RESOLUTION OF THE CITY COUNCIL
• OF THE CITY OF NATIONAL CITY
APPROVING A PROPOSED STORM DRAIN EASEMENT
DEDICATED TO THE CITY OF NATIONAL CITY
FROM NATIONAL SCHOOL DISTRICT PROVIDING AN
EASEMENT ON LINCOLN ACRES ELEMENTARY SCHOOL PROPERTY
WHEREAS, pursuant to a disposition and development agreement between
the Community Development Commission of the City of National City and the
Metropolitan Area Advisory Committee on Anti -Poverty of San Diego County, Inc.
(MAAC), MAAC is constructing four single-family residential units, and rehabilitating
one single-family residential unit, on Euclid Avenue; and
WHEREAS, the development of four new structures and one rehabilitated
structure require a storm drain system designated to carry storm water to the most
appropriate public storm drain, which is located on Valle Vista Avenue adjacent to
Lincoln Acres Elementary School; and
WHEREAS,, a proposed easement entitled, "Deed of Dedication" and
drawing (attached hereto) have been prepared for action by the National School District
Board of Trustees.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City
of National City that the City is willing and able to accept the proposed easement, entitled
"Deed of Dedication," and including its identifying drawing (attached hereto), at such
time the easement and drawing are approved by the National School District Board of
Trustees.
PASSED and ADOPTED this 6th day of June, 1995.

DEED OF DEDICATION
The National School District of. San Diego County, California,
does hereby dedicate to the City of National City, an easement for
the construction, operation, replacement, maintenance, and
inspection of a Storm Drain and appurtenances thereto, through,
over, under, along and across all that real property situated in
the City of National City, County of San Diego, State of
California, belonging to the said School District and more
particularly described as follows:
That portion of the Southwest Quarter of Quarter Section 107 of
Rancho De La Nacion, in the City of National City., County of San
Diego, State of California, according to Map thereof No. 166 made
by Morrill', filed May 11, 1869 in the Office of the County Recorder
of said San Diego County, described as follows:
BEGINNING at the Southeasterly corner of Lot 6, Block "A" of F.A.
RICHARD'S SUBDIVISION, according to Map thereof No. 2459, filed in
the Office of the County Recorder of said San Diego County; thence
along the Southerly line of said Lot 6, South 70°51'00" West a
distance of 20.00 feet to the TRUE POINT OF BEGINNING; thence

Subject: RESOLUTION OF THE CITY COUNCIL OF'THE CITY OF NATIONAL
CITY APPROVING A PROPOSED STORM DRAIN EASEMENT DEDICATED
TO THE CITY OF NATIONAL CITY FROM NATIONAL SCHOOL
DISTRICT PROVIDING AN EASEMENT ON LINCOLN ACRES
ELEMENTARY SCHOOL PROPERTY
A report regarding this subject was provided the City's Community
Development Commission at its regular meeting of April 18, 1995.
At that time, it was pointed out that the School District was
reluctant to grant a storm -drain easement to entities other than
the City of National City.
Due to discussions with private property owners living on Valley
Vista Avenue, it was suggested that an attempt be made to secure an
easement on private property for the Developer (MAAC), to construct
the necessary storm drainage line. Unfortunately, the private
property owners don't agree to the need for such a drainage system
and have, therefore, rejected staff requests.
The purpose of the drainage line is to accommodate storm water run-
off following the construction of four (4) new single-family homes
along the 2000 block of Euclid Avenue in accordance with the MAAC-
CDC approved Disposition and Development Agreement. Due to the
City's elevation and reconstruction of Euclid Avenue, the easterly
slope of these lots require a drain to carry surface water to the
City's storm drain, located at the end of Valle Vista Avenue. The
drain would run south along the rear property lines of the four new
houses and the existing rehabilitated unit.
In order to get the water to the Valle Vista Drain, a 15-foot by
155-foot easement is needed along the north end of Granger
Elementary School land. (See the attached Deed of Dedication. and
Drawing.) The land area needed for the easement is primarily on a
slope area not used for playground purposes. At the CDC meeting of
April 18th, Commissioners generally agreed that the City should be
the responsible entity for maintaining the easement, since it was
the City that created the situation by the construction of Euclid
Avenue. The annual cost to the maintain is minimal.
