Public Participation: Encouraged in a number of ways as described below. Members of the
public may attend the City Council Meeting in person, watch the City Council Meeting via live web
stream, or participate remotely via Zoom. Recording of Meetings are archived and available for
viewing on the City’s website.
Public Comment: Persons wishing to address the City Council on matters not on the agenda
may do so under Public Comments. Those wishing to speak on items on the agenda may do so
when the item is being considered. Please submit a Speaker’s Slip to the City Clerk before the
meeting or immediately following the announcement of the item. All comments will be limited
up to three (3) minutes. The Presiding Officer shall have the authority to reduce the time allotted
to accommodate for a large number of speakers. (City Council Policy 104)
EFFECTIVE JANUARY 1, 2023
All Contributions to Candidates and Current Elected Officials are required to self-report a
Declaration of Campaign Contribution to a Councilmember of more than $250 within the past
year (effective Jan 1, 2023). This report may be included on the Public Comment Speaker Slip to
be completed prior to the City Council Meeting.
If you wish to submit a written comment email to the City Clerk’s Office at least 1 hour before the
City Council Meeting to allow time for distribution to the City Council.
Spanish Interpretation Services: Spanish Interpretation Services are available; please
contact the City Clerk before the start of the meeting for assistance.
American Disabilities Act Title II: In compliance with the American Disabilities Act of 1990,

RECOMMENDATION:

LLP, for Legal Services in the Specialized Area of Land Use and Business Matters Regarding the
San Diego Unified Port District by Increasing the Not-to-Exceed Amount by $25,000 for a New
Not-to-Exceed Total Amount of $100,000.”

EXPLANATION:
The City of National City (“City”) engages outside legal support for specialized areas. Matters
involving the San Diego Unified Port District require specialized expertise related to the Public
Trust Doctrine and other specialized laws, regulations and policies involving the waterfront. In
January 2024, the City Attorney’s Office negotiated a new retainer agreement with Devaney Pate
Morris Cameron, LLP (“DPMC”). The legal services included representing the City in connection
with waterfront development, implementation of the Balanced Land Use Plan, assisting with the
negotiation of the Municipal Services Agreement and other business matters regarding the San
Diego Unified Port District for a not-to-exceed amount of $25,000. On August 6, 2024, the
Agreement was amended to increase the not-to-exceed amount by $50,000 for a new not-to-
exceed total amount of $75,000 by Resolution No. 2024-89.
To ensure the City’s interests remain protected and to avoid any lapse in the City’s ability to
consult with DPMC, City staff recommends a Second Amendment to the Agreement by increasing
the not-to-exceed amount by $25,000 for a new not-to-exceed total amount of $100,000.
FINANCIAL STATEMENT:
Sufficient funds exist in account no. 100-10-13-13100-7213, City Manager’s Professional
Services account.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA,
AMENDING THE AGREEMENT BETWEEN THE CITY OF NATIONAL CITY AND DEVANEY
PATE MORRIS & CAMERON, LLP, FOR LEGAL SERVICES IN THE SPECIALIZED AREA OF
LAND USE AND BUSINESS MATTERS REGARDING THE SAN DIEGO UNIFIED PORT
DISTRICT BY INCREASING THE NOT-TO-EXCEED AMOUNT BY $25,000 FOR A NEW NOT-
TO-EXCEED TOTAL AMOUNT OF $100,000.
WHEREAS, in January 2024, the City of National City (“City”) entered into an Agreement
with Devaney Pate Morris & Cameron, LLP (“DPMC”) to assist in representing the City in
connection with matters regarding the San Diego Unified Port District for an amount not-to-exceed
$25,000; and
WHEREAS, on August 6, 2024, the Agreement was amended to increase the not-to-
exceed amount by $50,000 for a new not-to-exceed total amount of $75,000 by Resolution No.
2024 – 89; and

Section 1: Authorizes the Mayor to execute the Second Amendment to the Agreement
between the City of National City and Devaney Pate Morris & Cameron, LLP, for legal services in
the specialized area of land use and business matters regarding the San Diego Unified Port
District to increase the not-to-exceed amount by $25,000 for a new not-to-exceed amount of
$100,000.
Section 2: The City Clerk shall certify to the passage and adoption of this Resolution
and enter it into the book of original Resolutions.

