A RESOLUTION OF THE PLANNING COMMISSION OF THE CITY 3 May 21, 2001 OF NATIONAL CITY, CALIFORNIA, DENYING A CONDITIONAL USE PERMIT APPLICATION FOR THE SALE OF BEER AND WINE IN AN EXISTING MARKET AT 431 N. HIGHLAND AVENUE. APPLICANT: SAMIR SOMO. CASE FILE NO. CUP-2001-5. CONSISTENCY REVIEW 5. COMMISSIONER GODSHALK ASKED WHAT THE PROJECT “INSTALL SPEED DRIVES/MOTORS AT CIVIC CENTER” WAS AND HOW IT IS CONSISTENT WITH THE GENERAL PLAN. ASSOCIATE CIVIL ENGINEER LONG EXPLAINED THAT THE PROGRAM IS FOR INSTALLATION OF DRIVES AND MOTORS ON AIR CONDITIONING EQUIPMENT FOR ENERGY CONSERVATION AT THE CIVIC CENTER. DIRECTOR POST STATED THE PROGRAM CARRIES OUT ENERGY CONSERVATION POLICIES IN THE GENERAL PLAN. 5. REVIEW OF CITY’S F.Y. 2001-2002 CAPITAL IMPROVEMENT PROGRAM FOR CONSISTENCY WITH THE GENERAL PLAN. COMMISSIONER GODSHALK ASKED IF THERE HAS BEEN ANY DISCUSSION OF UPGRADING THE COUNCIL CHAMBERS TO ADD AUDIO VISUAL EQUIPMENT. DIRECTOR POST STATED THAT IT HAS BEEN DISCUSSED AND IS PROPOSED FOR NEXT FISCAL YEAR. COMMISSIONER DETZER ASKED ABOUT THE MOBILE DATA COMPUTING PROJECT. ASSOCIATE CIVIL ENGINEER LONG STATED THAT THE PROGRAM IS FOR THE POLICE DEPARTMENT AND RELATES TO THEIR LAPTOP COMPUTERS. COMMISSIONERS DISCUSSED OTHER TECHNOLOGY RELATED PROJECTS. COMMISSIONERS ASKED ABOUT PARADISE CREEK PARK PROJECT. COMMISSIONER GODSHALK STATED THAT THIS IS THE FIRST TIME IT IS LISTED IN THE CIP BUDGET AND HAS A BUDGETED AMOUNT OF $700,000 FROM THE COASTAL CONSERVANCY. 4 May 21, 2001 MOTION BY VALDERRAMA, 2ND BY BACA, TO FIND THAT THE PROPOSED 2001-02 CAPITAL IMPROVEMENT PROGRAM IS CONSISTENT WITH THE NATIONAL CITY GENERAL PLAN. MOTION CARRIED BY THE FOLLOWING VOTE: AYES: VALDERRAMA, GODSHALK, UNGAB, BACA, MARTINELLI, DETZER. ABSENT: PARRA. CONTINUED PUBLIC HEARING 6. STAFF STATED THAT A CONDITION OF APPROVAL HAS BEEN ADDED REQUIRING A DIFFERENT TREE SPECIES BE PLANTED IN LIEU OF THE PROPOSED EUCALYPTUS TREES. ALSO, THE APPLICANT HAS INFORMED STAFF THAT THEY WOULD LIKE TO HAVE THE WALLS OF THE PROPOSED BUILDING FIVE FEET TALLER. FURTHER, THE FENCE ALONG BAY MARINA DRIVE IS TO BE REMOVED TO ALLOW PROPOSED LANDSCAPING TO PROPERLY SCREEN THE BUILDING. A CONDITION SHOULD BE ADDED TO REQUIRE THAT THE NORTH SECTION OF THE CHAIN LINK FENCE BE REMOVED, IF APPROVED BY THE PROPERTY OWNER. ABEL PARRA, 845 E. 8TH STREET, NATIONAL CITY, REPRESENTING KLEEN BLAST ABRASIVES, SPOKE IN SUPPORT OF THE APPLICATION. HE MENTIONED INFORMATION PROVIDED WHICH COMMISSIONERS REQUESTED ON THE BUCKET ELEVATOR, MATERIAL SAFETY DATA SHEET, MATERIAL SAMPLE AND PHOTOS OF THEIR SITE IN WASHINGTON STATE. HE REFERRED TO THE HANDOUT DISTRIBUTED, WHICH SHOWS SAMPLE OF STAMPED CONCRETE PROPOSED TO BE USED AND THE DRAWING OF THE BUILDING WITH FIVE FEET ADDED TO THE HEIGHT. 