STAFF REPORT BY ASSISTANT PLANNER PARIS. CASE FILE NO. CUP-2000-22. 2 August 21, 2000 COMMISSIONERS DISCUSSED PARKING AND POSSIBLE IMPACTS THIS USE WILL HAVE ON THE CENTER. CONCERN WAS EXPRESS THAT THERE IS ONLY ONE HANDICAP PARKING SPACE, 7 TO 18 EMPLOYEES, AND 5 VANS. MARINA MURASHOVA, APPLICANT, STATED THAT PARKING IS NOT ANTICIPATED TO BE A PROBLEM. SHE STATED THAT SOME EMPLOYEES ONLY COME AT CERTAIN TIMES, LIKE THE COUNSELOR WHO IS THERE ONLY 2 HOURS A WEEK. SHE STATED THE VANS HOLD UP TO 20 PEOPLE, THEY MIGHT ONLY USE 3 VANS. COMMISSIONER GODSHALK MENTIONED THAT THE LANDLORD MIGHT BE ASKED TO RESERVE SPACES FOR THE VANS. COMMISSIONER DETZER ASKED WHERE THE VANS WOULD BE PARKED AFTER HOURS. MS. MURASHOVA RESPONDED THAT THE VANS WOULD BE PARKED ON -SITE WITH INSTALLED ALARMS. NENITA ROSALES, 1317 D AVENUE #412, (KIMBALL TOWERS) SPOKE IN SUPORT OF THIS PROGRAM. SHE STATED THAT NUMEROUS SENIORS WOULD BENEFIT FROM THIS PROGRAM. MOTION BY GODSHALK, 2ND BY BACA TO CLOSE THE PUBLIC HEARING AND APPROVE CUP-2000-22 BASED ON REQUIRED FINDINGS FOR APPROVAL AND SUBJECT TO CONDITIONS OF APPROVAL, WITH MODIFICATION TO CONDITION NO. 8 THAT THE PREMISES SHALL BE LICENSED BY THE STATE OF CALIFORNIA PRIOR TO CONDUCTING BUSINESS, AND WITH ADDED CONDITIONS OF APPROVAL THAT AN AREA ON THE EAST SIDE OF THE SHOPPING CENTER SHALL BE RESERVED FOR PARKING OF THE CENTER'S VANS, AND THAT TWO ADA HANDICAP SPACES BE PROVIDED IN FRONT OF THE FACILITY. CASE FILE AVENUE, EXPRESSED CONCERN ABOUT NO. 5-2000-2. TRAFFIC, POSSIBLE SLOPE EROSION, NOISE, AND LACK OF LANDSCAPING. THEY ALSO ASKED WHAT WOULD HAPPEN TO THE EXISTING TREES ON THE SITE. ASSISTANT CIVIL ENGINEER LONG ANSWERED QUESTIONS ABOUT INSTALLATION OF RETAINING WALLS AND A BROW DITCH TO DIVERT RUN- OFF AND PREVENT EROSION. STAFF RESPONDED TO QUESTIONS AND CONCERNS ABOUT LANDSCAPING AND PRESERVATION OF SOME OF THE TREES ON THE SITE. RICHARD SHERMAN, 1236 E. 16TH STREET, EXPRESSED CONCERNS ABOUT TRAFFIC ISSUES IN THE AREA AND STATED ADDING HOMES WOULD INCREASE TRAFFIC. HE ALSO STATED THAT NATURAL LIGHTING WOULD BE BLOCKED BY CONSTRUCTION OF THESE HOMES. TERESA HODGE, 1624 I AVENUE TALKED ABOUT LETTER SHE RECEIVED FROM THE CODE CONFORMANCE OFFICER REGARDING PAVING OF A SETBACK AREA. DIRECTOR POST STATED THAT THE PROPER TIME TO BRING UP THIS ISSUE IS UNDER PUBLIC ORAL COMMUNICATIONS. FRANK ARRINGTON, 830 GOLDEN PARK AVENUE, SAN DIEGO, PROPERTY OWNER, SPOKE IN SUPPORT OF THE APPLICATION AND ANSWERED A COMMISSIONER'S QUESTION REGARDING PRICE OF HOMES. HE STATED THE PRICE WILL BE APPROXIMATELY $190,000 FOR THE SMALLER HOME, AND $240,000 FOR THE LARGEST HOME. 4 August 21, 2000 HECTOR PADILLA, WORKING FOR PROPERTY OWNER, STATED THAT THE TREES