EXPLANATION:
On January 21, 2024, The City of National City (“City”) received notice of Tax Sale No. 7095, a
sale of tax-defaulted properties through the County of San Diego Treasurer-Tax Collector (“TTC”).
If a property owner is delinquent on their property tax payments for five or more years, the TTC
is empowered by state law to declare the property delinquent and sell the property at public
auction to recover back taxes. Prior to public auction, the governing body of the public agency
can enter into "Chapter 8" Purchase Agreements with the TTC to acquire the parcels for public
benefit. The TTC provides public agencies and nonprofit organizations with a list of pending sales.
Counties, cities, taxing agencies, revenue districts, special districts, the State of Califo rnia, and
other state agencies may purchase properties prior to auction for public use.
"Chapter 8" purchase agreements are negotiated between the TTC and the interested public
agencies or nonprofit organizations. The "Chapter 8" purchase price is set by t he minimum bid
established by TTC in accordance with Revenue and Tax Code § 3793.1 and includes all
defaulted taxes, assessments, associated penalties and costs, costs of sale, and the "outstanding
balance of any property tax postponement loan." The TTC typically sets the minimum bid at
roughly half of the assessed value of the defaulted property.
Available Properties
The following three National City properties are listed for auction:

If the City desires to purchase one or more of these properties, it must provide no later than
February 13, 2025, a completed application form which includes:

1) A written objection to the scheduled sale and request to acquire the parcels on City
letterhead. This must include a list of the parcels by address/APN, the intended use for
each parcel, and how that intended use complies with the City’s mission statement; and
2) A resolution from the governing board authorizing the purchase(s); and
3) The City’s mission statement
The City intends to utilize the properties to offer for low-income homeownership opportunities
once fully rehabilitated. However, the City has been made aware that it is a common occurrence
for tax-defaulted properties up for auction to be pulled from the listing at the last minute as the
owners find various ways to settle the outstanding tax bill. As such, any or all of these properties
may no longer be available for sale by the time the sale deadline date arrives, rendering the City
unable to acquire them.
FINANCIAL STATEMENT:
This item is only to approve the application. If successful, appropriation of Housing Authority
funds, available from fund balance, will occur at a future date when the Chapter 8 Purchase
Agreement is brought to City Council for approval. There is no financial impact to the General
Fund.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA,
AUTHORIZING AN APPLICATION TO PURCHASE TAX-DEFAULTED PROPERTIES FROM
THE COUNTY OF SAN DIEGO TREASURER-TAX COLLECTOR THROUGH TAX SALE NO.
7095.
WHEREAS, on January 21, 2024, the City of National City (“City”) received notice of Tax

EXPLANATION:
On October 25, 2022, Plaintiffs Estate of Brian Umana, by and through his successor in interest,
B.U., by and through her guardian ad litem Roberto Umana, individually and as successor in
interest to Brian Umana and Margarita Cardenas (“Plaintiffs”) filed a lawsuit against the City of
National City (“City”) and National City Police Officers regarding the alleged wrongful death of
Brian Umana. The suit is titled Estate of Brian Umana et al. v. City of National City, United States
District Court for the Southern District of California, Case Nos. 3:22-CV-01657-GPC-AGS AND
3:22-CV-01657-GPC-SBC.
On December 3, 2024, City Council convened in Closed Session and voted unanimously to
authorize a settlement of $1,000,000. On January 20, 2025, Plaintiffs executed a Settlement
Agreement agreeing to resolve the Litigation. This settlement is not an admission of guilt on the
part of the City, or its officers. The City’s decision to reach a settlement is done to mitigate financial
risk to the City and taxpayers.
FINANCIAL STATEMENT:
Approval of this action will increase Fiscal Year 2025 Appropriations in the Liability Insurance
Fund (account 627-10-15-15600-7432) by $1,000,000. The City is self-insured up to $250,000.
All costs of this case in excess of $250,000 will be reimbursed by the City’s insurance carrier.

SETTLEMENT AGREEMENT AND GENERAL RELEASE OF ALL CLAIMS
This Settlement Agreement and General Release of All Claims (hereinafter “Agreement”)
is made and entered into as of January 20, 2025, by and between Plaintiffs ESTATE OF BRIAN
UMANA, by and through his successor in interest, B.U., by and through her guardian ad litem
Roberto Umana, individually and as successor in interest to Brian Umana, Margarita Cardenas
individually (collectively “Plaintiffs”) v. NATIONAL CITY, a municipal corporation,
NATIONAL CITY POLICE DEPARTMENT, an unknown entity, OFFICERS MICHAEL
SPORTELLI and EVAN DAVIS; CORPORAL RYAN STINNETT (collectively “Defendants”).
Hereinafter, Plaintiffs and Defendants will be collectively referred to as “Parties” or individually
as a “Party”.
RECITALS
On October 25, 2022, Plaintiffs filed a Complaint alleging a series of civil rights
violations related to the death of their beloved family member BRIAN UMANA, who was killed
in an officer involved shooting. Specifically, in the operative Second Amended Complaint,
Plaintiffs alleged causes of action including: (1) Use of Excessive Force (42 U.S.C §1983),
(2) Monell (42 U.S.C. §1983), (3) Assault/Battery, (4) Bane Act §52.1, (5) Violation of
Americans with Disabilities Act, (6) Deprivation of Medical Care, (7) Negligence, (8) Wrongful
Death (CCP §377.60), (9) Substantive Due Process – Interference with Familial Relations (42
U.S.C. §1983), (10) Violation of the Rehabilitation Act (29 U.S.C. §794(a)), (11) Intentional
Infliction of Emotional Distress. The case was filed in the United States District Court for the
Southern District of California as Case Number: 3:22-CV-01657 GPC AGS and 3:22-CV-01657
GPC SBC.
This Agreement is in full accord and satisfaction of said action and any and all disputed
claims that may arise out of said incident, and the payment of the sums detailed below is not an
admission of liability by any party but is in compromise of disputed claims.
AGREEMENT
1.0 Release and Discharge
1.1 In consideration for the payments detailed below, each Party, and their assignees,
fully and forever release and discharge every other Party from any and all actions, causes of
action, claims, demands, damages, liabilities, costs, attorney’s fees, expenses, compensation and
workers’ compensation benefits by reason of any damages, general or special, or injury or
injuries sustained on account of or any way arising out of the incident described and set forth in
the operative Complaint in the above-described lawsuit and which occurred on October 8, 2021.
1.2 This Agreement is intended as a full and complete release and discharge of all
claims that the Parties may have by reason of the incident set forth in the operative Complaint in
the above-described action. In consideration for the payment detailed below, the Parties do
hereby release and discharge each and every other Party, including each such Party’s assignees,
agents, servants, successors, worker’s compensation carriers, lien holders, insurers, attorneys,
and all others claiming through them from any and all liability of any nature related to the above-

