreation of scenes such as Homicide or a major vehicle collision; and WHEREAS, S, this system can also measure blood spatter and cast off and can provide projectile trajectory information; and WHEREAS, section 2.60.220 (B) of the National City Municipal Code("NCMC") regarding open market procedure - exception to bidding requirements, provides an opportunity to allow for the purchase of the FARO Laser Scanner System from FARO Technologies Inc. in light of the fact that the FARO Laser Scanner System is uniquely compatible with the needs of the Department and given its wide use by other police agencies it is clear that the competitive bidding process would not produce any competitive advantage; and WHEREAS, city staff requests City council to waive the formal bid process pursuant to National City Municipal Code section 2.60.220, subsection (B), sole source procurement, for the National City Police Department's purchase of the FARO Laser Scanner System and authorize the Mayor to execute the purchase agreement for the FARO Laser Scanner System from FARO Technologies INC. in a not -to -exceed amount of$1,2.4. Resolution No. 2022 —141 Page Two NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS: WS: Section 1: Authorize the waiving of the formal bid process pursuant to National City Municipal Code section 2.60.220, subsection (B)., sole source procurement, for the National City Police Department's purchase of the FARO Laser Scanner System. Section 2: Authorize the Mayor to execute the purchase agreement for the FARO Laser Scanner System from FARO Technologies INC. in a not -to -exceed amount of $81,92764. Funds will be taken from the 2019 COPS Grant for Public Safety Equipment and the balance will be taken from the Training, Travel & Subsistence Account. Section 3. The City Clerk shall certify the passage and adoption of this Resolution and enter it into the book of original Resolutions. PASSED and ADOPTED this 6th day of September 2022.