6. CONTINUED PUBLIC HEARING – COASTAL DEVELOPMENT PERMIT APPLICATION FOR A SAND BLAST MATERIALS STORAGE AND DISTRIBUTION FACILITY ON THE SOUTH SIDE OF BAY MARINA DRIVE APPROXIMATELY 335 FEET WEST OF HARRISON AVENUE/BAY MARINA WAY. APPLICANT: ABEL PARRA, KLEEN BLAST ABRASIVES. STAFF REPORT BY PLANNING TECHNICIAN HOSKINSON. CASE FILE NO. CDP-2001-1. 5 May 21, 2001 TIM SPURGEON, 2600 OLD CROW CANYON ROAD, SUITE 200, SAN RAMON, KLEEN BLAST ABRASIVES, ANSWERED COMMISSIONERS QUESTIONS CONCERNING AIR RESOURCES PERMITS, CONFIRMED THAT PARTS AND SUPPLIES WOULD NOT BE SOLD AT THIS SITE AND STATED THAT A SERVICE THEY PROVIDE IS NON-HAZARDOUS MATERIAL RETURNS WHICH THEY HAVE NOT YET DETERMINED IF IT WILL OCCUR AT THIS SITE. COMMISSIONERS DISCUSSED PORTABLE RESTROOMS AND OFFICE THAT WERE PROPOSED AT THE SITE. STAFF CLARIFIED THAT NO OFFICE OR RESTROOMS ARE NOW PROPOSED. MR. SPURGEON EXPLAINED THAT THERE ARE USUALLY NO CUSTOMERS AT THE SITE AND ONLY A FEW EMPLOYEES. MR. PARRA EXPLAINED THAT ONCE THIS APPROVAL IS RECEIVED THEY WOULD COME IN WITH TENANT IMPROVEMENT PLANS TO CONSTRUCT RESTROOMS AND AN OFFICE. TEMPORARY RESTROOM FACILITIES WILL INITIALLY BE PLACED ON THE SITE. COMMISSIONER MARTINELLI CONFIRMED WITH THE CDC EXECUTIVE DIRECTOR DESROCHERS THAT THEY ARE SATISFIED WITH THE PROPOSAL. EXECUTIVE CDC DIRECTOR DESROCHERS STATED THAT MR. PARRA DISCUSSED THE PROPOSAL WITH ERIC CROCKETT OF HIS STAFF AND PREVIOUS CONCERNS REGARDING NOISE, DUST, AND TRAFFIC HAVE BEEN ADDRESSED. THEIR PREVIOUS COMMENTS ARE WITHDRAWN. LANDSCAPING MODIFICATIONS WILL BE NEEDED BUT CDC HAS BEEN REASSURED ABOUT THE PROJECT AND WOULD LIKE TO SEE IT MOVE FORWARD. HE FURTHER STATED HE WOULD LIKE TO SEE PERMANENT FACILITIES HERE. MR. DESROCHERS ALSO STATED THEY 6 May 21, 2001 ARE WORKING WITH THE PORT DISTRICT TO REDIRECT TRUCK TRAFFIC DOWN TIDELANDS AVENUE TO I-5 AND AVOID BAY MARINA WAY. COMMISSIONER VALDERRAMA ASKED FOR TIMELINE FOR INSTALLATION OF RESTROOM FACILITIES. MR. PARRA STATED THAT THEY WOULD COME IN WITHIN THREE MONTHS AFTER THE BUILDING IS CONSTRUCTED TO SUBMIT PLANS FOR TENANT IMPROVEMENTS FOR OFFICE AND RESTROOM FACILITIES. RESTROOMS WILL BE CONSTRUCTED WITHIN ONE YEAR. DIRECTOR POST STATED THAT IT IS UNUSUAL TO HAVE RESTROOMS