described incident, specifically including, but not limited to, all costs and expenses each such
Party may have incurred, including, but not limited to, attorney’s fees. This Agreement shall be a
fully binding and complete agreement among the Parties, and their respective heirs, assigns and
successors.
1.3 Each Party also hereby releases and discharges each other from all consequences,
effects and results of the incident set forth in the Complaint and the resulting damages. Further,
all rights under Section 1542 of the Civil Code of the State of California are hereby expressly
waived. The Parties understand that Section 1542 of the Civil Code provides as follows:
A general release does not extend to claims that the creditor or releasing party does
not know or suspect to exist in his or her favor at the time of executing the release
and that, if known by him or her, would have materially affected his or her
settlement with the debtor or released party.
1.4 This Agreement is the result of arms-length negotiations. All Parties represent
and warrant to the others that the persons executing this Agreement on behalf of such Party are
duly and fully authorized to do so, that each Party, where applicable, is acting pursuant to the
power and authority granted by its respective principals and that no further approvals are
required to be obtained from any person or entities.
1.5 The Parties further declare and represent that no promise, inducement, or
agreement not herein expressed has been made and that this Agreement contains the entire
agreement between the Parties and that the terms of this Agreement are contractual and not mere
recital.
1.6 Plaintiffs further declare that, in exchange for the payment detailed below,
Plaintiffs are solely responsible to satisfy all existing, outstanding, or future liens (including
Medicare or Medical liens) associated with this action, and to release, hold harmless, and
indemnify Defendants and the Defendants’ counsel from responsibility to satisfy any such lien, if
one now or hereafter ever exists.
2.0 Consideration
2.1 Plaintiffs have agreed to dismiss the Defendants from this matter, with prejudice,
in exchange for payment of ONE MILLION DOLLARS ($1,000,000.00). Defendants shall
deliver said payment to Plaintiffs’ attorneys within thirty (30) days of the plaintiffs’ return of the
signed agreement. The check will be made payable to: “McKenzie Scott PC in trust” for
“Umana” and the “Law Offices of Emily E. Howe”. Plaintiffs shall send Defendants’ Counsel a
Request for a Joint Motion for Dismissal with prejudice, to hold in trust for joint filing after
payment has been issued and cleared upon the full execution of this Agreement.

3.0 Attorney’s Fees
Each Party hereto shall bear all attorney’s fees and costs arising from the actions of its
own counsel in connection with the Agreement, the matters and documents referred to herein,
and all related matters.
4.0 Representation of Comprehension of Document
In entering into this Agreement, Plaintiffs represent that they have relied upon the advice
of their attorneys, who are the attorneys of their choice; that the terms of this Agreement have
been completely read and explained by their attorneys; and that the terms of this Agreement are
fully understood and voluntarily accepted by Plaintiffs.
5.0 Warranty of Capacity to Execute Agreement
Plaintiffs represent and warrant that no other person or entity has, or has had, any interest
in the liens, claims, demands, obligations, or causes of action referred to in this Agreement; that
Plaintiffs have the sole right and exclusive authority to execute this Agreement and receive the
sums specified in it; and that Plaintiffs have not sold, assigned, transferred, conveyed or
otherwise disposed of any of the liens, claims, demands, obligations or causes of action referred
to in this Agreement.
6.0 Governing Law
This Agreement shall be construed and interpreted in accordance with the laws of the
State of California.
7.0 Additional Documents
All Parties agree to cooperate fully and execute any and all supplementary documents
and to take all additional actions which may be necessary or appropriate to give full force and
effect to the basic terms and intent of this Agreement.
8.0 Entire Agreement and Successors in Interest
This Agreement contains the entire agreement between the Parties with regard to the
matters set forth in the operative Complaint and shall be binding upon and inure to the benefits
of the executors, administrators, personal representatives, heirs, successors and assigns of each
Party.
9.0 Effectiveness
This Agreement shall become effective immediately following execution by each of the
Parties.

to the Agenda Report as Exhibit A, and authorizes the Finance Director to pay the sum of one
million dollars ($1,000,000) from the Liability Claims Cost Fund, account No. 627-10-15-15600-
7432, in settlement of each and every claim for damages, interest, costs, and fees of any type
against the City of National City, its agents and employees, arising from the Litigation filed by
Plaintiffs.
Section 2: That the City Council hereby authorizes the establishment of an
appropriation of one million dollars ($1,000,000) in the Liability Insurance Fund.

and enter it into the book of original Resolutions.

