The owners of the vacant lot on Shelby Drive, APN 563-184-40, offered
to dedicate to the City, a portion of their southeasterly property corner
which is needed for the future street improvements along Shelby Drive. The
street improvements on Shelby Drive will be constructed by the County of
San Diego at no cost to the City.
The area of the dedicated parcel is described on the attached easement
document. This resolution will also rename the dedicated parcel of land as
Shelby Drive.

RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF NATIONAL CITY
ACCEPTING CONVEYANCE OF REAL PROPERTY
FROM THE NORMA J. MORRISON TRUST,
DIRECTING THE RECORDATION OF AN EASEMENT FOR
STREET PURPOSES AND DEDICATING AND NAMING
A PARCEL OF LAND ON SHELBY DRIVE
(A.P.N. 563-184-40)
BE IT RESOLVED by the City Council of the City of National City that
pursuant to Resolution No. 7083, the City Clerk is hereby ordered to execute a Certificate
of Acceptance and to record the following instrument conveying an interest in real estate
to the City of National City:
EASEMENT FOR STREET PURPOSES dated December 7, 1995 from
NORMA J. MORRISON, Trustee of Norma J. Morrison Trust of April 27,
1993.
BE IT FURTHER RESOLVED as follows:
1. That the real property described in the attached Exhibit "A" was
conveyed to the CITY OF NATIONAL CITY for street purposes.
2. That the CITY OF NATIONAL CITY desires that said property be
dedicated for public street purposes.
3. That the described parcel of land in Exhibit "A" shall henceforth be
known as a portion of Shelby Drive.
PASSED and ADOPTED this 16th day of January, 1996.

incidents thereto for a public street upon, over and across that certain real property in the City of National City,
County of San diego, State of California, described as follows:

All that portion of Lot 10, of ORANGE VILLA in the City of National City, County of San Diego, State
of California, according to Map thereof No. 1333 filed April 4, 1911 in the Office of the County
Recorder of said County lying Southerly of the following described line:
BEGINNING at a point on the Southeasterly line of Lot 11 of said Map No. 1333, said point being 5.00
feet Northeasterly of the most Southerly corner of said Lot 11; thence Northwesterly in a straight line
to a point on the Southwesterly boundary of that land described in deed to L. E. Morrison, et ux,
recorded in said County Recorder's Office, July 28, 1972 as File/Page No. 72-188232, said point being
5.00 feet Northwesterly of said most Southerly corner of Lot 11 and the POINT OF TERMINUS.
TOGETHER WITH an easement for excavation and embankment slopes and drainage structures over,
under, through and across that portion of said Lot 10 lying Northerly of the right-of-way described
above and Southerly of the following described line:
BEGINNING at a point on the Northeasterly line of said Lot 10, said point being 8.00 feet Northerly of
said most Southerly corner of Lot 11; thence Westerly in a straight line to a point on said Southwesterly

The Grantor hereby further gr6:r.o to the City of National City the privilege and right to extend drainage structures
and excavation and embankment slopes beyond the limits of the herein described right-of-way where required for
the construction and maintenance of said public street. RESERVING unto the grantor of the above described parcel
of land, his successors or assigns, the right to eliminate such slopes and/or drainage structures or portions thereof,
when in the written opinion of the City Engineer of Grantee, the necessity therefore is removed by substituting other
protection, support and/or drainage facility, provided such substitution Is first approved in writing by said City
Engineer.
The Grantor hereby further grants to Grantee all trees, growths (growing or that may hereafter grow), and road
building materials within said right-of-way, including the right to take water, together with the right to use the same
in such manner and at such locations as said Grantee may deem proper, needful or necessary, in the construction,
reconstruction, improvement or maintenance of said public street.
The Grantor, for himself, his successors and assigns, hereby waives any claim for any and all damages to Grantor's
remaining property contiguous to the right-of-way hereby conveyed by reason of the location, construction,
landscaping or maintenance of said public street.