DELAYED FOR ONE YEAR. HE SUGGESTED ADDING A CONDITION THAT THE RESTROOMS AND OFFICE SPACE BE INCORPORATED IN THE OVERALL BUILDING PERMIT FOR THE PROJECT AND THEY BE DONE UP FRONT WITH THE INITIAL CONSTRUCTION. TIM SPURGEON STATED THEY ARE ON A TIGHT TIMELINE AND INTEND TO BEGIN CONSTRUCTION AS SOON AS THEY CAN. HE STATED THERE ARE POTENTIAL WATER AND SEWER HOOKUP PROBLEMS. CHAIRMAN UNGAB ASKED HOW LONG THE LEASE IS FOR. MR. SPURGEON STATED THAT THEY WOULD HAVE A ONE-YEAR LEASE FROM THE RAILROAD COMPANY. COMMISSIONERS DISCUSSED HOURS OF OPERATION AND NUMBER OF TRUCK TRIPS PER DAY. CHAIRMAN UNGAB CONFIRMED WITH MR. DESROCHERS THAT THIS PROJECT DOES NOT CONFLICT WITH MARINA DEVELOPMENT. 7 May 21, 2001 MR. DESROCHERS CONFIRMED THAT IT DOES NOT. HE STATED IT IS IN THE INDUSTRIAL AREA AND WITH WELL MAINTAINED LANDSCAPING IS AN APPROPRIATE USE. COMMISSIONERS DISCUSSED IF ENOUGH ON-SITE PARKING IS PROVIDED, IF CITY STREETS WILL BE USED FOR QUEING AND WHAT TYPE OF OTHER STORAGE TYPE USES WOULD BE ALLOWED IF THIS USE NO LONGER OPERATES HERE. DIRECTOR POST STATED THAT THE PROPERTY OWNER COULD LEASE THIS BUILDING OUT TO ANOTHER ALLOWED USE. THIS APPLICATION IS FOR DEVELOPMENT OF THE PROPERTY. COMMISSIONERS ASKED WHY THE BUILDING HEIGHT IS BEING RAISED BY FIVE FEET. MR. PARRA STATED THAT HE WAS UNFAMILIAR WITH THE OPERATIONS AND DID NOT DRAW THE PLANS CORRECTLY. THE EQUIPMENT COULD NOT BE STORED INSIDE UNLESS THE BUILDING WERE TALLER. COMMISSIONERS SUGGESTED ADDING A CONDITION THAT THE APPLICANT WOULD SUBMIT BUILDING PLANS WITHIN NINETY DAYS AND HAVE ONE YEAR TO COMPLETE THE RESTROOMS. DIRECTOR POST STATED THAT IT WOULD BE A CHALLENGE TO ENFORCE THIS CONDITION. MOTION BY VALDERRAMA, 2ND BY MARTINELLI TO CLOSE THE PUBLIC HEARING AND APPROVE COASTAL DEVELOPMENT PERMIT WITH ADDED CONDITION TO REQUIRE THAT BUILDING PERMITS BE SUBMITTED FOR WITHIN NINETY-DAYS, AND PERMANENT FACILITIES CONSTRUCTION WITHIN ONE YEAR. COMMISSIONER DETZER STATED HE FELT WE SHOULD BE MORE STRIGENT AND REQUIRE PERMANENT RESTROOM FACILITIES BE BUILT WITH THE INITIAL DEVELOPMENT AND NOT 8 May 21, 2001 PLACE STAFF IN A COMPROMISING POSITION TO CHECK TO SEE IF RESTROOMS HAVE BEEN BUILT. HE ALSO STATED THAT A CONDITION NEEDS TO BE ADDED CONCERNING REMOVAL OF THE NORTH SECTION OF THE CHAIN LINK FENCE IF APPROVED BY THE PROPERTY OWNER AS SUGGESTED BY STAFF. THE MAKER AND SECOND OF THE MOTION AGREED AND AMENDED THE MOTION TO ADD CONDITION THAT BATHROOM FACILITIES BE INCLUDED IN THE ORIGINAL BUILDING