EXPLANATION:
The California Government Code (§53646(b)(1)) requires that, when the Treasurer or the Chief
Fiscal Officer of a local agency renders to the legislative body of the agency a quarterly report on
the agency’s investment portfolio, such report shall include the following information regarding all
securities, investments, and moneys held by the local agency:
type of investment;
issuer (bank or institution);
date of maturity;
dollar amount invested; and
current market valuation as of the date of the report.
In addition, Government Code §53646(b)(2) requires that the report state the City’s compliance
with its investment policy and Government Code §53646(b)(3) requires that it include a statement
regarding the ability of the local agency to meet its pool’s expenditure requirements over the next

The San Diego County Pool and LAIF are liquid investment pools that allow participants to earn
market-rate returns while retaining access to funds within 24 to 48 hours of a withdrawal request
with no penalty. The City’s assets managed by Chandler Asset Management may be liquidated
and withdrawn at any time. However, these investments likely do not provide the short liquidity
(i.e., quick access to funds) of the pooled money funds, and liquidation of these investments is at
the risk of loss and/or penalty to the City.

Economic Update:
“Recent economic data suggests continued growth fueled by a resilient consumer. Inflationary
trends have subsided, but some components remain sticky, and core levels remain above the
Fed’s target. The labor market reflects improved balance between supply and demand for
workers. While job creation has been robust, continuing jobless claims remain elevated. Given
the economic outlook, we expect gradual normalization of monetary policy and a steepening yield
curve.
As broadly anticipated, the Federal Open Market Committee (FOMC) reduced the Fed Funds
Rate by 25 basis points to the range of 4.25- 4.50% at the December meeting. Although the cut
was widely anticipated, market participants viewed the trajectory of rates in the SEP as ‘hawkish.’
Chair Jerome Powell reiterated previous statements indicating the economy is in a good place
and that monetary policy is well positioned. The Fed released the quarterly Summary of Economic
Projections (SEP), which now forecasts a higher central tendency of core inflation and a higher
longer run Fed Funds forecast. In the Chandler team’s view, the updated SEP reflects the
continued resiliency of the US economy and the corresponding risk of inflation taking longer to
reach the FOMC’s two percent objective in 2025.
US Treasury yields shifted higher in December and the curve steepened. The 2-year Treasury
yield increased 9 basis points to 4.24%, the 5- year Treasury rose 33 basis points to 4.38%, and
the 10-year Treasury yield surged 40 basis points to 4.57%. The spread between the 2-year and
10-year Treasury yield points on the curve increased to +33 basis points at December month-end
versus +2 basis points at November month-end. The spread between the 2-year Treasury and
10-year Treasury yield one year ago was -37 basis points. The spread between the 3-month and
10-year Treasury yield points on the curve increased to +25 basis points in December from -32
basis points in November.”1

Notes
Yield to maturity (YTM) is the estimated rate of return on a bond given its purchase price, assuming all coupon payments are made on a timely basis and reinvested at this same rate of return to the maturity date. Weighted Days to
Maturity is average time it takes for securities in a portfolio to mature, weighted in proportion to the dollar amount that is invested in the portfolio. Yields for the portfolio are aggregated based on the book value of each security.
Monthly Investment Returns are reported gross of fees.Administration fees since fiscal year 17-18 have averaged approximately 7 basis points per annum. **All Investments held during the month of August 2024 were in compliance with
the Investment Policy dated January 1,2023. The County Treasurer believes the Treasury Investment Pool contains sufficient cash flow from liquid and maturing securities, bank deposits, and incoming cash to meet the next six months of
expected expenditures.
While Safety, Liquidity, and Yield remain the Fund’s primary investment objectives, all else being equal and acting under statutory investment limitations, the County Treasurer affirms his/her commitment to the consideration of ESG
criteria in evaluating securities. Sustainalytics, a Morningstar Company, provides high-quality, analytical environmental, social and governance (ESG) research, ratings and data to institutional investors and companies. Using Sustainalytics
scoring, which is available on Bloomberg, the Pool had a weighted average MTN/CP/CD score of 20.02 as of 09/30/24, placing it in the “Medium Risk” category. Sustainalytics’ ratings categories are: negligible (0-9.99), low (10-19.99),
medium (20-29.99), high (30-39.99) and severe (40+).