ON LOTS 1 AND 2 WILL REMAIN. COMMISSIONER DETZER STATED THAT HE WOULD LIKE TO SEE DESIGN ENHANCEMENTS SUCH AS WINDOW DETAILS BE ADDED TO THE HOMES. IT WAS ALSO SUGGESTED THAT OTHER TYPES OF TREES BE USED INSTEAD OF MAGNOLIAS. COMMISSIONER GODSHALK ASKED IF A TOT LOT OR OTHER PARK AMENITIES WOULD BE PROVIDED. DIRECTOR POST STATED THE SUBDIVISION IS TO SMALL TO REQUIRE PARK AMENITIES; RATHER, PARK IN LIEU FEES WOULD BE REQUIRED. COMMISSIONER GODSHALK STATED HE WOULD LIKE TO HAVE INFORMATION ABOUT PARK IN LIEU FEES. COMMISSIONER UNGAB DISCUSSED TRAFFIC ISSUES AND ASKED IF INSTALLATION OF A TRAFFIC SIGNAL HAS BEEN CONSIDERED AT 16TH STREET AND L AVENUE. DIRECTOR POST STATED THAT HE IS NOT AWARE OF A CIP PROJECT TO ADD A SIGNAL AT THIS INTERSECTION. COMMISSIONER VALDERRAMA STATED THAT THERE IS NO CLOSET SPACE INCLUDED IN THE MASTER BEDROOM ON THE PLANS. MR. ARRINGTON, PROPERTY OWNER, STATED THAT THIS IS AN OVERSIGHT, AND WILL BE CORERCTED. DAVID BABIHIRZ, 4667 POINT LOMA AVENUE, PROJECT ENGINEER STATED THAT THEY WILL BE COMPLETING M AVENUE BETWEEN 16TH AND 14TH STREET, AND WILL ADDRESS THE DRAINAGE FROM THE L AVENUE PROPERTIES. RICHARD SHERMAN, 1236 E. 16TH STREET ASKED FOR CLARIFICATION AS TO WHERE THE HOMES WILL BE BUILT AND August 21, 2000 AGAIN EXPRESSED CONCERN ABOUT TRAFFIC AND THE DANGEROUS SITUATION WITH CARS TRAVELING DOWN THE HILL ON 16TH STREET. COMMISSIONER DETZER SUGGESTED ADDING A CONDITION OF APPROVAL THAT FINAL DESIGN PLANS BE BROUGHT BACK FOR COMMISSION REVIEW. STAFF STATED THAT THE PLANS CAN BE REVIEWED UNDER THE APPROVAL OF PLANS PROCESS AND WOULD TAKE APPROXIMATELY 2 ADDITIONAL WEEKS TO PROCESS. THE PROPERTY OWNER AGREED TO ADD THIS CONDITION. MOTION BY DETZER, 2ND BY GODSHALK TO RECOMMEND THE CITY COUNCIL APPROVE 5-2000-2, BASED ON REQUIRED FINDINGS AND SUBJECT TO CONDITIONS OF APPROVAL, WITH DELETION OF THE LAST TWO SENTENCES ON CONDITION NO. 11 AND ADDING A CONDITION REQUIRING FINAL DESIGN REVIEW PLANS TO BE REVIEWED BY THE COMMISSION. PUBLIC HEARING — CONDITIONAL USE RECEIVED FROM THE APPLICANT PERMIT FOR A MONOPALM WIRELESS REQUESTING A CONTINUANCE TO THE COMMUNICATIONS FACILITY AT A MEETING OF OCTOBER 16, 2000 TO WORK CHURCH AT 2701 E. 8TH STREET. COMMISSIONER GODSHALK STATED THAT HE WOULD LIKE THE MOTION TO INCLUDE THAT A LETTER BE SENT TO ALL CARRIERS AND PROPERTY OWNERS REMINDING THEM OF CONDITIONS OF APPROVAL REQUIRING NO OBJECTION TO CO -LOCATING FACILITIES. MAKER OF MOTION AGREES. ROLL CALL: AYES — UNANIMOUS. August 21, 2000 8. CHAIRMAN VALDERRAMA REVIEWED ALTERNATIVE ACTIONS WITH STAFF. RITA HEUSS, 4TH STREET, NATIONAL CITY, PROVIDED A HANDOUT SHOWING THIS PROPERTY FOR SALE AS FOUR UNITS. SHE STATED THAT THIS OWNER GOT CAUGHT AND THE CITY