PERMIT SUBMITTAL. COMMISSIONER GODSHALK STATED THAT HE IS NOT HAPPY WITH THE PROPOSAL SINCE IN THE FUTURE THIS FACILITY COULD BE USED FOR A NUMBER OF STORAGE TYPE USES, INCLUDING THE STORAGE OF HAZAROUS MATERIALS. THIS PROPERTY IS MANAGED BY THE RAILROAD AND THEY ONLY ALLOW YEAR-TO-YEAR LEASES. NO RAILROAD REPRESENTATION IS PRESENT TO CONFIRM THAT THIS USE WILL BE HERE FOR MORE THAN ONE YEAR. COMMISSIONERS DISCUSSED POSSIBLE CHANGE IN TENANTS IN THE FUTURE, POSSIBLE USE FOR STORAGE OF HAZARDOUS MATERIALS AND THE NEED TO PROHIBIT USES OTHER THAN SAND BLAST MATERIAL STORAGE. MOTION CARRIED BY THE FOLLOWING VOTE: AYES: VALDERRAMA, UNGAB, BACA, MARTINELLI. NAYS: GODSHALK, DETZER. ABSENT: PARRA. 9 May 21, 2001 PUBLIC HEARING 7. COMMISSIONERS DISCUSSED THE PROPOSED AMENDMENT. THEY ASKED WHAT HAPPENS IF THE PROPERTY OWNER HAS A PROPOSED OR APPROVED DISCRETIONARY PERMIT ON THE PROPERTY IN QUESTION AND IT IS CONTRARY TO THE CDC PROPOSAL; AND WHAT IS THE DOWNSIDE TO PROCESSING AN APPLICATION PER EXSTING CODE PROVISIONS. THEY ALSO ASKED WHAT HAPPENS IF THE CITY DOES NOT PREVAIL IN EMINENT DOMAIN. CDC DIRECTOR DESROCHERS STATED THAT THE DOWNSIDE IS AT LEAST A TWO-MONTH DELAY, BUT THAT WOULD DIFFER WITH EACH PROJECT. SENIOR ASSISTANT CITY ATTORNEY HRADECKY STATED THAT IN CASES WHERE A DISCRETIONARY PERMIT EXISTS, THE CITY WOULD EXERCISE ITS USE OF EMINENT DOMAIN. MOTION BY BACA, 2ND BY VALDERRAMA, TO CLOSE THE PUBLIC HEARING AND RECOMMEND THAT THE CITY COUNCIL APPROVE THE DRAFT AMENDMENT, BASED ON REQUIRED FINDING. MOTION CARRIED BY THE FOLLOWING VOTE: AYES: VALDERRAMA, GODSHALK, UNGAB, BACA, MARTINELLI, DETZER. ABSENT: PARRA. 7. PUBLIC HEARING – AMENDMENT TO TITLE 18 (ZONING) OF THE MUNICIPAL CODE CONCERNING THE FILING OF APPLICATIONS FOR CONDITIONAL USE PERMITS, VARIANCES AND OTHER DISCRETIONARY APPROVALS. PLANNING DIRECTOR COMMISSIONER DETZER REPORTED A LARGE WOODEN ADVERTISING SIGN AT THE CORNER OF MANCHESTER AND PLAZA BOULEVARD. COMMISSIONERS COMMISSIONER MARTINELLI REPORTED A REFRIGERATOR IN THE 10 May 21, 2001 ALLEY AT 15TH AND HARDING. IT CURRENTLY IS BLOCKING THE ALLEY, BUT PREVIOUSLY HAS BEEN SEEN BEHIND VARIOUS BUSINESSES. COMMISSIONER GODSHALK REPORTED WEEDS, PALM TREE CLIPPINGS AND OTHER TRASH AT EASTBOUND 18TH STREET AND I-5. COMMISSIONER BACA REPORTED HIGH WEEDS AT 16TH STREET AND “M” AVENUE. DIRECTOR POST STATED THAT SOON THE FIRE DEPARTMENT WILL BEGIN THEIR ANNUAL WEED ABATEMENT PROGRAM AND WE WILL MAKE SURE THESE WEEDS GET CUT. NO REPORT. CHAIRMAN NONE.