Resolution to Initiate a Street Vacation of a Portion of Orange Street Cul-de-Sac West of Euclid

RECOMMENDATION:
Staff is Recommending that the City Council Once Again Initiate the Street Vacation Request,
and Adopt a Resolution Entitled, “Resolution of the City Council of the City of National City,
California, Initiating a Street Vacation of a Portion of Orange Street Cul-de-Sac West of Euclid
Avenue.”

EXPLANATION:
Previous Action
The City Council initiated this Street Vacation in October of 2022. However, more than 40 days
elapsed prior to a finding of General Plan Conformance by the Planning Commission, counter to
what is required by the City’s Street Vacation Procedures. This was due to difficulties involved with
getting an adequate property line survey. The applicant has since worked with Engineering
Department staff on procuring the survey and is once again ready to move forward.
Executive Summary
The applicant is proposing to vacate a portion of the Orange Street cul-de-sac adjacent to their
single-family home. The area is undeveloped and functions as a side yard of the property,
although it is considered right-of-way. It is unclear to the casual observer that the area is not part
of the residential property. The applicant already keeps the area clean and free of weeds.
Vacating the area would allow the applicant to fence off the area, delineating more clearly the
border between private and public property, as well as providing more security for the property.
Street Vacation
The right-of-way to be vacated is approximately 1,500 square feet in size. The area is separated
from the main Euclid Avenue corridor by a chain link fence and is at the top of an embankment
adjacent to said street. A brow ditch is located on the top of the embankment on the Euclid Avenue
side of the fence. There are overhead SDG&E facilities in the area, which would require an
easement of access in the future should the area be vacated. Otherwise, the area is not
accessible from Euclid Avenue or Orange Street (there is a barrier separating the area from the
cul-de-sac) and is ostensibly part of the applicant’s property due to them keeping the area clean.
Although the City is technically responsible for maintenance of the area, there is often confusion
over whether the area is private or public due it being immediately adjacent to a single-family

home. There have also been encampments and unauthorized access to the area in the past,
which poses a security issue. Vacating the area would also allow the property owner to improve
site drainage conditions, which are currently problematic (run-off is causing erosion and the
transportation of topsoil into the street).
If initiated, the Planning Commission would subsequently hold a hearing to consider the
conformity of the proposed vacation with the General Plan. The City Council would then hold a
public hearing to consider the Planning Commission’s determination of conformity along with
staff’s report and recommendation and any community input.

2. File the report (deny).

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA, INITIATING A STREET VACATION OF A PORTION OF ORANGE
STREET CUL-DE-SAC WEST OF EUCLID AVENUE.
WHEREAS, the City Council of the City of National City, California considered and
approved an initiation request for a Street Vacation of a portion of Orange Street cul-de-sac
west of Euclid Avenue on October 18, 2022; and
WHEREAS, pursuant to the City’s Street Vacation Procedures, more than 40 days
elapsed before a finding of General Plan Conformance could be made by the Planning
Commission, thus rendering the previous initiation null and void; and
WHEREAS, the City Council of the City of National City, California, considered an
initiation request for a Street Vacation of a portion of Orange Street cul-de-sac west of Euclid
Avenue on February 4, 2025; and
WHEREAS, the City Council considered the staff report contained in Case File No.
2022-24 SC, maintained by the City and incorporated herein by reference along with evidence
and testimony also presented; and
WHEREAS, this action is taken pursuant to all applicable procedures required by State
and City law; and
WHEREAS, City staff recommends the approval of the request to initiate a Street
Vacation.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE, AND ORDER AS FOLLOWS:

Introduction of Ordinance Amending National City Municipal Code Chapter 2.75 Adjusting
Campaign Contribution Limits as Required Every Odd-Numbered Year to Reflect Changes in the
Consumer Price Index.
RECOMMENDATION:
Introduce Ordinance Entitled, “Ordinance of the City Council of the City of National City, California,
Amending Various Sections of the National City Municipal Code Chapter 2.75 to Adjust the
Campaign Contribution Limits for Any Election Held on or after January 1, 2025.”

EXPLANATION:
National City Municipal Code Section 2.75.030 (L) requires the City Clerk to adjust the campaign
contribution limit every odd-numbered year to reflect any changes in the Consumer Price Index
(CPI) for the San Diego Metropolitan Area for the two-year period ending on December 31st of the
previous year and requires these adjustments to be rounded to the nearest five-dollars ($5) as a
cost-of-living adjustment.
Chapter 2.75 Section 2.75.030 (L)
The campaign contribution limits and contribution acceptance and solicitation limits
specified in subsections A, B, C and D of this section shall be adjusted in February of
each odd-numbered year commencing in 2023, for changes in the Consumer Price
Index (CPI) over the previous two -year period. The City Clerk shall apply the annual
percent change in the CPI for all Urban Consumers (CPI -U) for the San Diego
Metropolitan Area to determine the appropriate rate of increase or decrease.
Adjustments made pursuant to this subsection shall be rounded to the near est five
dollars.
The Annual Consumer Price Index for the San Diego Metropolitan area rose by 5.2% during
2023 and by another 2.6% in 2024, demonstrating an overall increase of 8.39 percent for the
two-year period.
The contribution limits were previously set at one -thousand one hundred thirty-five dollars
($1,135) in a calendar year for individuals (subsection A, and B), and two -thousand two hundred
and sixty-five dollars ($2,265) in a calendar year from political party committees (subsections
D, and E), political action committees and independent committees to candidates or controlled
committees.