SHOULD NOT REWARD THEM AND LEGALIZE IT. THE MOST ALLOWED SHOULD BE THREE UNITS. GEORGIA GUARANO, 410 HARBISON AVENUE, STATED THAT SHE FEELS THERE SHOULD BE PENALITIES FOR THOSE WHO ILLEGALLY CONVERT GARAGES INTO UNITS. SHE ALSO STATED THAT THIS PROPETY DOES NOT HAVE A RENTAL PROPERTY PERMIT. KATHY SUTCH, PROPERTY OWNER STATED THAT SHE PURCHASED THIS PROPERTY IN MAY, 1998 AND IT WAS REPRESENTED TO HER AS FOUR UNITS. SHE THEN FOUND OUT A YEAR LATER THAT THE UNITS ARE NOT LEGAL AND SHE IS TRYING TO REMEDY THE SITUATION. SHE WOULD LIKE TO KEEP THE PROPERTY WITH FOUR UNITS, AS THE CODE ALLOWS HER SIX. SHE STATED THAT SHE HAS DONE ELECTRICAL AND PLUMBING REPAIRS, REPLACED SCREENS AND CARPETING, AND WORKED ON THE FENCES. TIM JONES, 294 SHASTA STREET, CHULA VISTA, ARCHITECT STATED THAT THE PROPERTY OWNER WAS DECEIVED WHEN SHE PURCHASED THE PROPERTY AND IS NOW TRYING TO LEGALIZE THE UNITS. HE FURTHER STATED THAT THE STUDIO UNIT HAS A PERMIT AND IT IS NOW CONSIDERED LAWFUL NON- CONFORMING. THE PROPERTY OWNER DOES NOT INTEND TO PASS ALONG THE PROBLEMS TO ANOTHER BUYER, BUT TO LEGALIZE THE UNITS. COMMISSIONER MARTINELLI ASKED HOW MUCH RENT IS BEING RECEIVED FROM THESE UNITS. 8. PUBLIC HEARING — PLANNED DEVELOPMENT PERMIT TO LEGALIZE TWO EXISTING DWELLING UNITS AT 1834 K AVENUE. APPLICANT: TIM P. JONES. STAFF REPORT BY ASSOCIATE PLANNER CAIN. CASE FILE NO. PD-1999-2. August 21, 2000 KATHY SUTCH, PROPERTY OWNER STATED THAT SHE RECEIVES $775 FOR THE FRONT OF THE HOUSE, $800 FOR THE REAR UNIT, $475 FOR THE STUDIO UNIT, AND $500 FOR THE FOURTH UNIT. THIS INCLUDES UTILITIES. COMMISSIONER PARRA ASKED IF THE COMMISSION APPROVES LEAVING ALL FOUR UNITS HERE IF CONDITION NO. 14 SHOULD BE DELETED. STAFF STATED THAT IF COMMISSION ACTION IS TO KEEP ALL FOUR UNITS, THEN CONDITION NO. 14 SHOULD BE DELETED. COMMISSIONER UNGAB STATED THAT THIS IS A VIOLATION SITUATION AND CONDITIONS DO NOT ADDRESS TIMEFRAMES FOR CORRECTING THE SITUATION. DIRECTOR POST SUGGESTED THAT THE ILLEGAL UNITS BE VACATED WITHIN THIRTY DAYS AND NOT RENTED OUT UNTIL CONDITIONS OF APPROVAL ARE MET. TIM JONES, ARCHITECT, STATED THAT HE FEELS THEY CAN START WORK AND SHOULD HAVE IT COMPLETD WITHIN ONE YEAR. COMMISSIONER GODSHALK STATED THAT HE FEELS HE NEEDS MORE INFORMATION BEFORE HE CAN REACH A DECISION. HE STATED THAT MAYBE THE HOUSE SHOULD BE CONVERTED TO ONE UNIT AND WOULD LIKE TO REVIEW ALL ALTERNATIVES. HE WOULD LIKE THE ITEM CONTINUED AND A SITE VISIT ARRANGED. COMMISSIONER MARTINELLI STATED THAT SHE ALSO WOULD LIKE TO SEE THE PROPERTY AND THE UNITS. August 21, 2000 MOTION BY DETZER, 2ID BY BACA, TO APPROVE PLANNED DEVELOPMENT PERMIT 1999-2, AS PROPOSED BY STAFF FOR THREE UNITS, SUBJECT TO FINDINGS AND CONDITIONS OF