HomeMy WebLinkAboutGarcia, Maria - Permit to Enter and Work on Premises - 2024 NI �- CALIFORNIA NATIONAL Clint 's1 V INCORPORATED LIMITED ACCESS AGREEMENT PERMIT TO ENTER AND WORK ON PREMISES THIS LIMITED ACCESS AGREEMENT (the "Agreement") is executed as of the _ day of October, 2024 (the "Effective Date") by and between Garcia Maria D R Trust 03-17-08P ("Garcia"), and the CITY OF NATIONAL CITY, a municipal corporation with an address of 1243 National City Blvd., National City, California 91950 (the"City"). Commencing on and as of the Effective Date of this Agreement, Garcia, as owner of the real property located at 1306 E. 16th Street, National City, California 91950 (the "Premises"),hereby grants permission to the City,its contractors,officers,employees,and agents to enter upon the Premises between the hours of 6:30 a.m. and 5:00 p.m. local time, Monday through Friday, solely for the purpose of removing and replacing a 36-inch storm drain and box culvert that runs across the northeast corner of the Premises and no other purposes whatsoever (Exhibit "A" Attached) . The City shall comply with all applicable laws, regulations, and rules governing the Premises. The term of this Agreement shall commence on the date of this Agreement and shall terminate thirty (30) days after completion of the removal and replacement of the storm drain and private improvements. Upon expiration or termination of this Agreement, the City shall immediately remove all equipment from the Premises, restore the Premises to its current condition (including the block retaining wall) on and as of the date immediately preceding the date of this Agreement (save for construction contemplated herein), and vacate the Premises. The City shall be liable for any injury,loss,damage or expense and claims for loss,damage or expenses that result from the negligent or intentional acts of the City. The City's indemnity obligations herein shall survive the expiration or earlier termination of this Agreement. Notwithstanding the foregoing, the City's indemnity obligations shall not be construed to apply to claims in which Garcia is alleged or proven to be negligent or for Garcia's willful misconduct. This Agreement shall be considered to be a single integrated contract and represents the full and complete agreement of the parties concerning the transactions contemplated hereunder. Upon execution by Garcia and the City,this Agreement shall be binding upon the respective parties and their legal representatives, successors, and assigns. This Agreement may not be modified except in a writing signed by each of the parties hereto. This Agreement may be executed in multiple counterparts,each of which shall be deemed to be an original and all of which,when taken together,will be deemed to constitute one �^ CALIFORNIA -4. Any party to this Agreement may deliver an executed copy hereof by electronic transmission to the other party and any such delivery shall have the same force and effect as delivery of a manually signed copy of this Agreement. By signing below, the undersigned representative of the City hereby represents and warrants that he/she is a duly authorized officer of the City and has legal capacity to execute this Agreement, having full express authority to bind the City to the terms and conditions hereof.