Applying the percentage of change of the Consumer Price Index and rounding to the nearest
five dollars ($5), the City Clerk adjusted the contribution limits to $1,230 for individuals and
$2,455 for political action committees and independent committees to candidates or
controlled committees.
The City Clerk will be publishing the Notice of Campaign Contribution Limit Adjustment in the
Star News, as required, on Friday, February 7, 2025. Additionally, the Federal Voting Rights
Act, together with an agreement between the U.S. Department of Justice and the San Diego
County Registrar of Voters, requires translation of all election-related materials and notices into
covered languages predominantly spoken by 10,000 voters or more in the County. Therefore,
the City Clerk has caused the notice to be translated into and published in language -specific
newspapers as follows:

2.75.030 - Campaign Contributions—Limitations and Exclusions.
A. Contributions by individuals to candidates or controlled committees. No individual
shall make any contribution to a candidate and/or the candidate’s -controlled committee,
with respect to any single city election, which will cause the total amount contribut ed by
such individual to the candidate and the candidate’s -controlled committee, when
combined, to exceed one thousand one two hundred thirty-and thirtyfive dollars ($1,230)
in a calendar year.
B. Acceptance or solicitation by candidates or controlled committees from individuals.
No candidate or controlled committee, including the candidate's campaign treasurer,
shall solicit or accept any contribution from any individual with respect to any single city
election, which will cause the total amount contributed by such individual to the
candidate and the candidate’s -controlled committee, when combined, to exceed one
thousand one two hundred thirty- and thirty five dollars ($1,230) in a calendar year.
C. Contributions by candidates. The provisions of Subsections A and B of this section

accept any contribution from any political party committee, political action committee, or

F. Family contributions. Contributions by spouses shall be treated as separate
contributions and shall not be aggregated. Contributions by children under eighteen
years of age shall be treated as contributions attributed equally to each parent or
guardian.
G. Applicability of section to candidate and com mittees. The provisions of this section
are applicable to any contributions made to a candidate or controlled committee whether
used by such candidate or controlled committee to finance a current campaign, to pay
debts incurred in prior campaigns, or other wise.

H. Contributions by city contractors. No individual who contracts with the City of National
City, either for the rendition of personal services or for the furnishing of any materials,
supplies, or equipment to the city, or for the sale or lease of a ny land or building, to or
from the city, shall make any contribution to a city candidate or controlled committee at
any time between the commencement of negotiations for and (i) the completion of
performance of such contract or (ii) the termination of neg otiations for such contract,
whichever occurs later.
I. Contributions from city employees.
1. It is unlawful for a candidate or a candidate’s -controlled committee, to solicit, directly
or indirectly, a contribution from a city employee with knowledge tha t the person from
whom the contribution is solicited is a city employee.
2. This subsection shall not prohibit a candidate or a candidate’s -controlled committee
from soliciting contributions from city employees if the solicitation is part of a solicitatio n
made to a significant segment of the public that may include city employees, and the
solicitation does not otherwise violate the provisions of this chapter.
3. Nothing in this subsection prohibits a city employee from making a contribution to a
candidate, and nothing in this subsection prohibits a candidate from accepting a
contribution from a city employee.
4. As used in this subsection, the term "city employee" means any employee of the City
of National City (city) or any of its organizational subdivi sions, agencies, offices, boards,
or commissions.
J. Aggregation of contributions from different individuals financed, maintained, or
controlled by same individual. Contributions from different individuals, but which are
financed, maintained, or controlle d by the same individual, shall be aggregated for
purposes of the contribution limits of Subsections A and B of this section. All
contributions made by an individual whose contribution activity is financed, maintained,
or controlled by an individual, shall be deemed to be made by the same individual.
K. A contribution drawn from a checking account or credit card account held by an
individual doing business as a sole proprietorship is considered a contribution from that
individual for purposes of this subse ction, and may lawfully be received by a candidate
for elected city office. A nonmonetary contribution in the form of goods and services
donated by an individual doing business as a sole proprietorship is considered a
contribution from that individual for purposes of this subsection, and may lawfully be
received by a candidate for elective city office.
L. Adjustments for cost of living. The campaign contribution limits and contribution
acceptance and solicitation limits specified in Subsections A, B, D and E of this section
shall be adjusted in February of each odd-numbered year commencing in 2023, for
changes in the Consumer Price Index (CPI) over the previous two -year period. The city
clerk shall apply the annual percent change in the CPI for all Urban Co nsumers (CPI-U)
for the San Diego Metropolitan Area to determine the appropriate rate of increase or
decrease. Adjustments made pursuant to this subsection shall be rounded to the nearest
five dollars.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA,
AMENDING SECTION 2.75.030 OF THE NATIONAL CITY MUNICIPAL CODE CHAPTER 2.75
TO ADJUST THE CAMPAIGN CONTRIBUTION LIMIT FOR ANY ELECTION HELD ON OR
AFTER JANUARY 2025
NOW, THEREFORE, the City Council of the City of National City does ordain as follows:
Section 1. FINDINGS. The City Council of the City of National City hereby finds and
declares as follows:
WHEREAS, the City Council finds that the National City Municipal Code Chapter 2.75
Section 2.75.030(L), requires the City Clerk to adjust the campaign contribution limits every odd-
numbered year to reflect any changes in the Consumer Price Index to the San Diego Metropolitan
area; and
WHEREAS, the two-year period ending December 31 of the previous year is the period
of December 31, 2022 through December 31, 2024; and
WHEREAS, data reported by the Bureau of Labor Statistics regarding the annual changes
in the Consumer Price Index (CPI) for the San Diego Metropolitan area showed that between
2023 and 2024 the CPI for the San Diego Metropolitan area rose 5.11% and 3.12% for those
years, respectively, for an overall increase of 8.39%; and
WHEREAS, the contribution limits were previously set at one-thousand one hundred
thirty-five dollars ($1,135) in a calendar year for individuals (subsection A, and B), and two-
thousand two hundred and sixty-five dollars ($2,265) in a calendar year from political party
committees (subsections D, and E), political action committees and independent committees to
candidates or controlled committees; and
WHEREAS, applying the 8.39% increase in the CPI to the previous limits would result in
new contribution limits of one thousand two hundred and thirty dollars ($1,230) in a calendar year
for individuals (subsection A, and B), and two-thousand four hundred fifty-five dollars ($2,455) in
a calendar year from political party committees (subsections D, and E), political action committees
and independent committees to candidates or controlled committees.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY,
CALIFORNIA, HEREBY ORDAINS AS FOLLOWS:
Section 1: That the City Council hereby amends the Chapter 2.75 Section 2.75.030 to
the National City Municipal Code, to read as follows:
2.75.030 - Campaign Contributions—Limitations and Exclusions.
A. Contributions by individuals to candidates or controlled committees. No individual
shall make any contribution to a candidate and/or the candidate’s -controlled committee,
with respect to any single city election, which will cause the total amount contribut ed by
such individual to the candidate and the candidate’s -controlled committee, when
combined, to exceed one thousand two hundred and thirty dollars ($1,230) in a calendar
year.