APPROVAL, WITH ADDED CONDITON THAT THE ILLEGAL UNITS SHOULD BE VACATED WITHIN THIRTY DAYS AND THE ONE UNIT CAN AGAIN BE RENTED OUT UPON COMPLETION OF CONDITIONS OF APPROVAL. DISCUSSION ON MOTION: KATHY SUTCH, PROPERTY OWNER, ASKED COMMISSION, WHICH UNITS WERE ALLOWED TO STAY. COMMISSIONERS CLARIFIED THAT THE HOUSE COULD REMAIN AS A DUPLEX, AND THE LAWFUL NONCONFORMING STUDIO OVER THE GARAGE IS ALSO ALLOWED TO STAY. THE CONVERTED GARAGE WILL NEED TO BE VACATED AND CONVERTED BACK TO A GARAGE. ONE PORTION OF THE HOUSE WILL NEED TO BE VACATED AND A BUILDING PERMIT PULLED BEFORE THE HOUSE CAN AGAIN BE RENTED OUT AS A DUPLEX. COMMISSIONERS ASKED THAT ENGINEERING REVIEW CONDITION NO. 5 REQUIRING ALLEY IMPROVEMENTS AND DETERMINE IF IT IS STILL NECESSARY. TIM JONES ASKED IF MAKING THE CONVERTED GARAGE AND STUDIO INTO A TOWNHOME IS A POSSIBILITY. COMMISSIONER DETZER STATED THAT HE IS NOT IN FAVOR OF THAT OPTION. COMMISSIONER GODSHALK STATED THAT HE IS NOT IN FAVOR OF THE MOTION AND WOULD LIKE TO LOOK AT ALL POSSIBLE ALTERNATIVES. August 21, 2000 ROLL CALL: AYES — UNGAB, VALDERRAMA, BACA, MARTINELLI, DETZER. DIRECTOR POST MENTIONED ITEMS PROVIDED TO COMMISSIONERS IN THE FRONT OF THEIR BOOKS: UPDATES ON RECENT REFERRALS, UPCOMING CASES, MONTHLY CODE CONFORMANCE REPORT, AND AN ARTICLE ABOUT YARD DECORATIONS. COMMISSIONER MARTINELLI REPORTED ITEMS ON THE ROOF AT 1420 E. 6Ta STREET THAT ARE UNSIGHTLY, AND REPORTED THE KRAGEN SITE ON HIGHLAND AVENUE HAS AN ACCUMULATION OF TRASH AND LITTER. DIRECTOR POST STATED THAT STAFF WILL HAVE CODE CONFORMANCE CHECK THE TWO SITES. COMMISSIONER BACA REPORTED GRAFFITI AT PALM AVENUE AND 22ND STREET. DIRECTOR POST STATED THAT THIS WOULD BE REFERRED TO THE BUILDING AND SAFETY DEPARTMENT. COMMISSIONER GODSHALK THANKED THE CITY FOR ALLOWING HIM TO ATTEND THE LEAGUE OF CALIFORNIA CITIES CONFERENCE AND MENTIONED SEVERAL CLASSES HE HAD ATTENDED AND DISTRIBUTED BROCHURES AND HANDOUTS HE RECEIVED AT THE CONFERENCE. NO REPORT. TERESA HODGE, 1624 I AVENUE, STATED SHE RECEIVED A LETTER FROM THE CODE CONFORMANCE OFFICER REGARDING A CONCRETE PARKING AREA THAT WAS INSTALLED IN THE FRONT YARD OF HER FOUR PLEX. SENIOR ASSISTANT CITY ATTORNEY PLANNING DIRECTOR COMMISSIONERS CHAIRMAN ORAL COMMUNICATIONS (3 MINUTE TIME LIMIT). NOTE: Under State law, items requiring Commission action must be brought back on a subsequent agenda unless they are of a demonstrated emergency or urgent nature. 10 August 21, 2000 CHAIRMAN VALDERRAMA STATED THAT THERE IS NO ACTION THE COMMISSION CAN TAKE. HE SUGGESTED THAT SHE MEET WITH PLANNING STAFF TO DISCUSS THIS ISSUE. ONE OPTION IS TO TRY TO OBTAIN A VARIANCE, BUT IT WOULD COST MORE THAN REMOVING THE CONCRETE AND LANDSCAPING IT. 8:55 P.M.