B. Acceptance or solicitation by candidates or controlled committees from ind ividuals.
No candidate or controlled committee, including the candidate's campaign treasurer,
shall solicit or accept any contribution from any individual with respect to any single city
election, which will cause the total amount contributed by such indiv idual to the
candidate and the candidate’s -controlled committee, when combined, to exceed one
thousand two hundred and thirty dollars ($1,230) in a calendar year.
C. Contributions by candidates. The provisions of Subsections A and B of this section
shall not apply to contributions from a candidate to his or her controlled committee, nor
to the expenditure by the candidate of his or her personal funds on behalf of his or her
own candidacy.
D. Contributions by political party committees, political action comm ittees and
independent committees to candidates or controlled committees. No political party
committee, political action committee or independent committee, shall make any
contribution to a candidate and/or the candidate’s -controlled committee, with respect to
any single city election, which will cause the total amount contributed to the candidate
and the candidate’s-controlled committee, when combined, to exceed two thousand four
hundred and fifty-five dollars ($2,455) in a calendar year.
E. Acceptance or solicitation by candidates or controlled committees from political party
committees, political action committees and independent committees. No candidate or
controlled committee, including the candidate's campaign treasurer, shall solicit or
accept any contribution from any political party committee, political action committee, or
independent committee, with respect to any single city election, which will cause the
total amount accepted by such political party committee, political action committee, or
independent committee to the candidate and the candidate's controlled committee, when
combined, to exceed two thousand four hundred and fifty-five dollars ($2,455) in a
calendar year.
F. Family contributions. Contributions by spouses shall be treated as separat e
contributions and shall not be aggregated. Contributions by children under eighteen
years of age shall be treated as contributions attributed equally to each parent or
guardian.
G. Applicability of section to candidate and committees. The provisions of t his section
are applicable to any contributions made to a candidate or controlled committee whether
used by such candidate or controlled committee to finance a current campaign, to pay
debts incurred in prior campaigns, or otherwise.
H. Contributions by city contractors. No individual who contracts with the City of
National City, either for the rendition of personal services or for the furnishing of any
materials, supplies, or equipment to the city, or for the sale or lease of any land or
building, to or from the city, shall make any contribution to a city candidate or controlled
committee at any time between the commencement of negotiations for and (i) the
completion of performance of such contract or (ii) the termination of negotiations for such
contract, whichever occurs later.

I. Contributions from city employees.
1. It is unlawful for a candidate or a candidate’s -controlled committee, to solicit,
directly or indirectly, a contribution from a city employee with knowledge that
the person from whom the contribution is solicited is a city employee.
2. This subsection shall not prohibit a candidate or a candidate’s -controlled
committee from soliciting contributions from city employees if the solicitation
is part of a solicitation made to a significant segme nt of the public that may
include city employees, and the solicitation does not otherwise violate the
provisions of this chapter.
3. Nothing in this subsection prohibits a city employee from making a contribution
to a candidate, and nothing in this subsec tion prohibits a candidate from
accepting a contribution from a city employee.
4. As used in this subsection, the term "city employee" means any employee of
the City of National City (city) or any of its organizational subdivisions,
agencies, offices, boards, or commissions.
J. Aggregation of contributions from different individuals financed, maintained, or
controlled by same individual. Contributions from different individuals, but which are
financed, maintained, or controlled by the same individual, shall be aggregated for
purposes of the contribution limits of Subsections A and B of this section. All
contributions made by an individual whose contribution activity is financed, maintained,
or controlled by an individual, shall be deemed to be made by t he same individual.
K. A contribution drawn from a checking account or credit card account held by an
individual doing business as a sole proprietorship is considered a contribution from that
individual for purposes of this subsection, and may lawfully be received by a candidate
for elected city office. A nonmonetary contribution in the form of goods and services
donated by an individual doing business as a sole proprietorship is considered a
contribution from that individual for purposes of this subsection , and may lawfully be
received by a candidate for elective city office.
L. Adjustments for cost of living. The campaign contribution limits and contribution
acceptance and solicitation limits specified in Subsections A, B, D and E of this section
shall be adjusted in February of each odd-numbered year commencing in 2023, for
changes in the Consumer Price Index (CPI) over the previous two -year period. The city
clerk shall apply the annual percent change in the CPI for all Urban Consumers (CPI -U)
for the San Diego Metropolitan Area to determine the appropriate rate of increase or
decrease. Adjustments made pursuant to this subsection shall be rounded to the nearest
five dollars.
Section 2: This Ordinance shall take effect and be enforced thirty (30) days following
its adoption by City Council.
Section 3: The City Clerk shall certify to the adoption of this Ordinance and shall
publish in accordance with the law.

Public Hearing and Introduction of an Ordinance of the City Council of the City of National City,
California, Establishing the Compensation of the Mayor and City Councilmembers.
RECOMMENDATION:
Hold the Public Hearing, Receive Public Comment, and Introduce an Ordinance of the City
Council of the City of National City, California, Establishing the Compensation of the Mayor and
City Council.

EXPLANATION:
As an election has occurred and resulted in elected officials beginning new terms of office, the
City Council at its January 21st meeting discussed changes to their compensation. In accordance
with Government Code section 36516.5 changes to compensation must coincide with elections
at which members begin a new term in office. Changes made to compensation outside this
window will not be effective until the following term in office (two years).
The last salary adjustment for the Mayor and City Council occurred on March 7, 2023. The last
salary adjustment set the base salary of the City Council at $1,546.71 per month and the base
salary of the Mayor at $5,211.95 per month, as codified in Ordinance No. 2023-2517.
Compensation increases cannot exceed 5% per calendar year from the date of the last increase
in compensation, pursuant to Government Code Section 36516(a)(4). An elected Mayor, pursuant
to Government Code Section 36516.1, may be provided with additional compensation to that
which he/she receives as a councilmember. There are no limitations imposed on the amount of
the Mayor’s compensation.
At the January 21, 2025, Regular City Council Meeting, the City Council, in a 4 to 1 vote1, directed
staff to prepare an ordinance increasing their compensation by 10%. The 10% increase would
establish the City Council compensation to $1,701.38 per month, and the Mayor’s compensation
to $5,733.15 per month.
FINANCIAL STATEMENT:
An increase to the compensation for the Mayor and City Council of the maximum 10% allowable
by law will add approximately $13,678.55 of new expenditures annually to the General Fund.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA,
ESTABLISHING THE COMPENSATION OF THE MAYOR AND CITY COUNCIL.
NOW, THEREFORE, the City Council of the City of National City, California, hereby
ordains as follows:
Section 1. That the base monthly compensation for the City Council is established at
$1,701.38 per month, pursuant to the provisions of sections 36516 and 36516.5 of the California
Government Code.
Section 2. That the base monthly compensation for the Mayor is established at $5,211.95
per month, pursuant to the provisions of section 36516.1 of the California Government Code.
Section 3. That the benefits for the Mayor and City Council shall remain as previously
established, except for elimination of the $350 City Council expense allowance, to the extent
consistent with Government Code sections 36516, 36516.5, 53200 et seq. and any other
applicable legal requirements.
Section 4. This Ordinance shall take effect and be in force thirty (30) days from the date
of its passage, and before the expiration of fifteen (15) days after its passage, it or a summary of
it, shall be published once, with the names of the members of the City Council voting for and
against the same in the Star News, a newspaper of general circulation published in the County of
San Diego, California.
Section 5. The City Clerk shall certify to the adoption of this Ordinance and shall publish
in accordance with the law.
